As such, it applies in five main situations:<\/p>\n<ul>\n<li><span data-term-id=\"41204420\">Obstructing<\/span> the lawful execution of a legal process<\/li>\n<li>Interfering with a <span data-term-id=\"41204425\">peace officer<\/span> (<span data-term-id=\"41204446\">law enforcement officer<\/span>)<\/li>\n<li>Interfering with <span data-term-id=\"41204428\">firefighters<\/span><\/li>\n<li>Interfering with a <span data-term-id=\"41204443\">member of an ambulance service personnel crew<\/span><\/li>\n<li><span data-term-id=\"41204420\">Obstruction<\/span> involving <a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-609-50.html#:~:text=any%20employee%20of%20the%20Department%20of%20Revenue%2C%20Department%20of%20Public%20Safety%20Driver%20and%20Vehicle%20Services%20Division%2C%20a%20driver%27s%20license%20agent%20appointed%20undersection%20171.061%2C%20or%20a%20deputy%20registrar%20appointed%20undersection%20168.33\" target=\"_blank\" rel=\"noopener\">certain state employees<\/a> by force or <span data-term-id=\"41204441\">threat of force<\/span><\/li>\n<\/ul>\n<p>We review each in further detail below.<\/p>\n<h3><span data-term-id=\"41204420\">Obstructing<\/span> the Lawful Execution of Legal Process<\/h3>\n<p><span data-term-id=\"41204427\">Obstructing<\/span><span data-term-id=\"41204427\"> legal process<\/span> occurs when someone intentionally delays, blocks, or prevents officials from carrying out their duties, which are considered the <span data-term-id=\"41204453\">lawful execution of any legal process<\/span>. It includes things like:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/dont-bother-avoiding-process-servers\/\">Serving court papers<\/a><\/li>\n<li>Executing a search warrant<\/li>\n<li>Carrying out a court order<\/li>\n<\/ul>\n<p>If someone deliberately stands in front of a sheriff who\u2019s attempting to serve a civil <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/rules-for-landlords-and-property-managers-when-evicting-a-tenant.html\">eviction notice<\/a>, they are <span data-term-id=\"41204427\">obstructing<\/span><span data-term-id=\"41204427\"> legal process<\/span>. Intentionally blocking them from handing the papers to the tenant is illegal.<\/p>\n<h3>Interfering With a <span data-term-id=\"41204425\">Peace Officer<\/span><\/h3>\n<p>This is the conduct most people associate with <span data-term-id=\"41204423\">resisting arrest<\/span>. It includes any interference with a <span data-term-id=\"41204446\">law enforcement officer<\/span> performing lawful duties, not just arrests.<\/p>\n<p>These might include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/what-to-do-during-traffic-stops.html\">Traffic\/<span data-term-id=\"41204435\">DWI<\/span> stops<\/a><\/li>\n<li>Detentions<\/li>\n<li>Investigations<\/li>\n<li>Execution of search warrants<\/li>\n<\/ul>\n<p>As long as the officer is engaged in the <span data-term-id=\"41204439\">performance of <\/span><span data-term-id=\"41204426\">official duties<\/span>, any intentional noncompliance that interferes with an officer\u2019s <span data-term-id=\"41204426\">official duty<\/span> is prohibited.<\/p>\n<p>Let\u2019s say an <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/getting-pulled-over.html\">officer walks up to a parked car<\/a> to speak with the driver about a broken taillight and asks the driver to step out of the vehicle. The driver refuses and rolls the windows up. The officer repeats the command several times. The driver continues refusing and prevents the officer from opening the door. This is a classic <span data-term-id=\"41204420\">obstruction<\/span>.<\/p>\n<h3>Interfering With <span data-term-id=\"41204428\">Firefighters<\/span><\/h3>\n<p>Under <span data-term-id=\"41204419\">Minnesota<\/span>\u2019s <span data-term-id=\"41204420\">obstruction<\/span> statute, it\u2019s illegal to intentionally do anything that <span data-term-id=\"41204420\">obstructs<\/span>, hinders, or prevents a <span data-term-id=\"41204428\">firefighter<\/span> from performing their <span data-term-id=\"41204426\">official duties<\/span>. The law applies whether the <span data-term-id=\"41204428\">firefighter<\/span> is responding to a fire, rescue, or other emergency.<\/p>\n<p><span data-term-id=\"41204428\">Firefighters<\/span> arriving to put out a house fire need to connect their hose to the nearest hydrant. A neighbor, upset that the fire truck is\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/blocked-driveway-what-the-law-says-about-neighborhood-parking.html\">blocking their driveway<\/a>, stands in front of the hydrant to block the <span data-term-id=\"41204428\">firefighters<\/span>\u2019 access. This intentional behavior that delays the crew from getting water on the fire is prohibited.<\/p>\n<h3>Interfering With Ambulance Personnel<\/h3>\n<p>The law also protects ambulance service personnel who are providing or attempting to provide <span data-term-id=\"41204436\">emergency care<\/span>. This can involve life-or-death situations.<\/p>\n<p>Let\u2019s say someone collapses at home. Paramedics arrive and try to enter the bedroom to provide <span data-term-id=\"41204436\">emergency care<\/span>. A family member, overwhelmed and scared, stands in the doorway demanding answers before letting them in. <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/can-you-sue-a-paramedic-firefighter\/\">The paramedics<\/a> tell them to step aside so they can deliver medical care. The family member refuses and continues blocking the doorway. As long as the family member intentionally engaged in the behavior that caused the <span data-term-id=\"41204420\">obstruction<\/span>, they can face charges.<\/p>\n<h3><span data-term-id=\"41204420\">Obstructing<\/span> State Department Employees by Force or <span data-term-id=\"41204441\">Threat of Force<\/span><\/h3>\n<p>Using force or <span data-term-id=\"41204441\">threat of force<\/span> to interfere with certain state department employees performing their <span data-term-id=\"41204426\">official duties<\/span> is also prohibited. This includes <span data-term-id=\"41204419\">Minnesota<\/span>\u2019s:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.revenue.state.mn.us\/\" target=\"_blank\" rel=\"noopener\">Department of Revenue<\/a> employees<\/li>\n<li>Department of Public Safety Driver and Vehicle Services Division employees<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/mn\/transportation-ch-160-174a\/mn-st-sect-171-061\" target=\"_blank\" rel=\"noopener\">Driver&#8217;s license agents<\/a><\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/mn\/transportation-ch-160-174a\/mn-st-sect-168-33#:~:text=Subd.%202.%20Deputy%20registrars\" target=\"_blank\" rel=\"noopener\">Deputy registrars<\/a><\/li>\n<\/ul>\n<p>This is the only part of the statute that requires\u00a0either the <span data-term-id=\"41204447\">use of force<\/span>\u00a0or the\u00a0<span data-term-id=\"41204441\">threat of force<\/span> (or both). Charges involving these state employees are less common, but still occur.<\/p>\n<p>Suppose a state revenue employee comes to Pat\u2019s house to <a href=\"https:\/\/www.findlaw.com\/state\/minnesota-law\/minnesota-personal-income-tax-laws.html\">deliver a required tax notice<\/a>. Pat gets angry, steps toward the employee, and says, \u201cIf you don\u2019t leave right now, I\u2019m going to hurt you.\u201d The employee backs away because of the threat and doesn\u2019t deliver the notice. This is enough to violate the statute.<\/p>\n<h2>What the State Must Prove<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/understanding-criminal-law-how-to-break-down-a-criminal.html#:~:text=Understanding%20Criminal%20Statutes%3A%20One%20Element%20at%20a%20Time\">Each crime has required elements<\/a>. These are the elements the prosecution must prove in order to convict someone of a criminal offense.<\/p>\n<p>In this section, we examine the elements required for <span data-term-id=\"41204420\">obstruction<\/span> offenses.<\/p>\n<h3>Elements of <span data-term-id=\"41204420\">Obstruction<\/span><\/h3>\n<p>For <span data-term-id=\"41204420\">obstructing<\/span> (non-state department employees) in <a href=\"https:\/\/www.ag.state.mn.us\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41204419\">Minnesota<\/span>, prosecutors<\/a> must show the following:<\/p>\n<ul>\n<li>The person acted intentionally<\/li>\n<li>The official was performing lawful, <span data-term-id=\"41204426\">official duties<\/span><\/li>\n<li>The person\u2019s actions obstructed, resisted, or interfered with those duties<\/li>\n<\/ul>\n<p>No force or threat is required. Non\u2011violent interference is enough.<\/p>\n<h3>Elements of <span data-term-id=\"41204420\">Obstruction<\/span> Involving State Department Employees<\/h3>\n<p>For <a href=\"https:\/\/mn.gov\/mmb\/careers\/\" target=\"_blank\" rel=\"noopener\">state department employees<\/a>, the elements vary a bit. These charges require the prosecution to prove:<\/p>\n<ul>\n<li>The person acted intentionally<\/li>\n<li>The employee was performing <span data-term-id=\"41204426\">official duties<\/span><\/li>\n<li>The person used force or threatened to use force<\/li>\n<li>That force or threat obstructed or interfered with those duties<\/li>\n<\/ul>\n<p>While this is the only <span data-term-id=\"41204420\">obstruction<\/span> charge that requires force or <span data-term-id=\"41204441\">threat of force<\/span>, force also plays a role in other <span data-term-id=\"41204420\">obstruction<\/span> charges. We explore this in the next section.<\/p>\n<h2>Types of Resistance<\/h2>\n<p><span data-term-id=\"41204419\">Minnesota<\/span> treats <span data-term-id=\"41204420\">obstruction<\/span> with force or violence more seriously than <span data-term-id=\"41204420\">obstruction<\/span> by passive noncompliance.<\/p>\n<h3>Force and Violence<\/h3>\n<p>Force in this context means any physical action used to <span data-term-id=\"41204420\">obstruct<\/span>. It includes things like grabbing, pushing, and blocking.<\/p>\n<p>Violence is a more serious, assaultive type of force used to <span data-term-id=\"41204420\">obstruct<\/span>. Examples include hitting, kicking, and tackling.<\/p>\n<p>The use of either force or violence in\u00a0<span data-term-id=\"41204420\">obstruction<\/span>\u00a0cases can elevate\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges.html\"><span data-term-id=\"41204438\">criminal charges<\/span><\/a>\u00a0and support additional charges. Prosecutors often add separate charges for offenses like assault or <a href=\"https:\/\/www.findlaw.com\/state\/minnesota-law\/minnesota-disorderly-conduct-laws.html\"><span data-term-id=\"41204448\">disorderly conduct<\/span><\/a>. These are distinct criminal offenses, each with its own elements.<\/p>\n<h3>Passive Resistance<\/h3>\n<p>Mere refusal to move or other verbal noncooperation may be treated as passive resistance. <span data-term-id=\"41204420\">Obstruction<\/span> with passive resistance usually results in lower charges unless it poses a danger.<\/p>\n<p>Passive resistance includes things like:<\/p>\n<ul>\n<li>Going limp<\/li>\n<li>Sitting down and refusing to move<\/li>\n<li>Linking arms<\/li>\n<\/ul>\n<p>Even with passive resistance, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\">prosecutors must still show intentional <span data-term-id=\"41204420\">obstruction<\/span><\/a> for a conviction.<\/p>\n<h2>Does This Law Apply to Protestors?<\/h2>\n<p>Protestors who <span data-term-id=\"41204420\">obstruct<\/span> police, block streets, or prevent <span data-term-id=\"41204436\">emergency care<\/span> may <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arrest.html\">face <span data-term-id=\"41204457\">arrest charges<\/span><\/a>. Peaceful, nonviolent protests that don\u2019t <span data-term-id=\"41204420\">obstruct<\/span> officers or use\/threaten force are less likely to meet the statute\u2019s elements.<\/p>\n<p>Organizers and participants should be aware that interfering with <span data-term-id=\"41204426\">official duties<\/span> can convert a <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/is-there-a-right-to-peaceful-protest.html\">peaceful protest<\/a> into <span data-term-id=\"41204448\">disorderly conduct<\/span> or <span data-term-id=\"41204420\">obstruction<\/span> under <span data-term-id=\"41204455\">state law<\/span>. Arrests are possible if protestors engage in prohibited conduct.<\/p>\n<h2>Charges and Penalties: <span data-term-id=\"41204419\">Minnesota<\/span>\u2019s Three\u2011Tiered Structure<\/h2>\n<p><span data-term-id=\"41204419\">Minnesota<\/span> uses a three\u2011tiered structure to determine charges and penalties for <span data-term-id=\"41204420\">obstruction<\/span> offenses. It starts with <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\">misdemeanors<\/a>, the lowest charge for <span data-term-id=\"41204420\">obstruction<\/span> in <span data-term-id=\"41204419\">Minnesota<\/span>.<\/p>\n<p>Statutory enhancements can elevate the charge to a <span data-term-id=\"41204429\">gross misdemeanor<\/span> or even a felony. They are often referred to as <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/classifications-of-crimes.html#:~:text=Aggravating%20and%20Mitigating%20Circumstances\">aggravating factors<\/a>.<\/p>\n<p>Let\u2019s take a look at each one.<\/p>\n<h3>Tier 1: Misdemeanor<\/h3>\n<p>This is the baseline <span data-term-id=\"41204420\">obstruction<\/span> offense. It applies to <span data-term-id=\"41204420\">obstruction<\/span> violations when:<\/p>\n<ul>\n<li>There is no use or <span data-term-id=\"41204441\">threat of force<\/span> or violence<\/li>\n<li>No risk of harm is created<\/li>\n<li>No harm occurs<\/li>\n<\/ul>\n<p>Typical misdemeanor <span data-term-id=\"41204420\">obstruction<\/span> can be someone repeatedly getting in the way and refusing to step aside while an officer is trying to interview a witness. The <a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-609-125\/\" target=\"_blank\" rel=\"noopener\">penalties for a misdemeanor<\/a> include up to 90 days in county jail and\/or a fine of up to $1,000.<\/p>\n<h3>Tier 2: <span data-term-id=\"41204429\">Gross Misdemeanor<\/span><\/h3>\n<p>The next tier is <span data-term-id=\"41204429\">gross misdemeanors<\/span>. This is for <span data-term-id=\"41204420\">obstruction<\/span> offenses that are more serious than a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\">misdemeanor but less serious than a felony<\/a>. <span data-term-id=\"41204419\">Minnesota<\/span> prosecutors may bring <span data-term-id=\"41204429\">gross misdemeanor<\/span> <span data-term-id=\"41204420\">obstruction<\/span> charges when use or threats of force or violence accompany the <span data-term-id=\"41204420\">obstruction<\/span>.<\/p>\n<p>Examples of a <span data-term-id=\"41204429\">gross misdemeanor<\/span> charge can stem from someone physically struggling with officers during an arrest, pushing or pulling away without causing injury. <span data-term-id=\"41204420\">Obstruction<\/span> involving even minor levels of force is likely to be charged as a <span data-term-id=\"41204429\">gross misdemeanor<\/span>.
