These crimes can destroy families and force victims to live in fear of abuse. <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span> addresses these acts of <span data-term-id=\"39167445\">domestic abuse<\/span> to protect victims and punish abusers.<\/p>\n<p>Laws dealing with <span data-term-id=\"39167437\">domestic violence<\/span> are complex, with legalese that isn&#8217;t easy to parse. To help, we&#8217;ve provided answers to questions often asked about <span data-term-id=\"39167437\">domestic violence<\/span> in <span data-term-id=\"39167438\">Montana<\/span>. For many, their perception of <span data-term-id=\"39167437\">domestic violence<\/span> involves the bruises and black eyes associated with <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\">battered woman syndrome<\/a>. While that is a form that <span data-term-id=\"39167437\">domestic violence<\/span> takes, it&#8217;s not limited to <span data-term-id=\"39167480\">physical abuse<\/span>.<\/p>\n<p>Acts of <span data-term-id=\"39167437\">domestic violence<\/span> focus on <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">power and control<\/a>. Abusers use different <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">types of abuse<\/a> to keep their victims trapped in a cycle of fear, intimidation, coercion, and violence. Only certain crimes qualify to be considered <span data-term-id=\"39167437\">domestic violence<\/span>.<\/p>\n<p>People involved in specific relationships are also required for an offense to be classified as <span data-term-id=\"39167437\">domestic violence<\/span>. Since these crimes often involve family or other trusted individuals, they hit close to home.<\/p>\n<h2>What criminal acts are eligible to be considered <span data-term-id=\"39167437\">domestic violence<\/span> in <span data-term-id=\"39167438\">Montana<\/span>?<\/h2>\n<p>An <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-206\/\" target=\"_blank\" rel=\"noopener\">offense is considered <span data-term-id=\"39167437\">domestic violence<\/span><\/a> or a family crime when an abuser:<\/p>\n<ul>\n<li>Causes, with intent, a <span data-term-id=\"39167441\">bodily injury<\/span> to a family member or partner<\/li>\n<li>Causes a family member or partner to live in fear of <span data-term-id=\"39167441\">bodily injury<\/span> on purpose<\/li>\n<li>Causes a <span data-term-id=\"39167441\">bodily injury<\/span> to a family member or partner with a weapon<\/li>\n<\/ul>\n<p>There are specific crimes under <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span> that are considered eligible for <span data-term-id=\"39167437\">domestic violence<\/span> classification. Some carry <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-201\/\" target=\"_blank\" rel=\"noopener\">enhanced penalties if committed as an act of <span data-term-id=\"39167445\">domestic abuse<\/span><\/a>. There are also non-<span data-term-id=\"39167437\">domestic violence<\/span> <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-102\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39167439\">Orders of Protection<\/span> available for victims<\/a> of stalking, <span data-term-id=\"39167442\">sexual assault<\/span>, and other types of assault committed by those who aren\u2019t family members or partners.<\/p>\n<h2>Who is considered a family member or a partner under <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span>?<\/h2>\n<p>For <span data-term-id=\"39167437\">domestic violence<\/span> to occur, the type of offense is only part of the equation. The individuals involved must share one of a specific group of relationships as defined by <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span>. The participants must be one of the following for a <span data-term-id=\"39167437\">domestic violence<\/span> label:<\/p>\n<p><strong>Family Members<\/strong>:<\/p>\n<ul>\n<li>Parents<\/li>\n<li>Children<\/li>\n<li>Siblings<\/li>\n<li>Adoptive children\/Adoptive parents<\/li>\n<li><span data-term-id=\"39167475\">In-laws<\/span><\/li>\n<li>Step-children\/Step-parents<\/li>\n<li>Other past or <span data-term-id=\"39167446\">present family members of a household<\/span><\/li>\n<\/ul>\n<p><strong>Partners<\/strong>:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39167458\">Former spouses<\/span><\/li>\n<li>Persons who are in a dating relationship or an <span data-term-id=\"39167478\">ongoing intimate relationship<\/span><\/li>\n<li>Persons who were in a dating relationship or an <span data-term-id=\"39167478\">ongoing intimate relationship<\/span><\/li>\n<li>Persons who have a child in common<\/li>\n<\/ul>\n<p>If two people who share one of these relationships have a qualifying criminal act between them, <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span> will consider it <a href=\"https:\/\/www.justice.gov\/ovw\/domestic-violence\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39167437\">domestic violence<\/span><\/a>. Crimes that lack either element are still available for prosecution, but not as <span data-term-id=\"39167445\">domestic abuse<\/span>. Offenses deemed <span data-term-id=\"39167437\">domestic violence<\/span> offer focused types of protection and increased severity of penalties.<\/p>\n<h2>My partner is scaring me, and I&#8217;m afraid they&#8217;re going to get violent. What can I do?<\/h2>\n<p>If you&#8217;re in fear of <span data-term-id=\"39167451\">bodily harm<\/span>, <span data-term-id=\"39167442\">sexual assault<\/span>, <span data-term-id=\"39167470\">unlawful restraint<\/span>, or any other threatening act, call 911. If abuse has already happened and you&#8217;re afraid it&#8217;s going to happen again, call 911. <span data-term-id=\"39167438\">Montana<\/span> peace officers <a href=\"https:\/\/codes.findlaw.com\/mt\/title-46-criminal-procedure\/mt-st-46-6-311\/\" target=\"_blank\" rel=\"noopener\">receive special training for responding to possible <span data-term-id=\"39167437\">domestic violence<\/span><\/a> calls.<\/p>\n<p>Peace officers will identify the predominant aggressor of the situation and have the option to arrest them. They&#8217;ll take into account factors such as previous history, severity of injuries, and witness statements. If the predominant aggressor is violating an <span data-term-id=\"39167439\">Order of Protection<\/span>, the peace officer <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-209\/\" target=\"_blank\" rel=\"noopener\">can serve them with a no-contact order<\/a> on the spot.<\/p>\n<p>Whether or not your abuser gets arrested, it&#8217;s time for you to look into protection. <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span> <a href=\"https:\/\/courts.mt.gov\/forms\/domestic\" target=\"_blank\" rel=\"noopener\">has you covered<\/a>.<\/p>\n<h2>I told my abuser not to come back, but I&#8217;m sure they will. Is there any way I can stop them?<\/h2>\n<p>Short of your abuser being incarcerated, the best option for keeping them away from you is a <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167437\">domestic violence<\/span> <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\"><span data-term-id=\"39167439\">Order of Protection<\/span><\/a>. While they&#8217;re not a guarantee that your abuser won&#8217;t try to harm you, the penalties they carry can act as a strong deterrent.<\/p>\n<p><span data-term-id=\"39167439\">Orders of Protection<\/span> are <span data-term-id=\"39167466\">court orders<\/span> containing conditions that the abuser must obey. Each case is different, but certain conditions are common inclusions:<\/p>\n<ul>\n<li>Must leave the residence of the petitioner and stay away, regardless of ownership of the residence<\/li>\n<li>Cannot possess or use any firearm used in the assault<\/li>\n<li>Cannot transfer, encumber, conceal, or otherwise dispose of any property except in the usual course of business<\/li>\n<li>Must transfer of possession and use of the residence, an automobile, and other essential personal property to the petitioner<\/li>\n<li>Must complete violence counseling, which may include alcohol or <span data-term-id=\"39167469\">chemical dependency<\/span> counseling or treatment<\/li>\n<li>Cannot commit acts of violence against the petitioner and any designated family members<\/li>\n<li>Cannot threaten to commit acts of violence or <span data-term-id=\"39167451\">bodily harm<\/span> against the petitioner and any designated family member<\/li>\n<li>Cannot harass, annoy, disturb the peace of, telephone, contact, or otherwise communicate with the petitioner or any named family member<\/li>\n<li>Cannot remove a child from the jurisdiction of the court<\/li>\n<li>Must stay 1,500 feet (or a different distance designated by the court) away from the petitioner, the petitioner&#8217;s residence, the school or place of employment of the petitioner, or any other specified place<\/li>\n<\/ul>\n<p>Those who violate an <span data-term-id=\"39167439\">Order of Protection<\/span>, either by an act or omission of a requirement, face <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-626\/\" target=\"_blank\" rel=\"noopener\">penalties under <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span><\/a>. The punishments increase for repeated transgressions:<\/p>\n<p><strong><span data-term-id=\"39167464\">First Offense<\/span><\/strong>:<\/p>\n<ul>\n<li>A fine of up to $500<\/li>\n<li>Up to six months in county jail<\/li>\n<\/ul>\n<p><strong><span data-term-id=\"39167461\">Second offense<\/span><\/strong>:<\/p>\n<ul>\n<li>A fine between $200 and $500<\/li>\n<li>Between one day and six months in county jail<\/li>\n<\/ul>\n<p>First and <span data-term-id=\"39167461\">second offenses<\/span> are eligible for <span data-term-id=\"39167459\">misdemeanor<\/span> probation.<\/p>\n<p><strong>Third or subsequent offense<\/strong>:<\/p>\n<ul>\n<li>A fine between $500 and $2,000<\/li>\n<li>Between 10 days and two years in county jail or state prison<\/li>\n<\/ul>\n<p>The offender is also responsible for any crimes committed during the violation. Some offenses, <a href=\"https:\/\/codes.findlaw.com\/mt\/title-45-crimes\/mt-st-45-5-220\/\" target=\"_blank\" rel=\"noopener\">such as stalking<\/a>, carry far more severe penalties than for a non-<span data-term-id=\"39167437\">domestic violence<\/span> act.<\/p>\n<h2>Okay, so how do I get an <span data-term-id=\"39167439\">Order of Protection<\/span>? Do I have to go to court? How long does it last?<\/h2>\n<p>Getting an <span data-term-id=\"39167439\">Order of Protection<\/span> in <span data-term-id=\"39167438\">Montana<\/span> isn&#8217;t too complicated. While there&#8217;s a good deal of <span data-term-id=\"39167472\">self-help<\/span> available, the state suggests that you enlist the help of a <a href=\"https:\/\/dojmt.gov\/victim-advocates\/\" target=\"_blank\" rel=\"noopener\">victim advocate<\/a> to make sure everything is done right. If you&#8217;ve been abused or are in fear of abuse, your first step is going to either a city court, justice court, or a <span data-term-id=\"39167447\">district court<\/span>. If you have divorce or <span data-term-id=\"39167452\">child custody<\/span> proceedings happening in <span data-term-id=\"39167447\">district court<\/span>, that&#8217;s where you need to go.<\/p>\n<p>A clerk will help you (the petitioner) <a href=\"https:\/\/dojmt.gov\/wp-content\/uploads\/2011\/05\/ovs2.pdf\" target=\"_blank\" rel=\"noopener\">start the paperwork<\/a>. Once you&#8217;ve <a href=\"https:\/\/courts.mt.gov\/forms\/domestic\" target=\"_blank\" rel=\"noopener\">filled in all the forms<\/a>, a judge will review the petition and decide whether or not to issue a <strong><span data-term-id=\"39167465\">Temporary <\/span><span data-term-id=\"39167439\">Order<\/span><span data-term-id=\"39167439\"> of Protection<\/span><\/strong>. They may ask you additional questions to tailor the order to your situation. A <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-201\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39167465\">temporary order<\/span><\/a> is ex parte, which means they don&#8217;t need to speak to the abuser (the respondent) before issuing it.<\/p>\n<p>Once issued, a peace officer will serve the order to the respondent. The <span data-term-id=\"39167465\">temporary order<\/span> lasts either 20 days or until the case hearing. If the respondent was served and wishes to contest the order, both sides will give their arguments, present evidence, and call witnesses at the hearing. The judge then decides if the order should become a <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-202\/\" target=\"_blank\" rel=\"noopener\">Final <span data-term-id=\"39167439\">Order of Protection<\/span><\/a>.<\/p>\n<p>The duration of a Final <span data-term-id=\"39167439\">Order of Protection<\/span> can be for a set amount of time or be made permanent. The petitioner can file for an amendment or an extension while the order is in effect. Copies will be sent to <span data-term-id=\"39167444\">law enforcement<\/span> and the <span data-term-id=\"39167449\">Department of Justice<\/span> (DOJ).<\/p>\n<p>Keep a copy of your <span data-term-id=\"39167439\">Order of Protection<\/span> with you at all times. It stays in effect if you move within the state. It&#8217;s also protected under <span data-term-id=\"39167481\">federal law<\/span> by the <a href=\"https:\/\/www.hud.gov\/vawa#close\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a>, which ensures its validity nationwide. Is there any way to make it harder to find me?<\/h2>\n<p>Your new residential address is protected under <span data-term-id=\"39167438\">Montana<\/span>&#8216;s <a href=\"https:\/\/dojmt.gov\/victim-services\/address-confidentiality-program\/\" target=\"_blank\" rel=\"noopener\">Address Confidentiality Program<\/a>. Victims are given a second legal address that&#8217;s used for public records. All first-class mail is forwarded to the victim&#8217;s actual address. There is no charge for this program.<\/p>\n<h2>Will my abuser being charged with <span data-term-id=\"39167437\">domestic violence<\/span> help with our divorce and <span data-term-id=\"39167452\">child custody<\/span>?<\/h2>\n<p>It&#8217;s almost a certainty that a <span data-term-id=\"39167445\">domestic abuse<\/span> charge will weigh in on any divorce or <span data-term-id=\"39167452\">child custody<\/span> proceedings. Given that &#8220;serious marital discord&#8221; is <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-4-101\/\" target=\"_blank\" rel=\"noopener\">considered grounds for divorce<\/a> under <span data-term-id=\"39167438\">Montana<\/span> <span data-term-id=\"39167443\">family law<\/span>, <span data-term-id=\"39167437\">domestic violence<\/span> charges will fall under the judge&#8217;s consideration.<\/p>\n<p>When it comes to custody, the court is concerned with the best interests of the child. Any <span data-term-id=\"39167439\">Order of Protection<\/span> that specifies the <a href=\"https:\/\/codes.findlaw.com\/mt\/title-40-family-law\/mt-st-40-15-204\/\" target=\"_blank\" rel=\"noopener\">possibility of child abuse and limits parental contact with the abuser<\/a> will affect the final decision on any <span data-term-id=\"39167477\">parenting plans<\/span>.
