When it comes to the people involved in <span data-term-id=\"39050197\">domestic abuse<\/span>, they must share at least one of a set of qualifying relationships\u200b:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39050201\">Former spouses<\/span><\/li>\n<li>Family by consanguinity (blood relatives)<\/li>\n<li>Family through marriage affinity (blood relations through a spouse, such as a husband&#8217;s sister)<\/li>\n<li>Children<\/li>\n<li>People residing together<\/li>\n<li>People who have resided together in the past<\/li>\n<li>People with a child in common<\/li>\n<li>People in a <span data-term-id=\"39050216\">dating relationship<\/span><\/li>\n<li>People who were in a <span data-term-id=\"39050216\">dating relationship<\/span> in the past<\/li>\n<\/ul>\n<p>A <span data-term-id=\"39050216\">dating relationship<\/span> means a couple having frequent, intimate associations with affection and sexual involvement or the intent of affection and sexual involvement in the future. If you&#8217;re being abused and you are in one of these relationships, you&#8217;re suffering <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/stopping-domestic-violence.html\"><u><span data-term-id=\"39050193\">domestic violence<\/span><\/u><\/a>. <a href=\"https:\/\/www.nebraskacoalition.org\/get_help\/\" target=\"_blank\" rel=\"noopener\"><u>Advocates are available<\/u><\/a>\u200b to help.<\/p>\n<h3>Qualifying Offenses<\/h3>\n<p>An in-law who steals a watch from you is guilty of a crime, but not of a <span data-term-id=\"39050193\">domestic violence<\/span> offense. <span data-term-id=\"39050197\">Domestic abuse<\/span> crimes are about <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\"><u>power and control<\/u><\/a>. The abuser uses different <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\"><u>types of <span data-term-id=\"39050193\">domestic violence<\/span><\/u><\/a>\u200b to hold dominance over the victim. While\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\"><u>physical violence<\/u><\/a>\u00a0is often associated with\u00a0<span data-term-id=\"39050197\">domestic abuse<\/span>, other methods, including coercion, financial restriction, isolation, and intimidation, are used as well.<\/p>\n<p>If the participants are family or <span data-term-id=\"39050232\">household members<\/span>, any crimes under the following classifications <a href=\"https:\/\/www.childwelfare.gov\/resources\/definitions-domestic-violence-nebraska\/\" target=\"_blank\" rel=\"noopener\"><u>can qualify as <span data-term-id=\"39050193\">domestic violence<\/span> in <span data-term-id=\"39050192\">Nebraska<\/span><\/u><\/a>\u200b:<\/p>\n<ul>\n<li>Attempting to cause <span data-term-id=\"39050194\">bodily injury<\/span> with intent or recklessness, with or without a <span data-term-id=\"39050200\">dangerous instrument<\/span><\/li>\n<li>Threatening to cause <span data-term-id=\"39050194\">bodily injury<\/span> with intent or recklessness in a <span data-term-id=\"39050221\">menacing manner<\/span><\/li>\n<li>Engaging in <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-28-crimes-and-punishments\/ne-rev-st-sect-28-318\/\" target=\"_blank\" rel=\"noopener\"><u>sexual penetration or sexual contact without consent<\/u><\/a>\u200b<\/li>\n<li>Causing fear of <span data-term-id=\"39050218\">imminent <\/span><span data-term-id=\"39050194\">bodily injury<\/span> through threats and intimidation (even if the abuser had no intent to follow through)<\/li>\n<\/ul>\n<p>Criminal acts that meet both the participant and type of offense criteria are <span data-term-id=\"39050193\">domestic violence<\/span> in <span data-term-id=\"39050192\">Nebraska<\/span>. A husband committing <span data-term-id=\"39050206\">sexual assault<\/span> on their spouse is <span data-term-id=\"39050193\">domestic violence<\/span>. An employee punching their boss is a crime, but not <span data-term-id=\"39050197\">domestic abuse<\/span>.<\/p>\n<h2><span data-term-id=\"39050228\">Nebraska<\/span> <span data-term-id=\"39050193\">Domestic Violence<\/span> Laws: Protections, Programs, and Help for Victims<\/h2>\n<p>If you&#8217;re suffering abuse or are in fear of impending harm, call 911. If your abuser is guilty of <span data-term-id=\"39050193\">domestic violence<\/span> offenses, <span data-term-id=\"39050192\">Nebraska<\/span> offers several ways to help protect you.<\/p>\n<h3><span data-term-id=\"39050228\">Nebraska<\/span> <span data-term-id=\"39050193\">Domestic Violence<\/span> <span data-term-id=\"39050195\">Protective Orders<\/span><\/h3>\n<p>While not foolproof, <span data-term-id=\"39050228\">Nebraska<\/span> <a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=26-103\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39050193\">domestic violence<\/span> <span data-term-id=\"39050195\">protection orders<\/span><\/u><\/a>\u200b offer an effective way to get an abuser out of your life. This <span data-term-id=\"39050236\">restraining order<\/span> combines focused protections for the victim and strict penalties for the abuser.<\/p>\n<p>Each <span data-term-id=\"39050193\">domestic violence<\/span> <span data-term-id=\"39050195\">protection order<\/span> is tailored to fit the needs of the victim. While every case is different, <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\"><u>some conditions are common inclusions<\/u><\/a>\u200b in orders. The provisions include:<\/p>\n<ul>\n<li>The abuser is forbidden from restraining the victim or their personal liberty<\/li>\n<li>The abuser is forbidden from assaulting, attacking, molesting, threatening, or otherwise disturbing the peace of the victim<\/li>\n<li>Abiding by a no-contact order<\/li>\n<li>The abuser must vacate a shared dwelling and not return<\/li>\n<li>The abuser must stay away from any location named by the court<\/li>\n<li>Awarding temporary child custody for up to 90 days<\/li>\n<li>Forbidding the abuser from purchasing or possessing firearms<\/li>\n<li>Awarding custody of shared domestic animals to the victim<\/li>\n<li>Forbidding the abuser from making contact with or harming any domestic animals of the victim<\/li>\n<\/ul>\n<p>This is not an exhaustive list. The <span data-term-id=\"39050224\">court order<\/span> can contain all, some, or none of these provisions. The court can add any condition it deems necessary for the victim&#8217;s safety.<\/p>\n<p>Victims (petitioners) apply for a <a href=\"https:\/\/supremecourt.nebraska.gov\/self-help\/protection-order-information\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39050193\">domestic violence<\/span> <span data-term-id=\"39050195\">protection order<\/span><\/u><\/a>\u200b by fax, mail, or in person. <a href=\"https:\/\/supremecourt.nebraska.gov\/sites\/default\/files\/DC-19-70.pdf\" target=\"_blank\" rel=\"noopener\"><u>The petition<\/u><\/a>\u200b includes an affidavit in which you&#8217;ll describe instances of abuse as fully as possible. If you&#8217;re filing in person, take the forms <a href=\"https:\/\/supremecourt.nebraska.gov\/directories\/district-court-contacts\" target=\"_blank\" rel=\"noopener\"><u>to your nearest court<\/u><\/a>. There is no fee to file for a <span data-term-id=\"39050195\">protective order<\/span> in <span data-term-id=\"39050192\">Nebraska<\/span>. <a href=\"https:\/\/www.nebraskacoalition.org\/get_help\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39050193\">Domestic violence<\/span> advocates can help<\/u><\/a>\u200b if you&#8217;re having difficulties.<\/p>\n<p>At the courthouse, give your forms to the court clerk. A judge may ask you questions to determine the threat level you&#8217;re facing. If the court agrees that you&#8217;re in danger, an <a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=26-109\" target=\"_blank\" rel=\"noopener\"><u>ex parte temporary <span data-term-id=\"39050195\">protection order<\/span><\/u><\/a>\u200b is issued. This can contain the provisions you request and additional conditions added by the court. Your abuser (respondent) will not be contacted before the issuance (ex parte).<\/p>\n<p>After issuance, the order is served on the respondent. In <span data-term-id=\"39050193\">domestic violence<\/span> cases, this is often handled by the sheriff&#8217;s department. The respondent <a href=\"https:\/\/supremecourt.nebraska.gov\/self-help\/protection-order-information\/if-you-have-been-served-protection-order\" target=\"_blank\" rel=\"noopener\"><u>has ten days after service to request<\/u><\/a>\u200b a &#8220;show-cause&#8221; hearing if they wish to oppose the order. If they don&#8217;t oppose or don&#8217;t show up, the order becomes a final <span data-term-id=\"39050195\">protection order<\/span>.<\/p>\n<p>If the respondent chooses to oppose, you&#8217;ll have a case hearing. Both sides offer their arguments, call witnesses, and present evidence. If the court finds that the threat of abuse still exists, the temporary order becomes a final order. It has a duration of one year and is renewable each year that <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/where-does-one-turn-for-help-in-cases-of-domestic-violence.html\"><u>the threat remains viable<\/u><\/a>\u200b.<\/p>\n<p>Your <span data-term-id=\"39050195\">protection order<\/span> applies anywhere in <span data-term-id=\"39050192\">Nebraska<\/span>. It&#8217;s valid in all U.S. states, territories, and tribal reservations under <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\">both federal<\/a> and <span data-term-id=\"39050203\">Nebraska<\/span><span data-term-id=\"39050203\"> law<\/span>. If your abuser violates the <span data-term-id=\"39050195\">protection order<\/span>, call <span data-term-id=\"39050207\">law enforcement<\/span> at once.<\/p>\n<p>Those who violate a <span data-term-id=\"39050193\">domestic violence<\/span> <span data-term-id=\"39050195\">protection order<\/span> <a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=26-103\" target=\"_blank\" rel=\"noopener\"><u>face severe penalties<\/u><\/a>. The first violation is a <a href=\"https:\/\/www.nebraskalegislature.gov\/laws\/statutes.php?statute=28-106\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39050215\">Class I <\/span><span data-term-id=\"39050199\">misdemeanor<\/span><\/u><\/a>, with up to one year in jail and a fine of up to $1,000. Any violations after that are a <a href=\"https:\/\/news.legislature.ne.gov\/jud\/files\/2022\/03\/Felonies-Classification-of-Penalties-28-105.pdf\" target=\"_blank\" rel=\"noopener\"><u>Class IV felony<\/u><\/a>\u200b with a fine of up to $10,000 and up to two years in prison.<\/p>\n<p>Violators in <span data-term-id=\"39050192\">Nebraska<\/span> face prosecution for the crimes committed during the violation as separate offenses. These can add significant punishments. For example, <a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=28-323\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39050198\">domestic assault<\/span><\/u><\/a>\u200b has the following penalties:<\/p>\n<p><span data-term-id=\"39050204\">Third-degree<\/span> <span data-term-id=\"39050198\">domestic assault<\/span>:<\/p>\n<ul>\n<li>First violation &#8211; Class A <span data-term-id=\"39050199\">misdemeanor<\/span><\/li>\n<li>Subsequent violations &#8211; <span data-term-id=\"39050208\">Class IIIA felony<\/span><\/li>\n<\/ul>\n<p><span data-term-id=\"39050205\">Second-degree<\/span> <span data-term-id=\"39050198\">domestic assault<\/span> (injury with a deadly weapon\/<span data-term-id=\"39050200\">dangerous instrument<\/span>):<\/p>\n<ul>\n<li>First violation &#8211; <span data-term-id=\"39050208\">Class IIIA felony<\/span><\/li>\n<li>Subsequent violations: <span data-term-id=\"39050217\">Class IIA felony<\/span><\/li>\n<\/ul>\n<p><span data-term-id=\"39050202\">First-degree<\/span> <span data-term-id=\"39050198\">domestic assault<\/span> (intentional <span data-term-id=\"39050209\">serious <\/span><span data-term-id=\"39050194\">bodily injury<\/span>):<\/p>\n<ul>\n<li>First violation: <span data-term-id=\"39050217\">Class IIA felony<\/span><\/li>\n<li>Subsequent violations: <span data-term-id=\"39050210\">Class II felony<\/span><\/li>\n<\/ul>\n<p>These charges are in addition to violation penalties. The court may also add further provisions to the existing <span data-term-id=\"39050195\">protective order<\/span>.<\/p>\n<h3>Support Services and <span data-term-id=\"39050225\">Assistance Programs<\/span><\/h3>\n<p>To help victims escape their abusers, <span data-term-id=\"39050192\">Nebraska<\/span> offers many <a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=42-909\" target=\"_blank\" rel=\"noopener\"><u>types of emergency services<\/u><\/a>\u200b and temporary aid. Immediate services include housing in shelters, free legal aid, medical services, and financial aid. Some sources of aid\u200b can last up to thirty days. These can be relocation, daycare, employment, and alternatives to returning to the abuser.<\/p>\n<h3>Address Confidentiality Program (ACP)<\/h3>\n<p>Those who summon the courage to flee their abusers don&#8217;t want them to find them again. The <span data-term-id=\"39050192\">Nebraska<\/span> <a href=\"https:\/\/sos.nebraska.gov\/business-services\/address-confidentiality-program\" target=\"_blank\" rel=\"noopener\"><u>Address Confidentiality Program<\/u><\/a>\u200b helps keep them hidden. The victim is given a second legal address to be used for all official public documents, such as a driver&#8217;s license or voter registration. The program also forwards all first-class mail to the victim&#8217;s actual address. There is no charge for the ACP.<\/p>\n<h3>Release from Rental Agreements<\/h3>\n<p>A <span data-term-id=\"39050193\">domestic violence<\/span> victim with a <span data-term-id=\"39050195\">protection order<\/span> <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-76-real-property\/ne-rev-st-sect-76-1431-01\/\" target=\"_blank\" rel=\"noopener\"><u>can break a lease<\/u><\/a>\u200b to escape their abuser. This is legal under <span data-term-id=\"39050203\">Nebraska<\/span><span data-term-id=\"39050203\"> law<\/span>, and there are no penalties for the victim. They must give the landlord 14 days&#8217; notice, present proof of the\u00a0<span data-term-id=\"39050193\">domestic violence<\/span>\u00a0<span data-term-id=\"39050195\">protection order<\/span>, and pay all rent due through the date they leave.<\/p>\n<h3>Seeking Civil Relief<\/h3>\n<p><span data-term-id=\"39050193\">Domestic violence<\/span> victims can <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/filing-a-domestic-violence-lawsuit.html\"><u>sue their abusers in civil court<\/u><\/a>\u200b to recover lost wages, medical expenses, and pain and suffering. Taking this step alone is unwise for most people.
