The major federal law governing wages and hours is called the Fair Labor Standards Act (FLSA). The major state laws governing pay day requirements are known as the Massachusetts Wage Act. These laws address not only the payment of the basic minimum wage, but also regulate how many hours they can be required to work, overtime laws, and the special rules that apply to minors.<\/p>\r\n<p>Here, we will focus on Massachusetts state law including pay day requirements (frequency and manner), minimum wages, and overtime payment of wages.<\/p>\r\n<h2>Pay Day Requirements: How Often<\/h2>\r\n<p>A Commonwealth employer must pay wages weekly or bi-weekly, every two (2) weeks. An employer must pay employees who work five (5) or six (6) days in a calendar week within six (6) days of the end of the pay period. An employer must pay employees who work seven (7) days in a calendar week within seven (7) days of the end of the pay period. An employer must pay employees who work fewer than five (5) days in a calendar week within seven (7) days of the end of the pay period.<\/p>\r\n<h2>Method of Payment<\/h2>\r\n<p>An employer may pay wages by cash, check, or direct deposit, so long as the employee consents<\/p>\r\n<h2>FAQ About Massachusetts&nbsp;Minimum Wage and Overtime Pay<\/h2>\r\n<h3>What is the minimum&nbsp;wage in Massachusetts?<\/h3>\r\n<p>The minimum wage for employees is $14.25 per hour. The minimum wage for tipped employees is $6.15 per hour.<\/p>\r\n<h3>When is an employee&nbsp;entitled to overtime pay?<\/h3>\r\n<p>Most employees must be paid one and one-half times their regular hourly rate for all hours worked in excess of 40 hours in a given work week. State law does not require overtime after eight hours in a day.<\/p>\r\n<h3>Where can an employee file a wage complaint if the employee believes they have not been paid properly?<\/h3>\r\n<p>Complaints may be filed with the Office of the Attorney General&#8217;s Fair Labor and Business Practices Division.<\/p>\r\n<h3>Is there a penalty for&nbsp;an&nbsp;employer&nbsp;who fails&nbsp;to follow wage and hour&nbsp;laws?<\/h3>\r\n<p>Yes. An employee must be free to leave the workplace during the break.
