It\u2019s your home\u2019s value minus what you still owe on the mortgage.<\/p>\n<h3>What Qualifies as a Homestead?<\/h3>\n<p>For <span data-term-id=\"52745897\">Michigan<\/span>\u2019s equity protection, a homestead is the <span data-term-id=\"52745908\">primary residence<\/span> a <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home.html\"><span data-term-id=\"52745899\">homeowner<\/span><\/a> occupies and uses as their <span data-term-id=\"52745933\">permanent home<\/span>. Let\u2019s say your THR is $40,000 and the <span data-term-id=\"52745900\">property tax<\/span> on your homestead is $2,500. That means 3.2% of your THR = $1,280. Your <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-211-taxation-of-real-and-personal-property\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52745900\">property taxes<\/span><\/a> ($2,500) are $1,220 more than the income threshold (3.2%), so the state will refund you 60% of the $1,220 (the amount above the income threshold). Since 60% of $1,220 = $732, this is the amount of your tax credit.<\/p>\n<p>Don\u2019t worry &#8211; you\u2019re not expected to calculate this yourself. Claim this credit on your <span data-term-id=\"52745928\">income tax return<\/span> and complete the <span data-term-id=\"52745914\">Homestead <\/span><span data-term-id=\"52745914\">Property Tax<\/span><span data-term-id=\"52745914\"> Credit<\/span> form. The <a href=\"https:\/\/www.michigan.gov\/treasury\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52745918\">Michigan<\/span><span data-term-id=\"52745918\"> Department of Treasury<\/span><\/a> will do the math for you and refund the credit amount.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenant-rights.html\"><span data-term-id=\"52745906\">Renters<\/span> may also qualify<\/a> for <span data-term-id=\"52745897\">Michigan<\/span>\u2019s <span data-term-id=\"52745914\">homestead <\/span><span data-term-id=\"52745914\">property tax<\/span><span data-term-id=\"52745914\"> credit<\/span>. <span data-term-id=\"52745897\">Michigan<\/span> treats 23% of your annual rent as if it were <span data-term-id=\"52745900\">property taxes<\/span> you paid on your homestead. If 23% of rent paid exceeds 3.2% of THR, they qualify for the credit. Because <span data-term-id=\"52745906\">renters<\/span> aren\u2019t the <span data-term-id=\"52745902\">property owners<\/span>, the $165,400 <span data-term-id=\"52745912\">taxable value<\/span> cap doesn\u2019t apply.<\/p>\n<p>Let\u2019s take a look at an example where the <span data-term-id=\"52745906\">renter<\/span>\u2019s THR is $40,000, and <a href=\"https:\/\/www.findlaw.com\/state\/michigan-law\/michigan-tenant-rights-laws.html\">they paid $12,000 in rent<\/a> for the year. Their \u201c<span data-term-id=\"52745900\">property tax<\/span> equivalent\u201d is 23% of $12,000 ($2,760). The income threshold is 3.2% of $40,000 ($1,280). Since $2,760 is $1,480 more than the income threshold ($1,280), the state will refund the <span data-term-id=\"52745906\">renter<\/span> 60% of that $1,480. 60% of $1,480 = $888. In this example, their tax credit would be $888.<\/p>\n<p>For both <span data-term-id=\"52745906\">renters<\/span> and <span data-term-id=\"52745899\">homeowners<\/span>, the credit begins to phase out once THR exceeds $62,500.
