For the most part, these laws apply to all new <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/fencing-laws-and-your-neighbors-faqs.html\">fence installations<\/a>. However, your municipality may have other land use regulations that impact the design of your fence and the materials you can use to construct your fence.<\/p>\r\n<p>According to state law, a <a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-49-sect-2\/\" target=\"_blank\" rel=\"noopener\">lawful fence<\/a> must meet the following requirements:<\/p>\r\n<ul>\r\n<li>The fence must be at least four feet high<\/li>\r\n<li>The property owner must maintain the fence in a state of good repair<\/li>\r\n<li>The homeowner installing the fence may only use the following materials:<ul>\r\n<li>Rails<\/li>\r\n<li>Boards<\/li>\r\n<li>Iron<\/li>\r\n<li>Stone<\/li>\r\n<li>Timber<\/li>\r\n<\/ul>\r\n<\/li>\r\n<li>Residential fences cannot be constructed with of barbed wire<\/li>\r\n<li>You only need a fence permit if your fence is over seven feet tall<\/li>\r\n<\/ul>\r\n<p>If you have legal questions about your fence installation or fence disputes with your neighbors, it&#8217;s best to contact a <a href=\"https:\/\/lawyers.findlaw.com\/real-estate-law\/massachusetts\/?fli=dcta\" title=\"local real estate lawyer\" target=\"_blank\" rel=\"noopener\">local real estate lawyer<\/a>. For those who live in a community with a <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/home-owners-associations.html\">homeowner&#8217;s association<\/a> (HOA), confirm whether the bylaws contain any special rules regarding new fences or fence maintenance.<\/p>\r\n<h2><b>Fence Costs and Fence Maintenance<\/b><\/h2>\r\n<p>Property owners often question whether they are responsible for the costs of repairing and maintaining a division fence. State law requires landowners on both sides of a <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/fencing-on-property-line-who-pays-for-and-maintains-it.html\">boundary fence<\/a> to share all construction and maintenance costs, unless they make other arrangements.<\/p>\r\n<p>If your neighbor <a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-49-sect-4.html\" target=\"_blank\" rel=\"noopener\">refuses to pay<\/a>, you can file a complaint with the county&#8217;s fence viewer. If the fence viewer finds in your favor, you may be able to collect twice the amount of the delinquent owner&#8217;s share. If your neighbor doesn&#8217;t pay within 30 days, you can sue for an additional 1% per month in interest.<\/p>\r\n<h2><b>What Does a Fence Viewer Do?<\/b><\/h2>\r\n<p>According to Massachusetts state law, every town must annually appoint two or more fence viewers to settle residents&#8217; <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/neighbor-fence-disputes.html\">fencing disputes<\/a>. The fence viewer will investigate to help resolve the issue.<\/p>\r\n<p>Property owners can request a <a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-49-sect-1\/\" target=\"_blank\" rel=\"noopener\">fence viewer<\/a> to come and determine if a boundary fence is in good repair. They can also resolve issues regarding a fence&#8217;s size, condition, and distance from homeowners&#8217; property lines.<\/p>\r\n<h2><b>Can You Make a Neighbor Cut Their Trees?<\/b><\/h2>\r\n<p>Property owners have a right to plant trees, so it&#8217;s difficult to dispute your neighbor having too many trees or <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/what-can-you-do-about-an-encroachment.html\">encroaching branches<\/a>. However, as a property owner, you also have the right to quiet enjoyment. If your neighbor&#8217;s trees are encroaching on your property, you have options.<\/p>\r\n<p>Under Massachusetts law, there are a few instances where you can force a neighbor to trim or cut down a healthy tree by filing a <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/private-nuisance.html\">private nuisance claim<\/a>. You must demonstrate that your neighbor&#8217;s tree growth interrupts the use and enjoyment of your property and that you cannot reach an amicable resolution.<\/p>\r\n<p>You can trim branches to your property line when branches cross your property. However, if you damage the tree&#8217;s health or <a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-87-sect-11.html\" target=\"_blank\" rel=\"noopener\">trim branches on your neighbor&#8217;s property<\/a>, you may face criminal penalties of up to six months in jail.<\/p>\r\n<h2><b>Spite Fences and Your Right to Sunlight<\/b><\/h2>\r\n<p>Some states, including Massachusetts, prohibit homeowners from erecting &quot;<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-49-sect-21\/\" target=\"_blank\" rel=\"noopener\">spite fences<\/a>.&quot; A spite fence is just what it sounds like &#8211; a fence over six feet tall that a property owner erects maliciously or to annoy their neighbor.<\/p>\r\n<p>You can file a private nuisance claim if your neighbor installs a spite fence. You can also demand damages under <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries.html\">Massachusetts&#8217; tort law<\/a>. Keep in mind that it&#8217;s difficult to quantify damages in this type of lawsuit.<\/p>\r\n<p>In Massachusetts, landowners do not have legal rights to sunshine or a pretty view.
