Computer crimes may include:<\/p>\n<ul>\n<li>Improperly accessing a computer, system, or network;<\/li>\n<li>Introducing a virus or other contaminant into a computer system;<\/li>\n<li>Modifying, damaging, using, disclosing, copying, or taking programs or data;<\/li>\n<li>Using a computer in a scheme to defraud;<\/li>\n<li>Interfering with someone else&#8217;s computer access or use;<\/li>\n<li>Using encryption in aid of a crime;<\/li>\n<li>Falsifying e-mail source information; and<\/li>\n<li>Stealing an information service from a provider.<\/li>\n<\/ul>\n<h2>Computer Crime Laws in Montana<\/h2>\n<p>Montana <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/state\/criminal-laws\/details-on-state-computer-crime-laws.html\">computer crime laws<\/a> prohibit the intentional access of a computer network in order to commit <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/fraud.html\">fraud<\/a>, <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/definition-of-larceny.html\">larceny<\/a>, or damage the computer. Many computer crimes are committed as a means of stealing money or <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/identity-theft.html\">valuable information<\/a>.<\/p>\n<h2>Additional Ways to Commit Computer Crimes<\/h2>\n<p>Cyber crimes can encompass a broad range of activities including using an electronic device (like a computer, tablet, or Smartphone) to harm, defraud or threaten another person, to solicit minors, or <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/cyber-bullying.html\">cyberbullying<\/a>.<\/p>\n<h2>Computer Crimes and Federal Law<\/h2>\n<p>Laws concerning computer crimes have been enacted at both the state and federal levels. In 1986, Congress passed the <a adhocenable=\"false\" href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-1030.html\" target=\"_blank\" rel=\"noopener\">Computer Fraud and Abuse Act<\/a> (CFAA). This law has been amended and expanded as internet technology has advanced, and it continues to form the basis for federal prosecutions of computer-related criminal activities.<\/p>\n<h2>Other Federal Statutes<\/h2>\n<ul>\n<li><a adhocenable=\"false\" href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/\" target=\"_blank\" rel=\"noopener\">Electronic Communications Privacy Act<\/a> (ECPA),<\/li>\n<li><a adhocenable=\"false\" href=\"https:\/\/www.law.cornell.edu\/topn\/identity_theft_enforcement_and_restitution_act_of_2008\" target=\"_blank\" rel=\"noopener\">Identity Theft Enforcement and Restitution Act of 2008<\/a> (ITERA),<\/li>\n<li>Certain provisions of the USA PATRIOT Act.<\/li>\n<\/ul>\n<p>The following chart highlights the basics of Montana&#8217;s computer crime laws.
