You could face jail time, fines, and sex offender registration. Minnesota law also bans <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/solicitation.html\">solicitation<\/a> of prostitution and <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/pimping-and-pandering-laws.html\">pimping<\/a>. As with other states, Minnesota has also implemented strong laws on <a href=\"https:\/\/www.ag.state.mn.us\/Consumer\/Publications\/SexTrafficking.asp\" target=\"_blank\" rel=\"noopener\">sex trafficking<\/a>.<\/p>\r\n<h2><b>Minnesota&#8217;s Prostitution and Solicitation Laws at a Glance<\/b><\/h2>\r\n<p>Navigating the Minnesota criminal code can be challenging. The following table briefly explains the state&#8217;s prostitution laws.<\/p>\r\n<h3><b>Code sections<\/b><\/h3>\r\n<p><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.321\" target=\"_blank\" rel=\"noopener\">Definitions<\/a>: Minnesota Statutes \u00a7609.321<\/p>\r\n<p><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.322\" target=\"_blank\" rel=\"noopener\">Solicitation<\/a>: Minn. Stat. \u00a7609.322<\/p>\r\n<p><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.322\" target=\"_blank\" rel=\"noopener\">Inducement<\/a>, <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.322\" target=\"_blank\" rel=\"noopener\">promotion of prostitution<\/a>, and <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.322\" target=\"_blank\" rel=\"noopener\">sex trafficking<\/a>: Minn. Stat. \u00a7609.322<\/p>\r\n<p><a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.324\" target=\"_blank\" rel=\"noopener\">Patrons, prostitutes, and housing individuals engaged in prostitution<\/a>: Minnesota Statutes \u00a7609.324<\/p>\r\n<p><b>What&#8217;s prohibited?<\/b><\/p>\r\n<p>Minnesota law prohibits all prostitution-related activities, including:<\/p>\r\n<p>Sex trafficking in the first degree \u2014 This felony sex crime includes any of the following:<\/p>\r\n<ul>\r\n<li>Soliciting or inducing a person under 18 years of age to be a prostitute (i.e., being hired to engage in sexual penetration, whether oral, vaginal, or anal sex, or other sexual contact)<\/li>\r\n<li>Promoting the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/prostitution.html\">prostitution<\/a> of a person under 18<\/li>\r\n<li>Receiving profit, knowing it came from the prostitution of a minor<\/li>\r\n<li>Sex trafficking (enticing or obtaining a person under 18 to serve as a prostitute)<\/li>\r\n<\/ul>\r\n<p>Sex trafficking in the second degree \u2014 This criminal offense includes any of the following:<\/p>\r\n<ul>\r\n<li>Soliciting or inducing a person to practice prostitution<\/li>\r\n<li>Promoting prostitution<\/li>\r\n<li>Knowingly receiving a profit from the prostitution of another<\/li>\r\n<li>Sex trafficking<\/li>\r\n<\/ul>\r\n<p>Hiring adult prostitutes \u2014 Engaging in prostitution or hiring an adult for prostitution<\/p>\r\n<p>Prostitution \u2014 Engaging in prostitution or offering to perform sexual acts for money<\/p>\r\n<h3><b>Criminal penalties<\/b><\/h3>\r\n<p>The penalties for the above crimes are below.<\/p>\r\n<p><b>Sex trafficking in the first degree:<\/b> Up to 20 years in prison and a fine of up to $50,000. But the penalties are more severe in specific circumstances. For example, having more than one sex trafficking victim carries a possible jail sentence of 25 years and a minimum fine of $60,000.<\/p>\r\n<p><b>Sex trafficking in the second degree:<\/b> Up to 15 years in prison and a fine of up to $40,000.<\/p>\r\n<p><b>Hiring a minor for prostitution:<\/b> Depends on the child&#8217;s age<\/p>\r\n<ul>\r\n<li>For a child under 13, the penalty is not more than 20 years in prison and a fine of up to $40,000<\/li>\r\n<li>For a child between 13 and 15, the maximum penalty is ten years and a fine of $20,000<\/li>\r\n<li>For a child who is 16 or 17 years old, the penalty is up to five years in prison and a fine of $10,000<\/li>\r\n<\/ul>\r\n<p><b>Housing unrelated minors for prostitution:<\/b> Up to one year in jail and a fine of up to $3,000.<\/p>\r\n<p><b>Patronizing an adult prostitute:<\/b> Depends on the prostitution location and the defendant&#8217;s prior offenses.<\/p>\r\n<ul>\r\n<li>If the transaction occurs in a public place, the offender must pay a fine of at least $1,500<\/li>\r\n<li>If the sexual contact takes place in a private place, there is a minimum fine of $500<\/li>\r\n<li>If the defendant has a prior conviction for prostitution, they must pay a $1,500 fine and complete 20 hours of community service<\/li>\r\n<li>If the sex buyer used a motor vehicle in their solicitation, their conviction will appear on their <a href=\"https:\/\/dps.mn.gov\/divisions\/dvs\/Pages\/records-request-procedure.aspx\" target=\"_blank\" rel=\"noopener\">driving record<\/a>.<\/li>\r\n<li>If the crime occurred in a park or school zone, the <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.3242\" target=\"_blank\" rel=\"noopener\">penalties would increase<\/a> by up to three times the usual maximum sentence.<\/li>\r\n<\/ul>\r\n<h3><b>Court Assessments<\/b><\/h3>\r\n<p>The court will assess adult sex buyers (johns) and sex traffickers between $500 and $1,000, depending on the facts of the case.<\/p>\r\n<p>The penalties for prostitution depend on where the activity occurred and the offender&#8217;s prior convictions:<\/p>\r\n<p>Public place: This is a <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/609.03\" target=\"_blank\" rel=\"noopener\">gross misdemeanor<\/a>, punishable by one year in jail and a $3,000 fine.<\/p>\r\n<p>Private place: This is a misdemeanor, punishable by up to 90 days in jail and a $1,000 fine.<\/p>\r\n<ul>\r\n<li><p>With a prior prostitution conviction, this crime is also a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\">gross misdemeanor<\/a>.<\/p>\r\n<\/li>\r\n<\/ul>\r\n<p>Loitering in a public place to participate in prostitution is also a <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=609.3243\" target=\"_blank\" rel=\"noopener\">misdemeanor<\/a> charge.<\/p>\r\n<h3><b>Sex Offender Registry<\/b><\/h3>\r\n<p>If the state convicts you of sex trafficking of a minor or hiring a prostitute under 13 years of age, you must <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/?id=243.166\" target=\"_blank\" rel=\"noopener\">register as a sex offender<\/a>.<\/p>\r\n<h3><b>Defenses<\/b><\/h3>\r\n<p>There are very few defenses to prostitution in Minnesota. Innocence is always a defense to a criminal charge.
