For information regarding a specific legal issue affecting you, please <a href=\"https:\/\/lawyers.findlaw.com\/?fli=bylinelink\" target=\"_blank\" rel=\"noopener\">contact an attorney in your area<\/a>.<\/em><\/p>\n\n        <\/div>\n    <\/details>\n<\/section>\n<p>Identity theft is a crime that involves the use (or theft) of another person&#8217;s personal identifiable information, such as Social Security number and birth date, to open credit accounts and other illegal acts.<\/p>\r\n<h2>Personal Identifying Information<\/h2>\r\n<p>Personal identifying information includes the victim\u2019s:<\/p>\r\n<ul>\r\n<li>Name, address, and telephone number;<\/li>\r\n<li>Birth date;<\/li>\r\n<li>Driver&#8217;s license and social security number;<\/li>\r\n<li>Place of employment and employee identification number;<\/li>\r\n<li>Mother&#8217;s maiden name;<\/li>\r\n<li>Bank account or credit card information;<\/li>\r\n<li>Any other identifying information.<\/li>\r\n<\/ul>\r\n<h2>Identity Theft In Montana<\/h2>\r\n<p>Under <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/state\/criminal-laws\/details-on-state-identity-theft-laws.html\">Montana&#8217;s identity theft laws<\/a> the first offense can be charged as a <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\">misdemeanor<\/a> or <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/felonies.html\">felony<\/a> depending on the circumstances.<\/p>\r\n<p>If you believe you might be a victim of <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/identity-theft.html\">identity theft<\/a>, it is important that you take immediate and thorough action. Report the crime right away to law enforcement. Close your bank accounts and cancel your credit cards. Put a password on the new accounts that you open. You might not stop all the damage, but at least you can minimize it.<\/p>\r\n<h2>Contact Credit Bureaus<\/h2>\r\n<p>If you are a victim of identity theft, you should also contact the three (3) nationwide credit bureaus immediately and set up a fraud alert. A fraud alert tells banks and other creditors to take extra steps to verify your identity before issuing credit in your name, but it will not stop credit in your name. A fraud alert is free and will last 90 days unless you request an extended seven-year fraud alert and provide a <a adhocenable=\"false\" href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/obtaining-and-using-a-police-report.html\">police report<\/a>.<\/p>\r\n<ul>\r\n<li><a adhocenable=\"false\" href=\"http:\/\/www.equifax.com\/home\/en_us\" target=\"_blank\" rel=\"noopener\">Equifax<\/a> : 1-800-525-6285<\/li>\r\n<li><a adhocenable=\"false\" href=\"http:\/\/www.transunion.com\/\" target=\"_blank\" rel=\"noopener\">TransUnion<\/a> : 1-800-680-7289<\/li>\r\n<li><a adhocenable=\"false\" href=\"http:\/\/www.experian.com\/\" target=\"_blank\" rel=\"noopener\">Experian<\/a> : 1-888-397-3742<\/li>\r\n<\/ul>\r\n<p>The details of Montana&#8217;s identity theft laws are listed below.
