They can lawfully use force and other tactics when conducting police business. However, they must not exceed their authority and cross the line into unacceptable behavior.&nbsp;<\/p>\r\n<p>So, where is the line? What is&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/police-misconduct-and-civil-rights.html\">police misconduct<\/a>? How do you know when the police can be held accountable for their behavior?<\/p>\r\n<h2>Illegal Police Behaviors<\/h2>\r\n<p>Both state and&nbsp;<a href=\"https:\/\/www.justice.gov\/crt\/addressing-police-misconduct-laws-enforced-department-justice\" target=\"_blank\" rel=\"noopener\">federal laws<\/a>&nbsp;address certain conduct by police officers that may be considered &quot;actionable.&quot; If something is actionable, it means you can take legal action against someone for the act.<\/p>\r\n<p>Federal law addresses violations of civil rights. Under federal law, a law enforcement officer may be charged with misconduct for:<\/p>\r\n<ul>\r\n<li>Using excessive force<\/li>\r\n<li>Sexual assault<\/li>\r\n<li>Intentional false arrests<\/li>\r\n<li>Theft<\/li>\r\n<li>Intentional fabrication of evidence<\/li>\r\n<\/ul>\r\n<h2>Minnesota Law on Police Misconduct<\/h2>\r\n<p>Minnesota also has its own statutes covering misconduct. These laws are broader than the federal regulations, so they make more actions illegal.<\/p>\r\n<p>In Minnesota, misconduct can also occur when an officer:<\/p>\r\n<ul>\r\n<li>Fails or refuses to perform mandatory duties<\/li>\r\n<li>Exceeds their lawful authority<\/li>\r\n<\/ul>\r\n<p>Criminal charges may apply to police misconduct. The most common interactions occur during:<\/p>\r\n<ul>\r\n<li>Traffic stops<\/li>\r\n<li>Arrests<\/li>\r\n<li>Detentions<\/li>\r\n<li>Interrogations<\/li>\r\n<\/ul>\r\n<p><i><b>Examples of Police Misconduct:<\/b><\/i><\/p>\r\n<ul>\r\n<li>Discrimination because of race or religion<\/li>\r\n<li>Failure to follow proper police procedure<\/li>\r\n<li>Excessive force<\/li>\r\n<li>False arrest<\/li>\r\n<li>Planting evidence<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>What to Do If You Suspect Police Misconduct<\/b><\/p>\r\n<\/td>\r\n<td><p>If you suspect police misconduct, you will need detailed information to prepare a formal complaint or file a civil lawsuit. This detailed information can include:<\/p>\r\n<ul>\r\n<li>The names and badge numbers of the officers involved<\/li>\r\n<li>Identifying markings on the police car<\/li>\r\n<li>The location where it occurred<\/li>\r\n<li>The date and time of the event<\/li>\r\n<li>The contact information of any witnesses<\/li>\r\n<\/ul>\r\n<p>You can file a police misconduct complaint with the police department of the officer responsible. There may also be independent city or state agencies that handle such complaints. An attorney, or the police department where the officer works will be able to tell you where to file such a complaint.<\/p>\r\n<p>Police misconduct complaints sometimes are time-sensitive. You should file your complaint as soon as possible.<\/p>\r\n<p><i>Note: If you believe you are a victim of police misconduct and you have charges pending, contact an attorney before filing a complaint with a city Police Department. You may waive certain rights by filing a police misconduct complaint.<\/i><\/p>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Criminal Penalties \/ Damages for Police Misconduct Complaints<\/b><\/p>\r\n<\/td>\r\n<td><p><b><i>Minnesota Criminal Penalties<\/i><\/b><\/p>\r\n<p>Minnesota has limited criminal penalties for officers who have been found guilty of police misconduct. An officer who has violated other criminal statutes, for instance, murder or assault, would face additional criminal penalties.<\/p>\r\n<ul>\r\n<li>Violations of Section 609.43 (police officer misconduct): 1-year imprisonment and\/or a $3,000 fine<\/li>\r\n<li>Restitution (<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-611a-04.html\" target=\"_blank\" rel=\"noopener\">Section 611A.04<\/a>): Victims of crimes have a right to receive restitution<\/li>\r\n<\/ul>\r\n<p><b><i>Falsely Reporting Police Misconduct<\/i><\/b><\/p>\r\n<p>Minnesota has a specific statute to make it a crime to falsely report police misconduct.<\/p>\r\n<ul>\r\n<li>Violations of Section 609.505 (falsely reporting police misconduct) are misdemeanors<\/li>\r\n<li>Crime is subject to one year or less imprisonment and\/or a fine. Any restitution award may not exceed $3,000.<\/li>\r\n<\/ul>\r\n<p><b><i>Federal Criminal Penalties<\/i><\/b><\/p>\r\n<p>Violations of federal laws for police misconduct are punishable by fines and\/or imprisonment.
