Labor laws, affecting <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377637\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377637\">collective bargaining<\/span> agreements and union regulations, are a part of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377600\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377600\">employment law<\/span>.<\/p>\n<h2><strong><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377600\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377600\">Employment Laws<\/span><\/strong><\/h2>\n<p>Most states follow an <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/at-will-employment-and-wrongful-termination.html\">\u201cat-will\u201d employment<\/a> policy, which means that an employer or employee may end the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377616\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377616\">employment relationship<\/span> at any time without cause. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> is the only state that does not follow this policy.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/mt\/title-39-labor\/mt-st-39-2-901\/\" target=\"_blank\" rel=\"noopener\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377643\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377643\">Wrongful Discharge from Employment Act<\/span><\/a> prevents an employer from terminating an employee without <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377645\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377645\">good cause<\/span> after a <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377617\">probationary period<\/span>. The <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377617\">probationary period<\/span> is 12 months, unless a contract or <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377637\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377637\">collective bargaining<\/span> agreement states otherwise.<\/p>\n<p>After the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377617\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377617\">probationary period<\/span>, termination must be for cause. Wrongful termination is any termination without <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377645\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377645\">good cause<\/span>, or any termination:<\/p>\n<ul>\n<li>In retaliation for a refusal to violate public policy<\/li>\n<li>Based on an employee\u2019s expression of free speech, including the use of <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377650\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377650\">social media<\/span><\/li>\n<li>In violation of the employer\u2019s written disciplinary policy<\/li>\n<\/ul>\n<p>The Department of Labor does not enforce violations of the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377643\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377643\">Wrongful Discharge from Employment Act<\/span>. The Act provides employees with a civil remedy through the <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/filing-an-eeoc-complaint-or-charge.html\">Equal Employment Opportunity Commission<\/a> (EEOC).<\/p>\n<h3><strong><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> Wage and <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377631\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377631\">Hour Laws<\/span><\/strong><\/h3>\n<p>As of January 1st, 2025, the <a href=\"https:\/\/codes.findlaw.com\/mt\/title-39-labor\/mt-st-39-3-404\/\" target=\"_blank\" rel=\"noopener\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377633\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377633\">Montana<\/span> <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377599\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377599\">minimum wage<\/span><\/a> is $10.55 per hour. Employers not subject to the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377654\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377654\">federal <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377602\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377602\">Fair Labor Standards Act<\/span> (<span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377630\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377630\">FLSA<\/span>), such as businesses with fewer than two employees and small farms, may pay $4.00 per hour. Under some circumstances, exempt employers must pay at least the <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377632\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377632\">federal <\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377599\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377599\">minimum wage<\/span> of $7.25 per hour.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> does not have \u201ctip credits.\u201d Employers in traditionally tipped positions must pay employees <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377599\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377599\">minimum wage<\/span> and may not use tips as partial wages.<\/p>\n<p>Although <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> does not have mandatory <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377621\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377621\">overtime laws<\/span>, employers must pay workers who work more than 40 hours in any <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377601\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377601\">workweek<\/span> at least one and a half times their <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377652\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377652\">regular rate of pay<\/span>. <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> does not have laws limiting the number of hours an employee may work in any week or the number of consecutive days an employee may work. Employers must follow any <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377604\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377604\">federal laws<\/span> regarding rest periods and overtime.<\/p>\n<h3><strong>Right to Work Laws<\/strong><\/h3>\n<p>Contrary to their name, \u201cright-to-work\u201d laws do not guarantee workers any right to employment. They prohibit employers from negotiating contracts that require employees to join a union or pay union dues to benefit from union protections.<\/p>\n<p><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377598\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377598\">Montana<\/span> is not a \u201cright-to-work\u201d state. Employers may make union membership a condition of employment and can legally refuse to hire an applicant who will not join a union or who is not a union member. \u201cRight-to-work\u201d laws do not impact <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377610\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377610\">workers\u2019 compensation<\/span> insurance and do not impact other legal rights an employee has regarding workplace discrimination.<\/p>\n<h3><strong>Discrimination Laws<\/strong><\/h3>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/mt\/title-49-human-rights\/mt-code-ann-sect-49-1-101.html\" target=\"_blank\" rel=\"noopener\"><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377614\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377614\">Montana<\/span><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377614\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377614\"> Human Rights Act<\/span><\/a> mirrors federal civil rights laws. The Human Rights Act guarantees the right to freedom from discrimination in employment, including but not limited to:<\/p>\n<ul>\n<li>Race or ethnicity<\/li>\n<li>Religion<\/li>\n<li><span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377613\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377613\">National origin<\/span><\/li>\n<li>Physical or <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377646\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377646\">mental disability<\/span><\/li>\n<li>Age<\/li>\n<\/ul>\n<p>Workplace discrimination includes harassment or permitting a hostile <span data-action=\"click-&gt;dropdown#toggle\" data-dropdown-menu-id-param=\"menu_report_term_46377640\" data-dropdown-placement-param=\"top\" data-dropdown-disable-toggle-aria-param=\"true\" data-term-id=\"46377640\">work environment<\/span>.
