In Montana, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/prostitution.html\">prostitution<\/a> is defined as engaging in, agreeing to engage in, or offering to engage in sexual intercourse with another person in exchange for something of value. It is important to note that it is illegal to both buy and sell<i> <\/i>sexual favors. <\/p>\n<p>In other words, it is illegal to both act as a prostitution and to be the patron who visits a prostitute. Within the state it is also illegal to promote prostitution (including <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/solicitation.html\">soliciting prostitution<\/a>). The tables below outline Montana&#8217;s main prostitution and solicitation laws.<\/p>\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\n<tbody><tr><td style=\"width: 109px;\"><p><b>Code Section <\/b><\/p>\n<\/td>\n<td style=\"width: 481px;\">Montana Code <a href=\"http:\/\/leg.mt.gov\/bills\/mca\/45\/5\/45-5-601.htm\" target=\"_blank\" rel=\"noopener\">section 45-5-601<\/a>: <b>Prostitution<\/b><\/td>\n<\/tr><tr><td style=\"width: 109px;\"><p><b>What&#8217;s Prohibited? <\/b><\/p>\n<\/td>\n<td style=\"width: 481px;\">Engaging in, agreeing to engage in, or offering to engage in sexual intercourse with another person for compensation.
