In Michigan, an employer must carry <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-benefits-explained.html\"><span data-term-id=\"53092185\">workers&#8217; compensation<\/span><span data-term-id=\"53092185\"> insurance<\/span><\/a> if they have three or more employees at any time or one employee working 35 hours or more per week. This includes:<\/p>\n<ul>\n<li>All <span data-term-id=\"53092194\">private employers<\/span>, including <span data-term-id=\"53092219\">part-time<\/span> workers if there are more than three workers<\/li>\n<li>Public employers and government agencies<\/li>\n<li>Agricultural and farm employers with three or more employees working 35 or more hours for 13 weeks or more<\/li>\n<li>Households who have domestic workers (maids, nannies) who work on the premises for more than 35 hours per week<\/li>\n<\/ul>\n<p>Coverage begins as soon as an employee begins working for the company. There\u2019s no required amount of time that an employee must work for <span data-term-id=\"53092177\">workers\u2019 compensation<\/span> to apply. Employers not required to carry\u00a0<span data-term-id=\"53092179\">workers\u2019 comp<\/span>\u00a0may provide it voluntarily.<\/p>\n<h3>Exemptions<\/h3>\n<p><span data-term-id=\"53092214\">Sole proprietors<\/span> are not their own employees and aren\u2019t required to carry <span data-term-id=\"53092179\">workers\u2019 comp<\/span> for themselves. If they hire employees, they must have a policy as soon as they reach the state threshold.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/being-an-independent-contractor-vs-employee.html\"><span data-term-id=\"53092197\">Independent contractors<\/span><\/a> are not considered employees. Michigan uses the IRS multifactor test to determine if someone is an <span data-term-id=\"53092197\">independent contractor<\/span> or a paid employee. If an employee is misclassified, they may need to speak to a <a href=\"https:\/\/lawyers.findlaw.com\/workers-compensation-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"53092179\">workers\u2019 comp<\/span> attorney<\/a> to get their proper benefits.<\/p>\n<p>Partners, LLC members, and corporate officers may be classified as employees and covered by <span data-term-id=\"53092177\">workers\u2019 compensation<\/span>. They can file a waiver with the state if they prefer to use other insurance.<\/p>\n<h3>Covered Injuries<\/h3>\n<p><span data-term-id=\"53092190\">Workers\u2019 comp<\/span><span data-term-id=\"53092190\"> insurance<\/span> only covers <span data-term-id=\"53092178\">work-related injuries<\/span> and illnesses. If an injury happens during regular work hours in the course of your daily job duties, it should be covered by <span data-term-id=\"53092177\">workers\u2019 compensation<\/span>. Any illness that can be shown to be caused by something you encountered at work or during the course of employment is also covered.<\/p>\n<p><span data-term-id=\"53092212\">Insurance coverage<\/span> does not apply to anything that occurs outside the \u201cnormal scope of business.\u201d <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/the-going-and-coming-rule.html\">Traveling to and from work<\/a> is not covered, and injuries that happen during unpaid breaks taken off property are also exempt. However, if you\u2019re required to take lunch breaks in a company break area, your injury may be covered. If your job requires you to travel or you use a company vehicle, <span data-term-id=\"53092177\">workers\u2019 compensation<\/span> covers you while you\u2019re on the clock.<\/p>\n<p>If you have a pre-existing condition and your workplace injury aggravates or worsens it, <span data-term-id=\"53092179\">workers\u2019 comp<\/span> will cover any additional treatment necessary. For instance, if you had a back injury before starting the job and reinjured it while performing lifting required at work, <span data-term-id=\"53092179\">workers\u2019 comp<\/span> will cover treatment for this new injury.<\/p>\n<h3>Injuries Not Covered<\/h3>\n<p><span data-term-id=\"53092177\">Workers\u2019 compensation<\/span> doesn\u2019t cover injuries due to intentional or willful misconduct, such as deliberately ignoring safety requirements or disobeying posted rules. Refusal to follow posted safety protocols may result in your <span data-term-id=\"53092204\">workers\u2019 comp<\/span><span data-term-id=\"53092204\"> claim<\/span> being denied.<\/p>\n<p>Horseplay and goofing off that leads to injuries may not be covered, although Michigan courts recognize that some fooling around occurs at most workplaces. If the horseplay crosses the line into recklessness or negligence, you may not be able to use <span data-term-id=\"53092179\">workers\u2019 comp<\/span> for your injuries.<\/p>\n<h2>Types of <span data-term-id=\"53092186\">Workers&#8217; Compensation<\/span><span data-term-id=\"53092186\"> Benefits<\/span> in Michigan<\/h2>\n<p><span data-term-id=\"53092177\">Workers&#8217; compensation<\/span> covers all \u201creasonable and <span data-term-id=\"53092226\">necessary <\/span><span data-term-id=\"53092183\">medical care<\/span>\u201d after an injury or work-related illness. Your bills are sent directly to the <span data-term-id=\"53092206\">insurance carrier<\/span>, and you shouldn\u2019t pay anything out of pocket for your coverage. <span data-term-id=\"53092183\">Medical care<\/span> continues until you can return to work or reach \u201cmaximum medical improvement.\u201d<\/p>\n<p>The <span data-term-id=\"53092184\">wage loss benefit<\/span> is paid after the first full week of missed work. Wages are paid at about 80% of the worker\u2019s <span data-term-id=\"53092189\">average weekly wages<\/span> (after tax), based on the highest-paid 39 weeks of the last 52 weeks before the <span data-term-id=\"53092193\">date of injury<\/span>. If a worker can&#8217;t return to their previous job, they may receive\u00a0<span data-term-id=\"53092208\">vocational rehabilitation<\/span>\u00a0and job retraining for up to two years to help them find new employment or train for a new position within the company.<\/p>\n<h3>Temporary Total Disability<\/h3>\n<p>If you can\u2019t work while you recover but will be able to do so at some point, your doctor may place you on temporary total disability. <span data-term-id=\"53092179\">Workers\u2019 comp<\/span> will pay you <span data-term-id=\"53092211\">disability benefits<\/span> of up to 80% of your <span data-term-id=\"53092189\">average weekly wage<\/span>. The state pays up to 90% of the state average wage, about $1,201 in 2026. There is no absolute minimum, but <span data-term-id=\"53092213\">state law<\/span> guarantees at least 25% of the state <span data-term-id=\"53092189\">average weekly wage<\/span>. This payment continues until you are removed from temporary total disability.<\/p>\n<h3>Temporary Partial Disability<\/h3>\n<p>If you can work with specific limitations, such as reduced hours or light duty, your doctor can place you on temporary partial disability. You must accept any suitable job offer, or risk losing your <span data-term-id=\"53092184\">wage-loss benefits<\/span>. If your employer cannot meet the accommodations or has no suitable position, you may need to remain off work. Your <span data-term-id=\"53092192\">medical benefits<\/span> continue during this period until you can return to full work capacity.<\/p>\n<h3><span data-term-id=\"53092225\">Permanent Disability<\/span><\/h3>\n<p>If you reach maximum medical improvement and remain unable to return to your previous job position, you may be considered permanently disabled. <span data-term-id=\"53092202\">Michigan <\/span><span data-term-id=\"53092179\">workers\u2019 comp<\/span> has \u201c<span data-term-id=\"53092199\">specific loss<\/span>\u201d categories for partial <span data-term-id=\"53092225\">permanent disability<\/span> and total <span data-term-id=\"53092225\">permanent disability<\/span>. Permanently <span data-term-id=\"53092196\">injured employees<\/span> may receive up to 800 weeks of disability payments at 80% of their wages, which can be extended for life, or a lump-sum payment if they choose.<\/p>\n<p><strong><span data-term-id=\"53092199\">Specific Loss<\/span> and Permanent Partial Disability<\/strong> involve loss of a body part, such as a hand, eye, or leg. The worker can continue working at another job, but will likely need retraining and additional rehabilitation. <strong>Permanent Total Disability<\/strong> is an extreme case. It involves injuries such as losing both eyes or multiple amputations. These often prevent a return to gainful employment.<\/p>\n<h3><span data-term-id=\"53092207\">Death Benefits<\/span><\/h3>\n<p><span data-term-id=\"53092207\">Death benefits<\/span> are paid to spouses and minor children if a worker dies from a <span data-term-id=\"53092178\">work-related injury<\/span> or illness. The benefits help pay for funeral expenses and provide financial assistance to eligible dependents. Spouses receive 80% of the worker\u2019s <span data-term-id=\"53092189\">average weekly wage<\/span> after taxes, for up to 500 weeks. Minor children receive payments until they reach the age of 18. Payments can continue to the age of 21 in some cases, and indefinitely for adult children with physical or mental disabilities. A lump-sum funeral allowance of up to $6,000 is available immediately after the worker\u2019s death.<\/p>\n<h2>How To File a <span data-term-id=\"53092180\">Michigan <\/span><span data-term-id=\"53092187\">Workers&#8217; Compensation<\/span><span data-term-id=\"53092187\"> Claim<\/span><\/h2>\n<p>Notify your employer immediately if you\u2019re injured on the job. You have up to 90 days to report the injury, but report it as soon as possible. Your <span data-term-id=\"53092192\">medical benefits<\/span> should begin immediately, but it takes seven days, including weekends and holidays, before your wage replacement benefits begin.<\/p>\n<p>Always report your injury to your employer in writing. Don\u2019t assume that because you were treated at work or transported from your job site, your employer knows about your injury.<\/p>\n<p>Your employer may designate a doctor for you for the first 28 days of treatment. After that, you may request your own doctor by filing a form with the LEO.<\/p>\n<p>Not all injuries and illnesses appear immediately, so you have two years to file a formal <span data-term-id=\"53092187\">workers\u2019 compensation<\/span><span data-term-id=\"53092187\"> claim<\/span>. For instance, suppose you were driving a forklift in your company warehouse and accidentally hit a pillar. You suffered a minor neck injury, which you reported to your employer and were treated by the company first-aid office. Over the next few weeks, your neck started to hurt worse, and the following month you couldn\u2019t even turn it. A trip to the company doctor revealed a torn ligament. Because you reported it promptly, you can still file a <span data-term-id=\"53092187\">workers\u2019 compensation<\/span><span data-term-id=\"53092187\"> claim<\/span> and receive treatment under your employer\u2019s policy.<\/p>\n<h2>What if My <span data-term-id=\"53092204\">Workers&#8217; Comp<\/span><span data-term-id=\"53092204\"> Claim<\/span> Is Denied?<\/h2>\n<p>If your claim is denied or you dispute the\u00a0<span data-term-id=\"53092181\">insurance company<\/span>\u00a0or employer&#8217;s decision, you may file an application for mediation or a\u00a0hearing with the bureau within two years of the injury. If the dispute is not resolved at the mediation, the case is assigned a trial date before a <span data-term-id=\"53092177\">workers&#8217; compensation<\/span> judge. You may represent yourself during this process, but an attorney can be extremely helpful in meeting deadlines, gathering evidence, and representing you against the <span data-term-id=\"53092181\">insurance company<\/span>&#8216;s attorneys.<\/p>\n<h3>Common Reasons for Denial<\/h3>\n<p>The most common reason a claim is denied is for missed deadlines. If you don\u2019t notify your employer about a <span data-term-id=\"53092178\">work-related injury<\/span> within 90 days, or file a claim within two years of the injury, it can be automatically denied.<\/p>\n<p>Other common reasons for denial may include:<\/p>\n<ul>\n<li><strong>Disputed cause of injury<\/strong>: The insurer may argue that the injury didn\u2019t occur at work or that it was due to a pre-existing condition and not aggravated by your working conditions. Timely reporting can help avoid this. Michigan insurers cannot deny coverage for pre-existing conditions, but you will need strong medical records to establish your prior condition and how your job worsened it.<\/li>\n<li><strong>Medical examination conflicts<\/strong>: <span data-term-id=\"53092181\">Insurance companies<\/span> may demand an independent medical exam if they believe you\u2019re fully healed or dispute the nature of your injury. Your employer can send you to their own doctor for the first 28 days after the injury. After that date, you can request your own doctor.<\/li>\n<li><strong>Failure to follow medical instructions<\/strong>: If you don\u2019t follow your doctor\u2019s orders for treatment and rehabilitation, miss appointments, or return to work too soon, you can lose your <span data-term-id=\"53092200\">workers\u2019 comp<\/span><span data-term-id=\"53092200\"> benefits<\/span> or give the insurer grounds to dispute or deny your claim. Follow the doctor\u2019s instructions to the letter.<\/li>\n<li><strong>Incomplete or inaccurate records<\/strong>: Any gaps in your medical records can make it difficult to prove that a pre-existing condition is related to your current injury. Discrepancies between your initial statement and later medical reports will make investigators take a second look at your file.<\/li>\n<\/ul>\n<p>Keep all documents involved with your claim, including medical bills and instructions. If you need to contest a denial, having the receipts can make a big difference.<\/p>\n<h3>Misclassification<\/h3>\n<p>Employers may misclassify paid employees as <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/starting-a-business\/new-rules-for-independent-contractors.html\"><span data-term-id=\"53092197\">independent contractors<\/span> <\/a>to avoid paying benefits, including <span data-term-id=\"53092186\">workers\u2019 compensation<\/span><span data-term-id=\"53092186\"> benefits<\/span>.
