In the wake of a breakup or impending divorce, couples with minor children must address custody<\/a> and visitation issues.<\/p>\r\n

When one parent is the primary custodial parent, generally, the other parent has visitation rights. In most circumstances, Massachusetts law will refer to visitation rights as "parenting time."<\/p>\r\n

The child\u2019s parents can try to reach some consensus about what to do. If they succeed, they may enter into a parenting plan. "Legal custody" concerns decision-making authority regarding the child’s welfare. It involves identifying who will make major decisions for the child about medical care and schooling. It can be shared between parents or awarded solely to one parent.<\/p>\r\n

"Physical custody" determines where the child resides primarily. This determination may have a more direct impact on parenting time. It addresses the schedule of when the child will be with each parent. Physical custody of a child can also be shared between parents or awarded primarily to one parent.<\/p>\r\n

A custody order issued by a Massachusetts court<\/a> typically outlines these arrangements, detailing the rights and responsibilities of each parent. In cases of sole physical custody, the non-custodial parent is granted visitation rights to ensure continued involvement in the child’s life.<\/p>\r\n

    If the court finds that there’s abuse, then it may order: <\/p>\r\n

      \r\n

    • Pick-ups and drop-offs of the child in a safe location or in the presence of a third party<\/p>\r\n<\/li>\r\n

    • Visitation supervised by an appropriate person, visitation center, or agency<\/p>\r\n<\/li>\r\n

    • Conditional visitation for an abusive parent or parent based on their attending a treatment program<\/p>\r\n<\/li>\r\n

    • The parent to abstain from alcohol or controlled substances possession and consumption during the visitation and for 24 hours preceding visitation<\/p>\r\n<\/li>\r\n

    • No overnight visitation <\/p>\r\n<\/li>\r\n

    • Appointment of a guardian ad litem for the child to conduct an investigation and make recommendations<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr>
