There are many different types of protective orders, such as:<\/p>\r\n<ul>\r\n<li>Harassment protection orders<\/li>\r\n<li>Domestic abuse protection orders<\/li>\r\n<li>Sexual assault protection orders<\/li>\r\n<li>Domestic violence protection order<\/li>\r\n<\/ul>\r\n<p>Once the court system issues a <a href=\"https:\/\/www.findlaw.com\/state\/family-laws\/details-on-state-protective-order-laws.html\">protection order<\/a>, the person named in it (the respondent) must obey it or face criminal penalties. For example, they may have to stay a certain distance away from the person seeking the order (the petitioner). Other activities that a protective order generally prevents (or enjoins) the respondent from doing include the following:<\/p>\r\n<ul>\r\n<li>Communicating with the petitioner (in-person, telephonically, etc.)<\/li>\r\n<li>Threatening the petitioner<\/li>\r\n<li>Owning a firearm<\/li>\r\n<\/ul>\r\n<p>This article summarizes Nebraska&#8217;s protective order laws regarding domestic abuse. It begins with a brief overview of protective orders in Nebraska, followed by a chart outlining relevant statutes. It concludes with a list of related resources regarding domestic violence.<\/p>\r\n<p>If either you or a family member is a victim of domestic violence, contact the <a href=\"https:\/\/www.thehotline.org\/\" target=\"_blank\" rel=\"noopener\">National Domestic Violence Hotline<\/a>, the <a href=\"https:\/\/www.nebraskacoalition.org\/get_help\/help.html\" target=\"_blank\" rel=\"noopener\">Nebraska Coalition to End Sexual and Domestic Violence<\/a>, or local law enforcement.<\/p>\r\n<h2><b>Nebraska Protective Orders Overview and Definitions<\/b><\/h2>\r\n<p>Nebraska&#8217;s legislature enacted the <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-902\/\" target=\"_blank\" rel=\"noopener\">Protection from Domestic Abuse Act<\/a> to provide family and household members who suffer domestic abuse the necessary services to lessen and reduce the trauma of domestic abuse. <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-902\/\" target=\"_blank\" rel=\"noopener\">These services<\/a> include the following:<\/p>\r\n<ul>\r\n<li>Shelter<\/li>\r\n<li>Counseling<\/li>\r\n<li>Social services<\/li>\r\n<li>Limited medical care<\/li>\r\n<li>Limited legal assistance<\/li>\r\n<li>Other <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-905\/\" target=\"_blank\" rel=\"noopener\">support services<\/a> for victims, <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-913\/\" target=\"_blank\" rel=\"noopener\">abusers<\/a>, and <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-910\/\" target=\"_blank\" rel=\"noopener\">children<\/a><\/li>\r\n<li><a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-907\/\" target=\"_blank\" rel=\"noopener\">Emergency services<\/a><\/li>\r\n<\/ul>\r\n<p>Under the Act, abuse refers to the <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-903\/\" title=\"occurrence of any or all of the following acts\" target=\"_blank\" rel=\"noopener\">occurrence of any or all of the following acts<\/a> between family or household members:<\/p>\r\n<ul>\r\n<li>Attempting to cause or intentionally and knowingly causing bodily injury with or without a dangerous instrument<\/li>\r\n<li>Placing another person in fear of bodily injury through the use of a credible threat<\/li>\r\n<li>Sexual contact or sexual penetration without consent<\/li>\r\n<\/ul>\r\n<p>The terms <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-903\/\" target=\"_blank\" rel=\"noopener\">family and household members<\/a> refer to the following people:<\/p>\r\n<ul>\r\n<li>Spouses<\/li>\r\n<li>Former spouses<\/li>\r\n<li>Children<\/li>\r\n<li>People who currently live together or who have lived together in the past<\/li>\r\n<li>People who have a child in common (regardless of whether or not they were ever married or lived together)<\/li>\r\n<li>People related by blood (e.g., cousins) or marriage (e.g., a brother- or sister-in-law)<\/li>\r\n<li>People who are or were in a dating relationship (i.e., they engaged in frequent, intimate associations characterized by the expectation of affectionate or sexual involvement)<\/li>\r\n<\/ul>\r\n<p>Any victim of domestic abuse can file a petition and affidavit for a protection order. Petitioners must file with the clerk of the district court. The clerk can provide the necessary forms, but they cannot give the petitioner legal advice.<\/p>\r\n<p>Once filed, the district or county court will hold a hearing on the petition. Depending on the evidence presented at the court hearing, the court will decide whether or not to issue a protection order.<\/p>\r\n<p>The court may issue an ex parte order if it determines that the petitioner will be in immediate danger of abuse before the court can hold a hearing. The respondent <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-925\/\" title=\"can file a petition\" target=\"_blank\" rel=\"noopener\">can file a petition<\/a> and affidavit to schedule a show-cause hearing, at which the respondent may appear and show cause as to why the order should not remain in effect. (<i>Protection from Domestic Abuse Act<\/i>)<\/li>\r\n<li>NRS \u00a7 <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-924\/\" target=\"_blank\" rel=\"noopener\">42-924<\/a> (<i>Protection orders<\/i>)<\/li>\r\n<li>NRS \u00a7 <a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-925\/\" target=\"_blank\" rel=\"noopener\">42-925<\/a> (<i>Ex parte orders<\/i>)<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><b><p>Activity Addressed by Nebraska Protective Orders<\/p>\r\n<\/b><\/th>\r\n<td><p>Any victim of domestic abuse may file a petition or affidavit for a protective order. Protective orders may address many activities. Examples of activities include the following:<\/p>\r\n<ul>\r\n<li>Enjoining the respondent from imposing any restraint upon the liberty of the petitioner<\/li>\r\n<li>Enjoining the respondent from threatening, assaulting, molesting, attacking, or otherwise disturbing the peace of the petitioner<\/li>\r\n<li>Enjoining the respondent from communicating with the petitioner<\/li>\r\n<li>Removing or excluding the respondent from the petitioner&#8217;s residence, even if the respondent owns the residence<\/li>\r\n<li>Enjoining the respondent from being present in a specific place<\/li>\r\n<li>Awarding temporary custody of any minor children to the court (not to exceed 90 days)<\/li>\r\n<li>Enjoining the respondent from purchasing or possessing a firearm<\/li>\r\n<li>Awarding sole possession of a household pet to the petitioner<\/li>\r\n<li>Enjoining the respondent from coming into contact with the petitioner&#8217;s household pet<\/li>\r\n<li>Ordering other relief that the court deems necessary for the petitioner or household member&#8217;s safety and welfare<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><b><p>Duration of Nebraska Protective Orders<\/p>\r\n<\/b><\/th>\r\n<td><p>A Nebraska protection order lasts for <b>one year<\/b>.<\/p>\r\n<p>If the order grants a temporary order for custody, it will specify the duration of custody.<\/p>\r\n<p>A victim of domestic abuse may file a petition and affidavit to renew a protective order. They must file it within 45 days before the order expires.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><b><p>Penalty for a Violation of a Nebraska Protective Order<\/p>\r\n<\/b><\/th>\r\n<td><ul>\r\n<li><b>First violation<\/b>: Class I misdemeanor<\/li>\r\n<li><b>If they have a prior conviction for violating a protection order<\/b>: Class IV felony<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><b><p>Who May Apply for a Nebraska Protective Order?<\/p>\r\n<\/b><\/th>\r\n<td><p>Any victim of domestic abuse may file a petition and affidavit for a protective order. If the court issues a protective order, its protections may apply to family and household members.<\/p>\r\n<p>A respondent may also file a<a href=\"https:\/\/codes.findlaw.com\/ne\/chapter-42-households-and-families\/ne-rev-st-sect-42-924-03\/\" target=\"_blank\" rel=\"noopener\"> cross-petition and affidavit<\/a> for a protective order.
