The court may add any additional measures it deems necessary for the victim&#8217;s safety. Let&#8217;s take a good look at <span data-term-id=\"42404670\">Nevada<\/span>&#8216;s <span data-term-id=\"42404668\">protection orders<\/span>.<\/p>\n<h2><span data-term-id=\"42404668\">Protection Orders<\/span> in <span data-term-id=\"42404670\">Nevada<\/span>: The Orders<\/h2>\n<p><span data-term-id=\"42404668\">Protection orders<\/span> in <span data-term-id=\"42404670\">Nevada<\/span> are focused on specific abusive criminal acts, the relationships between those involved, or a combination of the two. Once they&#8217;ve been broken down and explained, it&#8217;s easier to understand which one is right for you.<\/p>\n<h3><span data-term-id=\"42404678\">Domestic Violence<\/span> <span data-term-id=\"42404668\">Protection Orders<\/span><\/h3>\n<p>The requirements for <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\" aria-expanded=\"false\"><span data-term-id=\"42404669\">domestic violence<\/span><\/a> crime classification vary a bit between the states. In <span data-term-id=\"42404670\">Nevada<\/span>, <a href=\"https:\/\/www.findlaw.com\/state\/nevada-law\/nevada-domestic-violence-laws.html\" aria-expanded=\"false\">people considered family, household members, or in a <span data-term-id=\"42404698\">dating relationship<\/span> must have one of a certain subset of abusive crimes<\/a> occur between them for domestic abuse consideration. They are crimes of <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">control and power<\/a>.<\/p>\n<p>If an offense is a <span data-term-id=\"42404669\">domestic violence<\/span> crime, the victim is eligible to petition for a <span data-term-id=\"42404670\">Nevada<\/span> <span data-term-id=\"42404678\">domestic violence<\/span> <span data-term-id=\"42404668\">protection order<\/span>. Victims (petitioners) file in either <span data-term-id=\"42404684\">Justice Court<\/span> or <span data-term-id=\"42404682\">District Court<\/span> for a <strong>temporary <span data-term-id=\"42404704\">ex parte<\/span> <span data-term-id=\"42404678\">domestic violence<\/span> <span data-term-id=\"42404668\">protection order<\/span><\/strong>. You can get help from <a href=\"https:\/\/www.thehotline.org\/get-help\/domestic-violence-local-resources\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><span data-term-id=\"42404669\">domestic violence<\/span> advocates<\/a>.<\/p>\n<p>A judge will review the application. If issued, the <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-020\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">order takes immediate effect<\/a> and lasts for either 45 days or until the case hearing. The abuser (respondent) must receive a <span data-term-id=\"42404708\">copy of the order<\/span> (service of process), but the court doesn&#8217;t need to speak with them to issue the order (<span data-term-id=\"42404704\">ex parte<\/span>).<\/p>\n<p>At the case hearing, both you and the respondent can offer their side of the story, <span data-term-id=\"42404694\">present evidence<\/span>, and call witnesses. If the court decides the threat of abuse still exists, an <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-200-378\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">extended <span data-term-id=\"42404669\">domestic violence<\/span> order of protection<\/a> is issued. Amendments and additions to the previous conditions are permitted. The extended order can stay in effect for up to two years.<\/p>\n<p>Violations of <span data-term-id=\"42404678\">domestic violence<\/span> <span data-term-id=\"42404668\">protection orders<\/span> are severe. Any temporary order violation or first <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-100\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">violation of an extended order is a misdemeanor<\/a>. A second violation of an extended order is a <span data-term-id=\"42404697\">gross misdemeanor<\/span>, and any subsequent violation is a category D felony.<\/p>\n<p>If firearms are prohibited under an extended order, the penalty for violating this prohibition is severe. <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-031\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">Any firearms violation<\/a> is a category B felony.<\/p>\n<h3>Harassment in the Workplace <span data-term-id=\"42404668\">Protection Order<\/span><\/h3>\n<p>Some <span data-term-id=\"42404668\">protective orders<\/span> in <span data-term-id=\"42404670\">Nevada<\/span> are very specific. A <strong>harassment in the workplace order<\/strong> <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-240\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">protects employees and employers<\/a> from someone inflicting bodily damage, property damage, or damage to the physical or mental health or safety of a victim at a <span data-term-id=\"42404703\">place of employment<\/span>. Threatening any of the above is also a crime.<\/p>\n<p><a href=\"https:\/\/nvcourts.gov\/__data\/assets\/pdf_file\/0019\/25714\/harassment_in_the_workplace_temporary_protection_order_mandatory_use_revised_9-30-20.pdf\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">Petitioning for a <span data-term-id=\"42404674\">temporary <\/span><span data-term-id=\"42404668\">protection order<\/span><\/a> is similar to getting a <span data-term-id=\"42404669\">domestic violence<\/span> order. However, an <span data-term-id=\"42404704\">ex parte<\/span> option isn&#8217;t available. The petitioner is required to let the abuser know that they&#8217;re filing for a <span data-term-id=\"42404668\">protection order<\/span>. Court hearings are required for both the temporary order petition and the extended harassment in the workplace order.<\/p>\n<p>The temporary order lasts for 15 days if granted. An extended order can last up to a year. An intentional <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-350\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">violation of the order is a misdemeanor<\/a>. If a conviction for the act committed during the violation is more severe than a misdemeanor, that punishment is used in place of it.<\/p>\n<h3>High-Risk <span data-term-id=\"42404668\">Protection Order<\/span><\/h3>\n<p>Known as extreme risk <span data-term-id=\"42404668\">protection orders<\/span> (ERPO) in other states, a <strong>high-risk <span data-term-id=\"42404668\">protection order<\/span><\/strong> is less punitive and more preventative than other <span data-term-id=\"42404670\">Nevada<\/span> orders. While most <span data-term-id=\"42404668\">protection orders<\/span> are issued as a response to abuse and violence, a <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-570.html\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">high-risk <span data-term-id=\"42404668\">protection order<\/span><\/a> is designed to stop trouble from occurring with firearms in the first place.<\/p>\n<p>A <span data-term-id=\"42404670\">Nevada<\/span> <span data-term-id=\"42404714\">protection against high-risk behavior<\/span> order is an emergency order. It&#8217;s issued if the court believes that the petitioner has proven that the respondent is a danger to both themselves and others. The petition is addressed within a day, and if issued, <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-575\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">the emergency order lasts for seven days<\/a>. <span data-term-id=\"42404704\">Ex parte<\/span> orders are available.<\/p>\n<p>The respondent faces arrest for failing to surrender firearms. The <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-630\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">extended order can last up to a year<\/a>. Violations of the order are a misdemeanor.<\/p>\n<h3><strong><span data-term-id=\"42404668\">Protection Order<\/span> on Behalf of <span data-term-id=\"42404690\">Minor Child<\/span><\/strong><\/h3>\n<p>These <span data-term-id=\"42404668\">protection orders<\/span> are often <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-400\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">filed by a parent or guardian<\/a> to keep others from committing <span data-term-id=\"42404695\">harm to minors<\/span>. They&#8217;re designed to get an abusive adult away from the minor. A <strong><span data-term-id=\"42404668\">protection order<\/span> on behalf of a <span data-term-id=\"42404690\">minor child<\/span><\/strong> functions like a <span data-term-id=\"42404678\">domestic violence<\/span> <span data-term-id=\"42404668\">protection order<\/span>, with a petition for a temporary <span data-term-id=\"42404704\">ex parte<\/span> order. This lasts for 30 days or until the case hearing.<\/p>\n<p>If the <strong><span data-term-id=\"42404676\">extended <\/span><span data-term-id=\"42404668\">protection order<\/span> on behalf of a child<\/strong> is issued after the case hearing, it&#8217;s in effect for up to a year. A <a href=\"https:\/\/codes.findlaw.com\/nv\/title-3-remedies-special-actions-and-proceedings\/nv-rev-st-33-400\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">violation of a temporary order<\/a> is a <span data-term-id=\"42404697\">gross misdemeanor<\/span>, while a violation of an extended order is a category C felony in <span data-term-id=\"42404670\">Nevada<\/span>. If the penalty for the offense exceeds the penalty for the violation, it&#8217;s used instead.<\/p>\n<h3><span data-term-id=\"42404671\">Sexual Assault<\/span> <span data-term-id=\"42404668\">Protection Order<\/span><\/h3>\n<p>Victims of any kind of non-consensual sexual penetration can find relief from further <span data-term-id=\"42404691\">sexual abuse<\/span> with a <span data-term-id=\"42404670\">Nevada<\/span> <strong><span data-term-id=\"42404671\">sexual assault<\/span> <span data-term-id=\"42404668\">protection order<\/span><\/strong>. This includes spouses and <span data-term-id=\"42404717\">former spouses<\/span> who have been forced into unwanted sexual acts.<\/p>\n<p>Temporary <span data-term-id=\"42404671\">sexual assault<\/span> <span data-term-id=\"42404668\">protection orders<\/span> <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-200-378\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">are available <span data-term-id=\"42404704\">ex parte<\/span><\/a>. Petitioners can file in <span data-term-id=\"42404684\">justice court<\/span>, but a judge can issue an order from criminal court as either a bail requirement or after the trial is over. It lasts 30 days or until the case hearing, whichever comes first.<\/p>\n<p>Extended orders last up to three years. Violating a temporary order is a <span data-term-id=\"42404697\">gross misdemeanor<\/span>. A category C felony awaits those who violate an extended\u00a0<span data-term-id=\"42404671\">sexual assault<\/span>\u00a0<span data-term-id=\"42404668\">protection order<\/span>. All <span data-term-id=\"42404671\">sexual assault<\/span> <span data-term-id=\"42404668\">protection orders<\/span> are sent to the <a href=\"https:\/\/www.leg.state.nv.us\/App\/InterimCommittee\/REL\/Document\/12762\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">Central Repository for <span data-term-id=\"42404670\">Nevada<\/span> Records of Criminal History<\/a>.<\/p>\n<h3><strong>Stalking and Harassment <span data-term-id=\"42404668\">Protection Order<\/span><\/strong><\/h3>\n<p>A <strong>stalking and harassment <span data-term-id=\"42404668\">protection order<\/span><\/strong> is true to its name. It covers the crimes of <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-200-575\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">stalking, <span data-term-id=\"42404699\">aggravated stalking<\/span>, and harassment<\/a>. Repeated threats from an abuser would qualify for this order as well. Protections focus on keeping the harasser\/stalker away from the victim and their <span data-term-id=\"42404688\">family members<\/span>.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-200-591\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">stalking and harassment order<\/a> follows many of the same rules as the <span data-term-id=\"42404671\">sexual assault<\/span> <span data-term-id=\"42404668\">protective order<\/span>, but also has a few different characteristics. It&#8217;s available as a temporary <span data-term-id=\"42404704\">ex parte<\/span> order, but lasts for 45 days instead of 30. In addition to offering relief to the victim, their family and household members can also receive protection under the order.<\/p>\n<p>A judge can issue a stalking and harassment <span data-term-id=\"42404668\">protection order<\/span> before, during, or after a trial. Extended orders can last up to three years. A <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-193-140\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42404697\">gross misdemeanor<\/span><\/a> is the penalty for violation of a temporary order. Those who violate an extended order face a <a href=\"https:\/\/codes.findlaw.com\/nv\/title-15-crimes-and-punishments\/nv-rev-st-193-130\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">category C felony<\/a>.<\/p>\n<h2 data-pm-slice=\"1 5 []\">Nevada Protective Orders Laws: Summary<\/h2>\n<p>As you&#8217;ve seen, we weren&#8217;t exaggerating about the number of protection orders available under Nevada law.
