Sometimes, those laws conflict with each other. For example, Michigan has legalized marijuana for medicinal and recreational purposes. However, marijuana is illegal at the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/federal-marijuana-laws.html\">federal level<\/a>.<\/p>\r\n<p>Drug laws are distinguished by the conduct involved. This means that different penalties exist for drug manufacturing, distribution, and possession. Michigan&#8217;s drug possession laws are separate from its <a href=\"https:\/\/www.findlaw.com\/state\/michigan-law\/michigan-drug-cultivation-and-manufacturing-laws.html\">drug cultivation\/manufacturing<\/a> and <a href=\"https:\/\/www.findlaw.com\/state\/michigan-law\/michigan-drug-distribution-laws.html\">distribution laws<\/a>.<\/p>\r\n<p>Both the federal and state governments classify controlled substances into different schedules. The more dangerous a drug is, the higher the penalties one will face if convicted of possession.<\/p>\r\n<p>Schedule 1 (Schedule I under federal law) controlled substances are the most dangerous drugs, meaning they have a high potential for abuse and no accepted medical uses. For more information, visit FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-charges.html\">Drug Charges<\/a> section.<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Michigan Drug Possession Law Code Section<\/b><\/p>\r\n<\/th>\r\n<td><a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-333-health\/#!tid=NCEF2F9E0314B11DBA6A3AFB4DB39BD01\" target=\"_blank\" rel=\"noopener\">Michigan Compiled Laws (MCL) Chapter 333<\/a><ul>\r\n<li>MCL \u00a7 <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-333-health\/mi-comp-laws-333-7403.html\" target=\"_blank\" rel=\"noopener\">333.7403 <\/a>(<i>Possession of a controlled substance<\/i>)<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Drug Possession Crimes in Michigan<\/b><\/p>\r\n<\/th>\r\n<td><p>Per MCL 333.7403, it&#8217;s prohibited for a person to possess the following with knowledge and intent:<\/p>\r\n<ul>\r\n<li>A controlled substance<\/li>\r\n<li>A controlled substance analog<\/li>\r\n<li>A prescription form unless it&#8217;s a valid prescription or by a practitioner&#8217;s order<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Michigan Drug Possession Charges and Penalties<\/b><\/p>\r\n<\/th>\r\n<td><p>Anyone who violates <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-333-health\/mi-comp-laws-333-7403.html\" target=\"_blank\" rel=\"noopener\">MCL 333.7403<\/a> by possessing a Schedule I or II narcotic drug, including mixtures, in the following amounts is guilty of a felony and faces the following punishments upon conviction:<\/p>\r\n<ul>\r\n<li><b>1,000 grams or more<\/b>: Up to life imprisonment and a fine of up to $1,000,000<\/li>\r\n<li><b>Between 450 and 1,000 grams<\/b>: Up to 30 years in prison and a fine of up to $500,000<\/li>\r\n<li><b>Between 50 and 450 grams<\/b>: Up to 20 years in prison and a fine of up to $250,000<\/li>\r\n<li><b>Between 25 and 50 grams<\/b>: Up to four years in prison and a fine of up to $25,000<\/li>\r\n<li><b>Under 25 grams<\/b>: Up to four years of prison time and a fine of up to $25,000<\/li>\r\n<li><b>Possession of ecstasy, MDMA, or methamphetamine (any amount)<\/b>: Up to 10 years in prison and a fine of up to $15,000<\/li>\r\n<li><b>Any amount of a Schedule I, II, III, or IV substance or analog not noted above<\/b>: Up to two years in prison and a fine of $2,000<\/li>\r\n<\/ul>\r\n<p>Under <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-333-health\/mi-comp-laws-333-7403.html\" target=\"_blank\" rel=\"noopener\">MCL \u00a7 333.7403<\/a>, possession of the following are misdemeanors:<\/p>\r\n<ul>\r\n<li><b>Any amount of LSD, peyote, mescaline, psilocybin, or Schedule V controlled substances<\/b>: Up to one year in jail and a fine of up to $2,000<\/li>\r\n<li><b>Marijuana or synthetic marijuana over the legal limit<\/b>: Penalties may depend on intent.
