It also has methods of deterrence to deny abusers opportunities to continue the vicious cycle of threats, violence, and abuse. This article will define what <span data-term-id=\"39158299\">New Hampshire<\/span> considers <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\"><span data-term-id=\"39158298\">domestic violence<\/span><\/a>, the guardrails the state has in place, and what happens when charges of abuse are exposed.<\/p>\n<h2><span data-term-id=\"39158299\">New Hampshire<\/span> <span data-term-id=\"39158337\">Domestic Violence<\/span><span data-term-id=\"39158337\"> Laws<\/span>: How They Work<\/h2>\n<p>Not all crimes in <span data-term-id=\"39158299\">New Hampshire<\/span> between people who know each other are considered to be <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/stop-domestic-violence.html\"><span data-term-id=\"39158298\">domestic violence<\/span><\/a>. There are two elements required of a crime for it to be considered <span data-term-id=\"39158341\">domestic abuse<\/span> in the <span data-term-id=\"39158347\">state of <\/span><span data-term-id=\"39158299\">New Hampshire<\/span>: the relationship between those involved and the type of crime committed. Let&#8217;s take a closer look at each aspect.<\/p>\n<h3><span data-term-id=\"39158298\">Domestic Violence<\/span> in <span data-term-id=\"39158299\">New Hampshire<\/span>: Who Can Be Part of It?<\/h3>\n<p><span data-term-id=\"39158315\">New Hampshire<\/span><span data-term-id=\"39158315\"> law<\/span> notes that those who can be caught up in <span data-term-id=\"39158298\">domestic violence<\/span> are <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-1.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39158317\">family members<\/span>, <span data-term-id=\"39158302\">household members<\/span>, and current or former sexual or <span data-term-id=\"39158301\">intimate partners<\/span><\/a>. That definition can feel a bit vague. Here&#8217;s a detailed list:<\/p>\n<ul>\n<li>Spouses or <span data-term-id=\"39158319\">former spouses<\/span><\/li>\n<li>Those living together now or who have lived together in the past<\/li>\n<li>Parents of a child together<\/li>\n<li>Family through consanguinity (blood relations)<\/li>\n<li>Family through marriage affinity (in-laws with a blood connection to a spouse)<\/li>\n<li>Current or former sexual partners<\/li>\n<li>Current or former intimate\/romantic partner (no sexual relations required)<\/li>\n<\/ul>\n<p>An offense that doesn&#8217;t qualify as <span data-term-id=\"39158298\">domestic violence<\/span> due to those involved not belonging to one of the above categories is still a crime. The court may rule that you and another person didn&#8217;t have a relationship that could be considered intimate or romantic, but if they&#8217;re stalking you, they can be arrested and charged.<\/p>\n<h3><span data-term-id=\"39158298\">Domestic Violence<\/span> in <span data-term-id=\"39158299\">New Hampshire<\/span>: Which Crimes Qualify?<\/h3>\n<p>No matter which types of abuse are involved, <span data-term-id=\"39158298\">domestic violence<\/span> crimes center around <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">control and power<\/a>. The abuser seeks to maintain control over the victim by means of threats, intimidation, violence, and many kinds of abuse.<\/p>\n<p><span data-term-id=\"39158299\">New Hampshire<\/span> identifies certain offenses as <span data-term-id=\"39158298\">domestic violence<\/span>. If the participants meet the state&#8217;s relationship criteria, any of the following can be charged as <span data-term-id=\"39158298\">domestic violence<\/span> crimes:<\/p>\n<ul>\n<li><a href=\"https:\/\/gc.nh.gov\/rsa\/html\/LXII\/633\/633-1.htm\" target=\"_blank\" rel=\"noopener\">Kidnapping<\/a><\/li>\n<li>Criminal restraint<\/li>\n<li>False imprisonment<\/li>\n<li>Arson<\/li>\n<li>Criminal Mischief<\/li>\n<li>Burglary<\/li>\n<li>Criminal Trespass<\/li>\n<li>Harassment<\/li>\n<li>Cruelty to animals<\/li>\n<li>First-degree assault and second-degree assault<\/li>\n<li><a href=\"https:\/\/gc.nh.gov\/rsa\/html\/LXII\/631\/631-2-b.htm\" target=\"_blank\" rel=\"noopener\">Assault &#8211; <span data-term-id=\"39158298\">domestic violence<\/span><\/a><\/li>\n<li><span data-term-id=\"39158333\">Reckless conduct<\/span><\/li>\n<li><span data-term-id=\"39158323\">Criminal threatening<\/span><\/li>\n<li>Aggravated felonious <span data-term-id=\"39158304\">sexual assault<\/span><\/li>\n<li><a href=\"https:\/\/gc.nh.gov\/rsa\/html\/LXII\/632-A\/632-A-3.htm\" target=\"_blank\" rel=\"noopener\">Felonious <span data-term-id=\"39158304\">sexual assault<\/span><\/a><\/li>\n<li><a href=\"https:\/\/gc.nh.gov\/rsa\/html\/LXII\/632-A\/632-A-4.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39158304\">Sexual assault<\/span><\/a><\/li>\n<\/ul>\n<p>In many instances, the crimes will use a special classification if <span data-term-id=\"39158341\">domestic abuse<\/span> is involved. For example, a conviction for <span data-term-id=\"39158304\">sexual assault<\/span> that qualifies as <span data-term-id=\"39158341\">domestic abuse<\/span> is recorded as &#8220;<a href=\"https:\/\/gc.nh.gov\/rsa\/html\/LXII\/632-A\/632-A-4.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39158304\">sexual assault<\/span> &#8211; <span data-term-id=\"39158298\">domestic violence<\/span><\/a>.&#8221;<\/p>\n<p>Often overlooked, a charge of <span data-term-id=\"39158323\">criminal threatening<\/span> means that using intimidation and threats is a form of <span data-term-id=\"39158298\">domestic violence<\/span>. For example, promising physical assault for disobeying an abuser&#8217;s rule that causes the <span data-term-id=\"39158339\">fear of imminent bodily injury<\/span> is considered as much of a <span data-term-id=\"39158298\">domestic violence<\/span> crime as if the physical abuse happened.<\/p>\n<p>In addition to any other charges, <a href=\"https:\/\/gc.nh.gov\/rsa\/html\/LXII\/632-A\/632-A-4.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39158298\">domestic violence<\/span> is a <span data-term-id=\"39158343\">class A <\/span><span data-term-id=\"39158310\">misdemeanor<\/span><\/a>. It becomes a <span data-term-id=\"39158327\">class B felony<\/span> if the abuser used or threatened the use of a <span data-term-id=\"39158308\">deadly weapon<\/span>. Each act of <span data-term-id=\"39158298\">domestic violence<\/span> is subject to a $50 fine, which cannot be reduced or suspended.<\/p>\n<h2><span data-term-id=\"39158299\">New Hampshire<\/span> <span data-term-id=\"39158337\">Domestic Violence<\/span><span data-term-id=\"39158337\"> Laws<\/span>: Orders of Protection<\/h2>\n<p>It&#8217;s difficult to prevent initial instances of <span data-term-id=\"39158298\">domestic violence<\/span> from occurring, but the <span data-term-id=\"39158347\">state of <\/span><span data-term-id=\"39158299\">New Hampshire<\/span> tries to give victims the means to keep it from happening again. In addition to criminal punishments, <span data-term-id=\"39158313\">victims of <\/span><span data-term-id=\"39158298\">domestic violence<\/span> have access to specialized <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\">orders of protection<\/a>.<\/p>\n<p><span data-term-id=\"39158299\">New Hampshire<\/span> offers <a href=\"https:\/\/www.courts.nh.gov\/self-help\/restraining-orders\" target=\"_blank\" rel=\"noopener\">three different types of <span data-term-id=\"39158300\">protective orders<\/span><\/a> for <span data-term-id=\"39158298\">domestic violence<\/span> victims. These <span data-term-id=\"39158303\">restraining orders<\/span> share many aspects, but each order is for a different situation. It&#8217;s essential to know which one you need, so let&#8217;s examine each one. Findlaw also offers an article <a href=\"https:\/\/www.findlaw.com\/state\/new-hampshire-law\/new-hampshire-protective-orders-laws.html\">just about New Hampshire protective orders<\/a>.<\/p>\n<h3>Emergency Ex Parte Order of Protection<\/h3>\n<p>This is an immediate and temporary form of protection <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-4.htm\" target=\"_blank\" rel=\"noopener\">a victim can seek when the courts are closed<\/a>. Victims contact their local\u00a0<span data-term-id=\"39158373\">law enforcement agency<\/span>, which then contacts an on-call judge.<\/p>\n<p>If issued, the emergency ex parte order of protection remains in effect until the end of the next business day. For further protection, the victim must submit a petition in a circuit court for either a temporary ex parte order of protection or a final order of protection.<\/p>\n<h3>Temporary Ex Parte Order of Protection<\/h3>\n<p>A <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-3.htm\" target=\"_blank\" rel=\"noopener\">temporary ex parte order of protection<\/a> differs from an emergency order in how it&#8217;s acquired and how long it can last. Victims fill out a <a href=\"https:\/\/www.courts.nh.gov\/our-courts\/circuit-court\/family-division\/forms\/domestic-violence\" target=\"_blank\" rel=\"noopener\">packet of forms<\/a> in circuit court. If the order is approved, the alleged abuser is served. If they object to the claim, a case hearing will be set within 30 days from the plaintiff&#8217;s filing or 10 days after the defendant is served.<\/p>\n<p>At the case hearing, both parties present their arguments. Each person can show evidence and call witnesses. If the court rules in favor of the victim, terms will be set for the final <span data-term-id=\"39158300\">protective orders<\/span>.<\/p>\n<h3>Final <span data-term-id=\"39158300\">Protective Orders<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-5.htm\" target=\"_blank\" rel=\"noopener\">final <span data-term-id=\"39158300\">protective order<\/span><\/a> is the result of the court finding that the preponderance of the evidence indicates that <span data-term-id=\"39158298\">domestic violence<\/span> abuse occurred. An initial order is valid for up to one year, but subsequent petitions from the victim can extend it for another year and up to five years after that.<\/p>\n<h3>Protections Offered by Orders of Protection<\/h3>\n<p>In addition to length, there are differences in what conditions can be imposed by each order of protection. All <span data-term-id=\"39158298\">domestic violence<\/span> <span data-term-id=\"39158300\">protective orders<\/span> in <span data-term-id=\"39158299\">New Hampshire<\/span> can demand the following from the defendant:<\/p>\n<ul>\n<li>Surrender of all firearms<\/li>\n<li>No abuse of you, your relatives, or your <span data-term-id=\"39158302\">household members<\/span><\/li>\n<li>No entering of your home or the surrounding area unless they are accompanied by a peace officer, have given you reasonable notice, or to retrieve personal belongings<\/li>\n<li>No contact with you or showing up at your work, school, or other specified locations<\/li>\n<li>No taking, damaging, or destroying of your property<\/li>\n<li>Acknowledging temporary custody orders as set by the state in the best interest of a child<\/li>\n<li>Abiding by visitation rulings, which may deny or order supervised visitation<\/li>\n<li>Staying away from any household animal<\/li>\n<li>Not causing the disconnection of any utilities and services to your home<\/li>\n<li>Granting you the exclusive use and possession of the home, an automobile, or household furniture<\/li>\n<li>Anything else the court deems necessary<\/li>\n<\/ul>\n<p>Conditions can be modified to fit the situation. Anything listed above may be included in any final <span data-term-id=\"39158300\">protective order<\/span>. No two <span data-term-id=\"39158345\">domestic violence<\/span><span data-term-id=\"39158345\"> cases<\/span> will be the same, so the terms of orders of protection will differ as well.<\/p>\n<p>Additional protections are available with a final <span data-term-id=\"39158300\">protective order<\/span>. These include:<\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Ordering the defendant to pay:<\/span>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Financial support to you and your minor children if they have a legal duty to do so<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">For losses suffered as a direct result of the abuse<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">For attorney&#8217;s fees<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Child support<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Insurance bills, mortgage payments, car payments, etc.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Ordering the defendant to surrender your personal items<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Mandatory attendance by the abuser to a batterer\u2019s intervention program or personal counseling<\/span><\/li>\n<\/ul>\n<p>Provisions are tailored to meet the specifics of each case.<\/p>\n<h3>Violations of <span data-term-id=\"39158299\">New Hampshire<\/span> Orders of Protection<\/h3>\n<p><span data-term-id=\"39158299\">New Hampshire<\/span> doesn&#8217;t tolerate violations of orders of protection. Law enforcement is instructed to arrest and detain anyone accused of violating an order. The officer does not have to witness the incident. The abuser will be held until their arraignment.<\/p>\n<p>The first violation of a <span data-term-id=\"39158300\">protective order<\/span> is a <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-9.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39158343\">class A <\/span><span data-term-id=\"39158310\">misdemeanor<\/span><\/a>. This becomes a <span data-term-id=\"39158327\">class B felony<\/span> for the use or the <span data-term-id=\"39158357\">threatened use of a <\/span><span data-term-id=\"39158308\">deadly weapon<\/span>. Any subsequent violation within six years of the conviction will increase the punishment for the crime by one level. For example, a <span data-term-id=\"39158343\">class A <\/span><span data-term-id=\"39158310\">misdemeanor<\/span> becomes a <span data-term-id=\"39158327\">class B felony<\/span>.<\/p>\n<h2><span data-term-id=\"39158299\">New Hampshire<\/span> <span data-term-id=\"39158337\">Domestic Violence<\/span><span data-term-id=\"39158337\"> Laws<\/span>: Other Protections<\/h2>\n<p><span data-term-id=\"39158299\">New Hampshire<\/span> residents have additional safeguards in place. Under <span data-term-id=\"39158335\">federal law<\/span>, the <a href=\"https:\/\/www.hud.gov\/vawa#faq\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a> ensures that <span data-term-id=\"39158299\">New Hampshire<\/span> orders of protection are enforceable in all US states and territories. VAWA also offers protections for federal housing.<\/p>\n<p>The <a href=\"https:\/\/www.doj.nh.gov\/bureaus\/office-victimwitness-assistance\/address-confidentiality-program\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39158299\">New Hampshire<\/span> Address Confidentiality Program<\/a> allows victims to keep a new address hidden from their abusers. They&#8217;re issued a second legal address, often a PO box, that&#8217;s used for all public records, such as driver&#8217;s licenses, taxes, and voting registration.<\/p>\n<p>In 2024, <a href=\"https:\/\/gencourt.state.nh.us\/bill_status\/legacy\/bs2016\/billText.aspx?sy=2024&amp;v=HP&amp;id=288\" target=\"_blank\" rel=\"noopener\">House Bill 261 (HB 261)<\/a> was passed to aid <span data-term-id=\"39158298\">domestic violence<\/span> victims in escaping further abuse. Taking effect on 1\/1\/2025, HB 261 allows victims to break lease agreements without penalty to flee their abuser.
