The law only applies when an officer is lawfully &#8220;performing his or her duties,&#8221; giving you a legal right to resist an <span data-term-id=\"41176766\">unlawful arrest<\/span>. Despite this right, physically resisting can be extremely dangerous, and the safest approach is to challenge the arrest&#8217;s legality in court with the help of an experienced attorney.<\/p>\n\n    <\/div>\n\n\n\n<p><span data-term-id=\"41176767\">Resisting arrest charges<\/span> in the <span data-term-id=\"41176775\">state of <\/span><span data-term-id=\"41176759\">Michigan<\/span> cover assaulting or <span data-term-id=\"41176758\">obstructing<\/span> a public officer in the performance of their duties. They aren\u2019t limited to interactions with <span data-term-id=\"41176760\">police officers<\/span> or even situations involving an arrest.<\/p>\n<p>In this article, we\u2019ll explain how <span data-term-id=\"41176759\">Michigan<\/span> defines the <span data-term-id=\"41176787\">criminal charge<\/span> referred to as resisting arrest. We\u2019ll also go over the potential penalties and possible defenses.<\/p>\n<h2>How <span data-term-id=\"41176762\">Michigan<\/span><span data-term-id=\"41176762\"> Law<\/span> Defines Resisting Arrest<\/h2>\n<p><span data-term-id=\"41176759\">Michigan<\/span>\u2019s main <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-81d.html\" target=\"_blank\" rel=\"noopener\">statute for resisting arrest<\/a> defines the full charge as assaulting, <span data-term-id=\"41176769\">battering<\/span>, resisting, <span data-term-id=\"41176758\">obstructing<\/span>, or opposing a person performing duty.<\/p>\n<p>The essential elements are that someone assaults, <span data-term-id=\"41176769\">batters<\/span>, wounds, resists, <span data-term-id=\"41176758\">obstructs<\/span>, opposes, or endangers a person whom the individual knows or has reason to know is performing their duties. The person performing their duties under the statute includes:<\/p>\n<ul>\n<li><span data-term-id=\"41176760\">Police officers<\/span> (including campus <span data-term-id=\"41176791\">security officers<\/span>)<\/li>\n<li><span data-term-id=\"41176793\">Peace officers<\/span><\/li>\n<li><span data-term-id=\"41176786\">Conservation officers<\/span><\/li>\n<li>Sheriffs and their deputies<\/li>\n<li>Firefighters<\/li>\n<li>Emergency medical services personnel (EMTs) and paramedics<\/li>\n<\/ul>\n<p>Resisting means <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-81d.html\" target=\"_blank\" rel=\"noopener\">assaulting, <span data-term-id=\"41176769\">battering<\/span><\/a>, or using other <span data-term-id=\"41176800\">physical force<\/span>. <span data-term-id=\"41176758\">Obstructing<\/span> refers to force, threat of force, or refusing to comply with <span data-term-id=\"41176770\">lawful commands<\/span>.<\/p>\n<p>What does all that mean? It indicates that you can receive <span data-term-id=\"41176767\">resisting arrest charges<\/span> for almost any interference with an officer attempting to carry out their duties. The key requirement is that you know they are public officials performing elements of their job.<\/p>\n<h2>Other Public Officials<\/h2>\n<p>Another <a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-479.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41176794\">Michigan<\/span><span data-term-id=\"41176794\"> resisting arrest<\/span> statute<\/a> covers a broader category of public officials who don\u2019t carry out arrests but might encounter resistance or <span data-term-id=\"41176758\">obstruction<\/span>. It uses the same key language, requiring an official to be performing their duties. The statute also interprets <span data-term-id=\"41176758\">obstruction<\/span> in the same way.<\/p>\n<p><span data-term-id=\"41176762\">Michigan<\/span><span data-term-id=\"41176762\"> laws<\/span> categorize almost any public official as a public officer for purposes of <span data-term-id=\"41176765\">resisting and <\/span><span data-term-id=\"41176758\">obstructing<\/span>. A wide array of public employees may have lawful authority under this law, including:<\/p>\n<ul>\n<li>Judges, prosecutors, or other court officials<\/li>\n<li>Probation and parole officers<\/li>\n<li>Medical examiners<\/li>\n<\/ul>\n<p>Individuals may face <span data-term-id=\"41176787\">criminal charges<\/span> for assaulting or impeding any such individual in the course of their duties.<\/p>\n<h2>Penalties for Resisting Arrest in <span data-term-id=\"41176759\">Michigan<\/span><\/h2>\n<p>Resisting arrest can be assessed as either\u00a0a <span data-term-id=\"41176782\">felony charge<\/span> or a\u00a0<span data-term-id=\"41176801\">misdemeanor<\/span><span data-term-id=\"41176801\"> offense<\/span>. It will depend on the details of the incident.<\/p>\n<p>Penalties for a <span data-term-id=\"41176776\">resisting and <\/span><span data-term-id=\"41176758\">obstructing<\/span><span data-term-id=\"41176776\"> charge<\/span> depend on the level of force used and whether the officer suffered serious injuries or required <span data-term-id=\"41176777\">medical care<\/span> after the event. In all cases, conviction on <span data-term-id=\"41176782\">felony <\/span><span data-term-id=\"41176780\">charges<\/span><span data-term-id=\"41176780\"> of resisting<\/span> will result in imprisonment and fines. Some of the possible outcomes include:<\/p>\n<ul>\n<li><strong>Baseline felony<\/strong>: Up to two years in prison, a fine of up to $2,000, or both<\/li>\n<li><strong>Causing <span data-term-id=\"41176764\">bodily injury<\/span><\/strong>: If <span data-term-id=\"41176773\">medical attention<\/span> is required, up to four years in prison, a fine of up to $5,000, or both<\/li>\n<li><strong>Causing serious impairment<\/strong>: If the act causes a &#8220;<span data-term-id=\"41176771\">serious impairment of a body function<\/span>,&#8221; up to 15 years in prison and a fine of up to $10,000, with some variation<\/li>\n<li><strong>Causing death<\/strong>: Up to 20 years in prison and a fine of up to $20,000<\/li>\n<\/ul>\n<p>These penalties can be served consecutively, meaning the sentence for resisting can be added on top of the sentence for any other crime committed during the incident.<\/p>\n<h2>Can You Legally Resist an <span data-term-id=\"41176766\">Unlawful Arrest<\/span> in <span data-term-id=\"41176759\">Michigan<\/span>?<\/h2>\n<p>The right to resist an <span data-term-id=\"41176766\">unlawful arrest<\/span> is rooted in common law. Some states still allow it as a defense to resisting arrest, while others have abolished it in their criminal statutes.<\/p>\n<p>In 2012, the <span data-term-id=\"41176789\">Michigan<\/span><span data-term-id=\"41176789\"> Supreme Court<\/span> ruled in <a href=\"https:\/\/clearinghouse.net\/doc\/41244\/\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"41176792\">People v. Moreno<\/span><\/em><\/a> that the state\u2019s resisting arrest statute did not abolish resisting <span data-term-id=\"41176766\">unlawful arrest<\/span>. The Court&#8217;s majority opinion centered on the phrase &#8220;performing his or her duties&#8221; as used in the resisting arrest statute. It held that an unlawful action, such as an illegal arrest or an <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-reasonableness-requirement.html\">unconstitutional search<\/a>, is by definition outside the scope of an officer&#8217;s official duties. The prosecution must prove the arrest was lawful to get a conviction.<\/p>\n<p>While this indicates that it\u2019s possible to legally resist an <span data-term-id=\"41176766\">unlawful arrest<\/span> under <span data-term-id=\"41176759\">Michigan<\/span> <span data-term-id=\"41176772\">state law<\/span>, that doesn\u2019t always mean it\u2019s safe or wise to do so. Most <a href=\"https:\/\/lawyers.findlaw.com\/lawyer\/criminal-law\/michigan?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41176763\">criminal defense attorneys<\/span><\/a> recommend not resisting, even if you believe the arrest itself is illegal. It\u2019s best to let a <span data-term-id=\"41176785\">defense lawyer<\/span> handle establishing <span data-term-id=\"41176798\">reasonable doubt<\/span> around the lawfulness of the arrest.<\/p>\n<h2>Defenses Available for a <span data-term-id=\"41176767\">Resisting Arrest Charge<\/span><\/h2>\n<p>If you\u2019re facing a <span data-term-id=\"41176767\">resisting arrest charge<\/span>, it\u2019s important to know what defense options might be available. What could work will vary by situation. Other possible defenses include:<\/p>\n<ul>\n<li><strong>Police misconduct: <\/strong>As the <em>Moreno <\/em>court held, if an officer\u2019s conduct is illegal, they aren\u2019t performing their duties. For example, let\u2019s say a <span data-term-id=\"41176760\">police officer<\/span> casually stops you, with no indication that you\u2019ve committed a crime. They try to take your laptop bag and say they\u2019re confiscating your laptop. You pull the bag away and hold onto it. If they have no warrant and no probable cause to believe the laptop is evidence of a crime, you could argue that you were lawfully resisting an illegal <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-seizure.html\">search and seizure<\/a>.<\/li>\n<li><strong><span data-term-id=\"41176790\">Excessive force<\/span><\/strong>: If an officer uses force that is not reasonably necessary to make an arrest, they are committing an assault. Using <span data-term-id=\"41176790\">excessive force<\/span> is a prime example of an unlawful act that negates an element of resisting arrest.<\/li>\n<li><strong>Lack of communication<\/strong>: The defendant must know, or have reason to know, that the person they are resisting is a public officer performing their duties. If you were unaware or uncertain that the individual was an officer, your response might be considered reasonable. A plainclothes <span data-term-id=\"41176760\">police officer<\/span> driving an unmarked vehicle who doesn\u2019t identify themselves can be construed as a threat and justify resisting arrest.<\/li>\n<li><strong>Lack of <span data-term-id=\"41176800\">physical force<\/span><\/strong>: If you do not use or threaten <span data-term-id=\"41176800\">physical force<\/span>, you can only be found guilty of <span data-term-id=\"41176758\">obstruction<\/span> for non-compliance if the prosecution proves the officer&#8217;s command was lawful.
