In this article, we&#8217;ll examine the definition of <span data-term-id=\"39091520\">domestic violence<\/span> under <span data-term-id=\"39091523\">Montana<\/span><span data-term-id=\"39091523\"> law<\/span>, determine who can be involved, and what <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/stop-domestic-violence.html\">options and protections are in place<\/a> for victims. Armed with knowledge, victims can break the endless cycle of abuse, threats, and violence and find a better life.<\/p>\n<h2><span data-term-id=\"39091519\">Montana<\/span> <span data-term-id=\"39091559\">Domestic Violence<\/span><span data-term-id=\"39091559\"> Laws<\/span>: The Basics<\/h2>\n<p>Certain crimes committed by people in specific relationships are classified as <span data-term-id=\"39091520\">domestic violence<\/span> in <span data-term-id=\"39091519\">Montana<\/span>. Knowing which offenses count and who qualifies is a bit confusing. Let&#8217;s dig into both aspects to gain a better grasp of <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-laws.html\">what <span data-term-id=\"39091520\">domestic violence<\/span> is<\/a>.<\/p>\n<h3><span data-term-id=\"39091520\">Domestic Violence<\/span> in <span data-term-id=\"39091519\">Montana<\/span>: Participants<\/h3>\n<p>No matter what the offense is, a crime between two strangers isn&#8217;t <span data-term-id=\"39091520\">domestic violence<\/span>. As suggested by the word domestic, these crimes are associated with life at home between family members and partners. To be considered a domestic offense, the people involved must share <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-206\/\" target=\"_blank\" rel=\"noopener\">one of the following relationships<\/a>:<\/p>\n<p><strong>Partners<\/strong>:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39091545\">Former spouses<\/span><\/li>\n<li>Persons who have a child in common<\/li>\n<li>Persons who are dating or are <span data-term-id=\"39091551\">intimate partners<\/span><\/li>\n<li>Persons who were in an <span data-term-id=\"39091536\">ongoing intimate relationship<\/span> or dating relationship<\/li>\n<\/ul>\n<p><strong>Family Members:<\/strong><\/p>\n<ul>\n<li>Parents<\/li>\n<li>Children<\/li>\n<li>Siblings<\/li>\n<li><span data-term-id=\"39091534\">In-laws<\/span><\/li>\n<li>Adoptive children<\/li>\n<li>Adoptive parents<\/li>\n<li>Step-children<\/li>\n<li>Step-parents<\/li>\n<li>Other past or <span data-term-id=\"39091527\">present family members of a household<\/span><\/li>\n<\/ul>\n<p>Inclusion in one of these groups doesn&#8217;t mean every crime involved is considered <span data-term-id=\"39091520\">domestic violence<\/span>. Prosecution for non-<span data-term-id=\"39091520\">domestic violence<\/span> crimes is still available, but certain protections and punishments aren&#8217;t attached. Some <a href=\"https:\/\/courts.mt.gov\/forms\/domestic\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39091519\">Montana<\/span> <span data-term-id=\"39091520\">domestic violence<\/span> <span data-term-id=\"39091522\">orders of protection<\/span><\/a> are used for victims of stalking and <span data-term-id=\"39091525\">sexual assault<\/span> as well.<\/p>\n<h3><span data-term-id=\"39091520\">Domestic Violence<\/span> Crimes in <span data-term-id=\"39091519\">Montana<\/span>: Offenses<\/h3>\n<p>Having an abuser and a victim who are family members or partners is part of the requirement for crimes to be <span data-term-id=\"39091520\">domestic violence<\/span>. The other half consists of the acts themselves, which fall under specific categories.<\/p>\n<p>There are many different <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">types of abuse<\/a> utilized by abusers to control and punish their victims. Family members and partners are <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-206\/\" target=\"_blank\" rel=\"noopener\">committing a <span data-term-id=\"39091520\">domestic violence<\/span> crime<\/a> in <span data-term-id=\"39091519\">Montana<\/span> if they:<\/p>\n<ul>\n<li>Cause an intentional <span data-term-id=\"39091524\">bodily injury<\/span> to a family member or partner<\/li>\n<li>Cause a <span data-term-id=\"39091524\">bodily injury<\/span> to a family member or partner with a weapon<\/li>\n<li>Cause, with intent, a family member or partner to live in fear of <span data-term-id=\"39091524\">bodily injury<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-102\/\" target=\"_blank\" rel=\"noopener\">Numerous criminal acts<\/a> fall under the abuses listed above. Some carry enhanced penalties for the abuser if the offense fits the <span data-term-id=\"39091520\">domestic violence<\/span> requirements. These include:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-206\/\" target=\"_blank\" rel=\"noopener\">Assault<\/a>\/<span data-term-id=\"39091544\">Aggravated assault<\/span>\/Assault on a minor\/Assault with a weapon\/Partner or <span data-term-id=\"39091521\">family member assault<\/span><\/li>\n<li>Intimidation<\/li>\n<li>Criminal endangerment\/Negligent endangerment<\/li>\n<li><span data-term-id=\"39091564\">Strangulation of a partner<\/span> or family member<\/li>\n<li><span data-term-id=\"39091562\">Unlawful restraint<\/span><\/li>\n<li>Kidnapping\/Aggravated kidnapping<\/li>\n<li>Arson<\/li>\n<\/ul>\n<p>Crimes that involve <span data-term-id=\"39091525\">sexual assault<\/span>, rape, and stalking can fall under types of assault for domestic crime determination. These <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-102\/\" target=\"_blank\" rel=\"noopener\">offenses are eligible for <span data-term-id=\"39091522\">orders of protection<\/span> in <span data-term-id=\"39091519\">Montana<\/span><\/a> regardless of the relationship between the offender and the victim.<\/p>\n<h2><span data-term-id=\"39091519\">Montana<\/span> <span data-term-id=\"39091559\">Domestic Violence<\/span><span data-term-id=\"39091559\"> Laws<\/span>: Protections<\/h2>\n<p>The sad truth about protections against <span data-term-id=\"39091520\">domestic violence<\/span> is that they often don&#8217;t come into play until after a victim has suffered abuse. Still, they can be an effective means for victims to extract themselves from a toxic relationship and start a better life. Let&#8217;s see <a href=\"https:\/\/dojmt.gov\/victim-services\/resource-library\/about-orders-of-protection\/\" target=\"_blank\" rel=\"noopener\">what <span data-term-id=\"39091519\">Montana<\/span> has to offer<\/a>.<\/p>\n<h3><span data-term-id=\"39091522\">Orders of Protection<\/span><\/h3>\n<p><span data-term-id=\"39091522\">Orders of Protection<\/span> are available for victims of certain crimes in <span data-term-id=\"39091519\">Montana<\/span>. In many cases, the offense doesn&#8217;t need to be <span data-term-id=\"39091520\">domestic violence<\/span> for a<a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-201\/\" target=\"_blank\" rel=\"noopener\"> victim to obtain an order<\/a>.<\/p>\n<p>Victims who have suffered abuse or are afraid they&#8217;ll be abused begin the process of getting a <a href=\"https:\/\/courts.mt.gov\/forms\/domestic\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39091519\">Montana<\/span> <span data-term-id=\"39091522\">Order of Protection<\/span><\/a> at a city, justice, or district court. If the victim and the abuser have a family law case in district court, the petition for the <span data-term-id=\"39091522\">Order of Protection<\/span> must be filed in a district court.<\/p>\n<p>The victim (petitioner) <a href=\"https:\/\/courts.mt.gov\/forms\/domestic\" target=\"_blank\" rel=\"noopener\">files forms with the court<\/a>, which are reviewed by a judge. The judge may speak with you for further details, but they won&#8217;t contact your abuser yet. If they feel the abuser poses a threat, a <strong>Temporary Ex Parte <span data-term-id=\"39091522\">Order of Protection<\/span><\/strong> is issued, and a date for a hearing is set. <span data-term-id=\"39091526\">Law enforcement<\/span> officers will serve the abuser (respondent) with the order.<\/p>\n<p>The hearing takes place within 20 days, assuming the abuser was served. If not, the hearing is delayed until they are served. The <span data-term-id=\"39091568\">Temporary <\/span><span data-term-id=\"39091522\">Order<\/span><span data-term-id=\"39091522\"> of Protection<\/span> remains in effect until then. It&#8217;s tailored to each case and <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-201\/\" target=\"_blank\" rel=\"noopener\">can include any or all of the following provisions<\/a> for the respondent:<\/p>\n<ul>\n<li>Cannot commit acts of violence against the petitioner and any designated family members<\/li>\n<li>Cannot threaten to commit acts of violence or <span data-term-id=\"39091560\">bodily harm<\/span> against the petitioner and any designated family member<\/li>\n<li>Cannot harass, annoy, disturb the peace of, telephone, contact, or otherwise communicate with the petitioner or any named family member<\/li>\n<li>Cannot remove a child from the jurisdiction of the court<\/li>\n<li>Must stay 1,500 feet (or a different distance designated by the court) away from the petitioner, the petitioner&#8217;s residence, the school or place of employment of the petitioner, or any other specified place<\/li>\n<li>Must leave the residence of the petitioner and stay away, regardless of ownership of the residence<\/li>\n<li>Cannot possess or use any firearm used in the assault<\/li>\n<li>Cannot transfer, encumber, conceal, or otherwise dispose of any property except in the usual course of business<\/li>\n<li>Must transfer possession and use of the residence, an automobile, and other essential personal property to the petitioner<\/li>\n<li>Must complete violence counseling, which may include alcohol or <span data-term-id=\"39091553\">chemical dependency<\/span> counseling or treatment<\/li>\n<\/ul>\n<p>The court may impose any additional condition it considers necessary for the petitioner&#8217;s safety. This includes keeping the new address of the petitioner from the respondent. It will consider any previous <span data-term-id=\"39091520\">domestic violence<\/span> offenses as well.<\/p>\n<p><span data-term-id=\"39091568\">Temporary <\/span><span data-term-id=\"39091522\">Orders<\/span><span data-term-id=\"39091522\"> of Protection<\/span> are sent to the appropriate <span data-term-id=\"39091526\">law enforcement<\/span> jurisdictions in <span data-term-id=\"39091519\">Montana<\/span>. A copy is sent to the <a href=\"https:\/\/archive.legmt.gov\/bills\/mca\/title_0400\/chapter_0150\/part_0030\/section_0030\/0400-0150-0030-0030.html#:~:text=(1)%20The%20clerk%20of%20court,copy%20of%20the%20proof%20of\" target=\"_blank\" rel=\"noopener\">national <span data-term-id=\"39091520\">domestic violence<\/span> database<\/a> at the <span data-term-id=\"39091531\">Department of Justice<\/span>.<\/p>\n<p>At the hearing, both sides can present evidence and call witnesses. If the judge determines that the abuser remains a threat, a <strong>Final <span data-term-id=\"39091522\">Order of Protection<\/span><\/strong> is issued. The <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-204\" target=\"_blank\" rel=\"noopener\">duration is up to the court<\/a>, which includes the option to make it permanent. The Final <span data-term-id=\"39091522\">Order of Protection<\/span> can have the same conditions as the <span data-term-id=\"39091568\">temporary order<\/span>. The petitioner can apply to modify or cancel the Final <span data-term-id=\"39091522\">Order of Protection<\/span> at any time.<\/p>\n<p>It&#8217;s a good idea to keep a copy of any <span data-term-id=\"39091532\">restraining order<\/span> on you at all times. This creates a secondary address for victims that keeps their residences out of public records. <a href=\"https:\/\/dojmt.gov\/victim-advocates\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39091547\">Crime victim<\/span> advocates<\/a> can assist victims in applying.<\/p>\n<h2><span data-term-id=\"39091519\">Montana<\/span> <span data-term-id=\"39091559\">Domestic Violence<\/span><span data-term-id=\"39091559\"> Laws<\/span>: Violations and Penalties<\/h2>\n<p>Both <span data-term-id=\"39091520\">domestic violence<\/span> crimes and violations of <span data-term-id=\"39091522\">Orders of Protection<\/span> earn the offender serious penalties in <span data-term-id=\"39091519\">Montana<\/span>. An abuser who is <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-626\/\" target=\"_blank\" rel=\"noopener\">aware of an <span data-term-id=\"39091522\">Order of Protection<\/span> and violates it <\/a>faces the following punishments:<\/p>\n<h3><strong><span data-term-id=\"39091533\">First Offense<\/span><\/strong>:<\/h3>\n<ul>\n<li>Up to six months in county jail<\/li>\n<li>A fine of up to $500<\/li>\n<\/ul>\n<h3><strong><span data-term-id=\"39091540\">Second offense<\/span><\/strong>:<\/h3>\n<ul>\n<li>Between one day and six months in county jail<\/li>\n<li>A fine between $200 and $500<\/li>\n<\/ul>\n<h3><strong>Third or subsequent offense<\/strong>:<\/h3>\n<ul>\n<li>Between 10 days and two years in county jail or state prison<\/li>\n<li>A fine between $500 and $2,000<\/li>\n<\/ul>\n<p>The court can order mandatory intervention and other treatment programs. The offender also faces charges for any crimes committed during the violation and is required to pay restitution to the victim for expenses related to the violation.<\/p>\n<p>The acts considered <span data-term-id=\"39091520\">domestic violence<\/span> often carry heavier penalties.
