These provisions presume that such an employee has an <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2015\/07\/can-i-get-disability-for-carpal-tunnel-syndrome.html\">occupational disease<\/a> suffered in the line of duty if the individual has heart disease, lung disease, hypertension, or similar conditions. Additionally, <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2015\/07\/can-i-sue-for-hearing-loss.html\">hearing loss<\/a> is covered in most cases. Maryland does not explicitly cover mental injuries, but there have been cases where the Maryland Court of Appeals determined that post-traumatic stress disorder (PTSD) was a compensable occupational disease.<\/p>\r\n<p>Like most states, Maryland <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/common-workers-compensation-defenses.html\">does not cover<\/a> intentional, self-inflicted injuries, or injuries incurred as a result of the employee&#8217;s intoxication.<\/p>\r\n<h2>Benefits<\/h2>\r\n<p>Maryland offers <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-in-depth.html\">wage replacement<\/a>, medical treatment, and vocational rehabilitation. Wage replacement is equal to two-thirds of your average weekly wage, subject to the state-imposed maximum. You receive your medical treatment from any physician you wish, and that physician can only charge you the rates permitted by the Workers&#8217; Compensation Commission. The Commission sets the rates for everything from examinations to expert testimony. If you are ultimately unable to <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-benefits-and-returning-to-work.html\">return to your occupation<\/a>, Maryland offers vocational rehabilitation to help you find a new occupation.<\/p>\r\n<h2>Dispute Resolution<\/h2>\r\n<p>The Maryland workers&#8217; compensation claim process is explained by <a href=\"http:\/\/www.wcc.state.md.us\/PDF\/Publications\/Claim_flow.pdf\" target=\"_blank\" rel=\"noopener\">this flow chart<\/a>. If your claim is <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-denied-here-are-your-next-steps.html\">denied<\/a> or you disagree with the amount of your wage benefits, you may request a hearing with the Commission. At the hearing, you or your attorney will present evidence supporting your position. This evidence may be in the form of documentation proving your average weekly wage, testimony from your physician proving the extent of your disability, and\/or testimony from your coworkers proving certain conditions in your work environment. After the hearing, an order will be issued dictating the benefits your employer&#8217;s workers&#8217; comp insurer owes you. If either you or your employer disagrees with the order, either of you may appeal the order to the Maryland Court.<\/p>\r\n<h2>Get a Claim Review from a Skilled Maryland Attorney<\/h2>\r\n<p>Work-related injuries can put employees in a tough spot.
