Some states require police to make an arrest at every domestic violence call.<\/p>\r\n<p>Under <a href=\"https:\/\/codes.findlaw.com\/ms\/title-99-criminal-procedure\/ms-code-sect-99-3-7\/\" title=\"Miss. Code \u00a7 99-3-7<\/a>, law enforcement officers <i>may<\/i> make an arrest when they have probable cause to believe that domestic violence happened in the past 24 hours. But they are not required to.<\/p>\r\n<p>The law does require officers to identify the primary aggressor and document any evidence of domestic violence they observe.<\/p>\r\n<h2>Criminal Penalties for Domestic Violence<\/h2>\r\n<p>Domestic violence can be charged as either a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/is-domestic-violence-a-felony-or-misdemeanor-.html\" title=\"misdemeanor or a felony\">misdemeanor or a felony<\/a> in Mississippi. So, if a person is convicted of simple domestic violence, then they&#8217;re convicted of aggravated domestic violence three years later, they could face up to ten years in prison.<\/p>\r\n<h3>Aggravating Factors<\/h3>\r\n<p>Mississippi code also contains provisions that can increase the criminal charge for <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/is-domestic-violence-a-felony-or-misdemeanor-.html\" title=\"domestic violence cases\">domestic violence cases<\/a>. This includes the following:<\/p>\r\n<ul>\r\n<li>Use of deadly weapon<\/li>\r\n<li>Commission of domestic violence in the presence of a child<\/li>\r\n<li>Commission of domestic violence against a pregnant victim<\/li>\r\n<li>Strangulation or attempt to strangle the victim<\/li>\r\n<li>Violation of existing protective order<\/li>\r\n<li>Disability or vulnerability of the victim<\/li>\r\n<\/ul>\r\n<h2>Protective Orders<\/h2>\r\n<p>Mississippi law offers several types of <a href=\"https:\/\/www.findlaw.com\/state\/mississippi-law\/mississippi-protective-orders-laws.html\" title=\"domestic abuse protection orders\">domestic abuse protection orders<\/a> to protect victims of acts of domestic violence.<\/p>\r\n<h3>Emergency Orders<\/h3>\r\n<p>If a person is in immediate and present danger of abuse, Mississippi courts can issue an <a href=\"https:\/\/codes.findlaw.com\/ms\/title-93-domestic-relations\/ms-code-sect-93-21-13\/\" title=\"emergency domestic violence protective order\" target=\"_blank\" rel=\"noopener\">emergency domestic violence protective order<\/a>. This type of order gives victims immediate protection while they await a hearing for their case.<\/p>\r\n<p>Emergency protection orders can:<\/p>\r\n<ul>\r\n<li>Prohibit or limit contact between the victim and the alleged abuser<\/li>\r\n<li>Prevent the alleged abuser from being within a certain distance of the victim&#8217;s home or work<\/li>\r\n<li>Temporarily evict the alleged abuser from a shared home<\/li>\r\n<\/ul>\r\n<p>The courts can issue emergency protective orders at any time, day or night, without giving prior notice to the alleged abuser.<\/p>\r\n<p>Emergency domestic violence protection orders are effective for ten days or until the court holds a hearing (whichever comes first). If the hearing is delayed, the court can extend the emergency order as needed to protect the victim&#8217;s safety.<\/p>\r\n<h3>Temporary Orders<\/h3>\r\n<p>After issuing an emergency protection order, the court will schedule a hearing. Here, the petitioner <a href=\"https:\/\/codes.findlaw.com\/ms\/title-93-domestic-relations\/ms-code-sect-93-21-11\/\" title=\"must prove the allegations of domestic abuse\" target=\"_blank\" rel=\"noopener\">must prove the allegations of domestic abuse<\/a> by a &quot;preponderance of the evidence.&quot;<\/p>\r\n<p>This generally means convincing the court that it is more likely than not that the alleged abuser has committed a domestic violence offense. It&#8217;s a lower bar than a criminal trial, where prosecutors must prove guilt beyond a reasonable doubt.<\/p>\r\n<p>The alleged abuser (respondent) receives a notice of the petition and the date, time, and place of the hearing. But the court can issue a <a href=\"https:\/\/codes.findlaw.com\/ms\/title-93-domestic-relations\/ms-code-sect-93-21-11\/\" title=\"temporary protection order\" target=\"_blank\" rel=\"noopener\">temporary protection order<\/a> even if they don&#8217;t show up. This is called an <i>ex parte<\/i> order. However, the court will only do so after verifying that the respondent was adequately notified.<\/p>\r\n<p>Temporary protection orders can address important issues. They may include child-related matters such as custody arrangements, temporary visitation rights, and other safety measures such as no-contact orders.<\/p>\r\n<h3>Final Protective Orders<\/h3>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/ms\/title-93-domestic-relations\/ms-code-sect-93-21-15\/\" title=\"Final protective orders\" target=\"_blank\" rel=\"noopener\">Final protective orders<\/a> represent a more comprehensive legal protection.
