These state laws must not dip below the federal wage and hour limits outlined in the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\">Fair Labor Standards Act<\/a> (FLSA). This article outlines Montana&#8217;s main wage and hour laws.<\/p>\r\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\r\n<tbody><tr><td style=\"width: 121.0px;\"><p><b>Code Section <\/b><\/p>\r\n<\/td>\r\n<td style=\"width: 469.0px;\">Montana Code <a href=\"http:\/\/leg.mt.gov\/bills\/mca\/39\/3\/39-3-404.htm\" target=\"_blank\" rel=\"noopener\">section 39-3-404<\/a>: <b>Minimum Wage<\/b><\/td>\r\n<\/tr><tr><td style=\"width: 121.0px;\"><p><b>What&#8217;s Prohibited? <\/b><\/p>\r\n<\/td>\r\n<td style=\"width: 469.0px;\">Most employers in Montana are required to pay their employees a wage of at least $8.30 per hour. However, employers not covered by the FLSA whose gross annual sales are $110,000 or less are allowed to pay their employees $4.00 per hour.<\/td>\r\n<\/tr><tr><td style=\"width: 121.0px;\"><b>Tipped Employees<\/b><\/td>\r\n<td style=\"width: 469.0px;\"><p>Tip credits aren&#8217;t allowed for tipped employees in Montana.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\r\n<tbody><tr><td style=\"width: 121.0px;\"><p><b>Code Section <\/b><\/p>\r\n<\/td>\r\n<td style=\"width: 469.0px;\">Montana Code <a href=\"http:\/\/leg.mt.gov\/bills\/mca\/39\/3\/39-3-405.htm\" target=\"_blank\" rel=\"noopener\">section 39-3-405<\/a>: <b>Overtime Compensation<\/b><\/td>\r\n<\/tr><tr><td style=\"width: 121.0px;\"><p><b>What&#8217;s Prohibited? <\/b><\/p>\r\n<\/td>\r\n<td style=\"width: 469.0px;\">Employees in Montana who work more than 40 hours in a workweek must be paid overtime compensation at a rate of at least 1\u00bd times the employee&#8217;s regular hourly rate for those hours worked over 40.<\/td>\r\n<\/tr><tr><td style=\"width: 121.0px;\"><p><b>Exclusions<\/b><\/p>\r\n<p>&nbsp;<\/p>\r\n<\/td>\r\n<td style=\"width: 469.0px;\"><p>The overtime compensation provision doesn&#8217;t apply to:<\/p>\r\n<ul>\r\n<li>Farm workers, or<\/li>\r\n<li>Students employed at amusement or recreational areas that operate on a seasonal basis and furnish the students with board, lodging, or other facilities<\/li>\r\n<\/ul>\r\n<p>Overtime pay for firefighters and law enforcement officers is governed by the FLSA.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h2>Exceptions to Montana&#8217;s Minimum Wage and Overtime Compensation Laws<\/h2>\r\n<p>Montana&#8217;s minimum wage and overtime compensation laws are not applicable to all employees within the state.
