Orders for Protection (OFP), <a href=\"https:\/\/ag.nv.gov\/uploadedFiles\/agnvgov\/Content\/Hot_Topics\/Open\/ProtectionOrderContacts.pdf\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">issued by <span data-term-id=\"39164208\">Nevada<\/span> courts<\/a>, offer relief from abuse through restrictions tailored to your situation. Which one you&#8217;ll need depends on your level of peril. Let\u2019s examine what\u2019s available and which one might be right for you.<\/p>\n<h3>Temporary (Ex Parte) Order for Protection (OFP)<\/h3>\n<p>An <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-020\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">ex parte OFP<\/a> is necessary when you believe you and your loved ones are in immediate danger from your abuser. After <a href=\"https:\/\/nvcourts.gov\/__data\/assets\/pdf_file\/0015\/25440\/dv-confidential-info-pdf.pdf\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">filing a confidential petition<\/a> with the <a href=\"https:\/\/selfhelp.nvcourts.gov\/find-my-court?enter=1\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">court in your jurisdiction<\/a>, you&#8217;ll know within one day if your temporary OFP is approved. The court will not contact your abuser while making their decision.<\/p>\n<p>If approved, your abuser will be served by <span data-term-id=\"39164217\">law enforcement<\/span>. You should never, ever serve an OFP to your abuser yourself. As soon as the emergency OFP goes into effect, you are covered by protections for the risks you&#8217;re facing. These can include the abuser:<\/p>\n<ul>\n<li>Not committing any harassment, injury, or threats to you or your <span data-term-id=\"39164216\">minor child<\/span> by themselves or through an agent<\/li>\n<li>Leaving your residence and not returning<\/li>\n<li>Not injuring or threatening to injure any shared animal<\/li>\n<li>Not contacting you at work, school, or other named locations<\/li>\n<li>Surrendering temporary legal custody of children, although the court will always consider the best interests of the child in any child custody case<\/li>\n<li>Anything else the court deems necessary<\/li>\n<\/ul>\n<p>The emergency OFP lasts for 45 days or until the case hearing, whichever comes first. This can be extended to 90 days if the police have trouble serving your abuser, known as the adverse party.<\/p>\n<h3>Extended Order for Protection (OFP)<\/h3>\n<p>For an extended OFP to go into effect, there must be a case hearing at a <span data-term-id=\"39164259\">bench trial<\/span> between the petitioner and the adverse party. The petitioner <a href=\"https:\/\/nvcourts.gov\/__data\/assets\/pdf_file\/0023\/25268\/dv-app-pdf.pdf\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">files a form<\/a> that requests more information than required for the emergency OFP. If an extended OFP is the only thing the petitioner files, it becomes a temporary OFP once the case date hearing is set.<\/p>\n<p>At the case hearing, both sides present their side of the story. Evidence can be provided and witnesses called. If the court rules in favor of the petitioner, the OFP will be extended for up to two years. Extended OFPs <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-030\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">offer additional protections and rights<\/a> for the victim. Abusers may be required to attend <span data-term-id=\"39164253\">domestic violence<\/span><span data-term-id=\"39164253\"> counseling<\/span> and perform <span data-term-id=\"39164214\">hours of community service<\/span>.<\/p>\n<h3>High-Risk <span data-term-id=\"39164213\">Protection Order<\/span><\/h3>\n<p>Also known as a red flag order, <span data-term-id=\"39164207\">domestic violence<\/span> victims can <a href=\"https:\/\/nvcourts.gov\/__data\/assets\/pdf_file\/0024\/25773\/high-risk_protection_order_application_for_and_declaration_in_support_of_mandatory_use.pdf\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">file a high-risk <span data-term-id=\"39164213\">protection order<\/span><\/a> when they believe their abuser having access to a firearm is a danger to themselves and others. If enacted, the adverse party has <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-033\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">24 hours to surrender all of their firearms<\/a>. Like other OFPs, the petitioner <a href=\"https:\/\/selfhelp.nvcourts.gov\/images\/protection-orders\/tpo-motion-fillable.pdf\" target=\"_blank\" rel=\"noopener\">can file to make it extended<\/a>. Violation of this order is a <a href=\"https:\/\/www.leg.state.nv.us\/nrs\/nrs-033.html#NRS033Sec031\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"39164210\">misdemeanor<\/span><\/a>.<\/p>\n<h2>What keeps an abuser from ignoring an OFP?<\/h2>\n<p><a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-100\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">Violations of OFPs<\/a> are a big deal in <span data-term-id=\"39164208\">Nevada<\/span>. Each violation carries charges in addition to those stemming from the crimes committed. These range from a <span data-term-id=\"39164210\">misdemeanor<\/span> for the <span data-term-id=\"39164227\">first offense<\/span>, a gross <span data-term-id=\"39164210\">misdemeanor<\/span> for a <span data-term-id=\"39164220\">second offense<\/span>, and a category D felony for either a <span data-term-id=\"39164255\">third offense<\/span> or for offenses like <span data-term-id=\"39164246\">battery constituting <\/span><span data-term-id=\"39164207\">domestic violence<\/span> or <span data-term-id=\"39164218\">strangulation<\/span>.<\/p>\n<p>Punishments for a felony with a <span data-term-id=\"39164219\">deadly weapon<\/span> are severe as well. A <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-193-166\/\" target=\"_blank\" rel=\"noopener\">felony committed as a violation of any OFP<\/a> is subject to between one and 20 years in state prison, in addition to the penalty for the underlying crime.<\/p>\n<p>There are other types of <span data-term-id=\"39164213\">protective orders<\/span> available in <span data-term-id=\"39164208\">Nevada<\/span> that are not just for <span data-term-id=\"39164222\">domestic violence<\/span><span data-term-id=\"39164222\"> cases<\/span>. Am I still covered?<\/h2>\n<p>Any OFP issued in <span data-term-id=\"39164208\">Nevada<\/span> is <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-085\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">required to be entered<\/a> into the Repository for Information Concerning Orders for Protection in the Central Repository for <span data-term-id=\"39164208\">Nevada<\/span> Records of Criminal History. This means it will be available for <span data-term-id=\"39164217\">law enforcement<\/span> anywhere in <span data-term-id=\"39164208\">Nevada<\/span>. Still, it&#8217;s always a good idea to keep a copy of your OFP with you at all times.<\/p>\n<p>No matter where you travel within the United States, its territories, or tribal lands, your OFP is valid. This is due to the <a href=\"https:\/\/www.hud.gov\/vawa#faq\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a>, which offers other protections as well as full faith and credit for OFPs at the federal level.<\/p>\n<h2>I don&#8217;t want my abusive ex to find my new residence. Can the <span data-term-id=\"39164224\">state of <\/span><span data-term-id=\"39164208\">Nevada<\/span> help?<\/h2>\n<p>The <span data-term-id=\"39164208\">Nevada<\/span> <a href=\"https:\/\/dcfs.nv.gov\/Programs\/CAP\/ConfidentialAddressProgram\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">Confidential Address Program (CAP)<\/a> is designed to help those who have suffered abuse from <span data-term-id=\"39164207\">domestic violence<\/span> or other means. It provides the victim with a fictitious address and confidential mail forwarding services. This allows the victim to keep their public records private, such as voting registration.<\/p>\n<h2>I want to get far away from my abuser, but there&#8217;s a lease on our residence. What can I do?<\/h2>\n<p>Under <span data-term-id=\"39164211\">Nevada<\/span><span data-term-id=\"39164211\"> law<\/span>, <span data-term-id=\"39164228\">victims of <\/span><span data-term-id=\"39164207\">domestic violence<\/span>, harassment, <span data-term-id=\"39164212\">sexual assault<\/span>, or stalking <a href=\"https:\/\/codes.findlaw.com\/nv\/title-10-property-rights-and-transactions\/nv-rev-st-118a-345\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">have the right to terminate their lease<\/a> with 30 days&#8217; notice to their landlord. This is done without penalties for breach of contract. They are required to cover the rent for 30 days, which can be done using any outstanding prepaid rent, such as a security deposit. The landlord can request to see the court orders and OFPs.<\/p>\n<p>If the victim wishes to instead stay in the dwelling and have the locks changed, the landlord is required to do so. This is done at the victim&#8217;s expense. The landlord cannot supply a key to the adverse party, even if they&#8217;re still on the lease.<\/p>\n<h2 data-pm-slice=\"1 1 []\">Nevada Domestic Violence Laws: A Summary<\/h2>\n<p>There&#8217;s been a lot of information thrown at you.
