Lawmakers in the New Hampshire House and New Hampshire Senate continue to fail at the task. A University of New Hampshire poll showed that&nbsp;<a href=\"https:\/\/scholars.unh.edu\/cgi\/viewcontent.cgi?article=1797&amp;context=survey_center_polls\" target=\"_blank\" rel=\"noopener\">almost two-thirds of New Hampshire residents<\/a>&nbsp;approve of cannabis legalization.<\/p>\r\n<p>Recently,&nbsp;<a href=\"https:\/\/www.billtrack50.com\/billdetail\/1655303\" target=\"_blank\" rel=\"noopener\">House Bill 1633 (HB1633-FN-A)<\/a>&nbsp;appeared to have enough support to pass and overcome a threatened veto from outgoing Republican Gov. Chris Sununu. Unfortunately, changes made to the bill weakened its support.&nbsp;<a href=\"https:\/\/www.nhpr.org\/nh-news\/2024-06-13\/after-months-of-debate-nh-house-shelves-plan-to-legalize-marijuana-in-state\" target=\"_blank\" rel=\"noopener\">The proposal got tabled<\/a>&nbsp;in June 2024.&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/medical-marijuana-an-overview.html\">Medical marijuana<\/a>&nbsp;remains available for qualified patients.<\/p>\r\n<p>Let&#8217;s take a look at how the medical marijuana program works as we examine marijuana laws in New Hampshire.<\/p>\r\n<h2>How Marijuana Laws Work in New Hampshire<\/h2>\r\n<p>In 2013, the New Hampshire legislature passed of&nbsp;<a href=\"https:\/\/www.gencourt.state.nh.us\/legislation\/2013\/HB0573.html\" target=\"_blank\" rel=\"noopener\">House Bill 573-FN (HB 573-FN)<\/a>&nbsp;to legalize marijuana for medical purposes. The law was also known as the Use of Cannabis for Therapeutic Purposes Act.<\/p>\r\n<p>Medical cannabis and cannabis products are available for registered patients in New Hampshire&#8217;s&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/programs-services\/population-health\/therapeutic-cannabis\" target=\"_blank\" rel=\"noopener\">Therapeutic Cannabis Program (TCP)<\/a>, which is part of the Department of Health and Human Services.<\/p>\r\n<p>Outside the TCP, any possession of marijuana for personal use remains illegal. There is no recreational use allowed. This makes New Hampshire the last state in New England to ban the use of small amounts of marijuana by adults. Medical patients must use marijuana products in their private residences.<\/p>\r\n<p>Marijuana is a&nbsp;<a href=\"https:\/\/www.dea.gov\/drug-information\/drug-scheduling\" target=\"_blank\" rel=\"noopener\">Schedule I drug<\/a>&nbsp;under the&nbsp;<a href=\"https:\/\/www.dea.gov\/drug-information\/csa\" target=\"_blank\" rel=\"noopener\">Controlled Substances Act (CSA)<\/a>. This means any possession or use of marijuana on federal lands, such as a national park, violates federal law. While&nbsp;<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-submits-proposed-regulation-reschedule-marijuana\" target=\"_blank\" rel=\"noopener\">reclassification is on the horizon<\/a>, as of November 2024, marijuana possession remains a federal crime.<\/p>\r\n<p>While possessing cannabis is illegal for non-patients, New Hampshire decriminalized some possession charges with&nbsp;<a href=\"https:\/\/trackbill.com\/bill\/new-hampshire-house-bill-640-relative-to-the-transparency-of-federal-agency-operations-within-new-hampshire\/2610951\/\" target=\"_blank\" rel=\"noopener\">House Bill 640<\/a>&nbsp;in 2017. With first-time and second-time possession offenses that are 0.75 ounces\/21.3 grams or less, the charge is a civil violation that carries a fine of $100. A third offense within three years of the original infraction is a fine of $300; subsequent offenses are class B misdemeanors and entail a fine of $1,200.<\/p>\r\n<p>Possession of more than 0.75 ounces\/21.3 grams is a class A misdemeanor, punishable by up to a year in jail. Possession of larger amounts can get charged as possession with intent to sell.<\/p>\r\n<p>All sales outside of&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/programs-services\/population-health\/therapeutic-cannabis\/alternative-treatment-centers\" target=\"_blank\" rel=\"noopener\">Alternative Treatment Centers (ATC)<\/a>&nbsp;in New Hampshire are illegal and charged as felony offenses. All private cultivation of marijuana plants is also against the law. Possession and sale of marijuana paraphernalia is also illegal. Based on the amount, it can bring serious criminal charges. Even a small amount may result in misdemeanor charges, a possible year in jail, and a fine of up to $2,000.<\/p>\r\n<h2>New Hampshire Medical Marijuana Laws<\/h2>\r\n<p>The&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/programs-services\/population-health\/therapeutic-cannabis\" target=\"_blank\" rel=\"noopener\">Therapeutic Cannabis Program<\/a>&nbsp;oversees New Hampshire&#8217;s medical marijuana use. To buy medical cannabis and cannabis products, a patient must be part of the TCP. You&#8217;ll need a&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/sites\/g\/files\/ehbemt476\/files\/documents\/2021-11\/tcp-writtencertification.pdf\" target=\"_blank\" rel=\"noopener\">written certification<\/a>&nbsp;from a physician in New Hampshire, Vermont, Maine, or Massachusetts. Your meeting must be in person.<\/p>\r\n<p>Eligible patients must be suffering from a&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/programs-services\/population-health\/therapeutic-cannabis\/qualifying-medical-conditions\" target=\"_blank\" rel=\"noopener\">qualifying medical condition<\/a>. This can be either certain stand-alone medical conditions or a combination of a qualifying diagnosis and a qualifying symptom. Qualifying stand-alone conditions include:<\/p>\r\n<ul>\r\n<li>Autism spectrum disorder (21 and older)<\/li>\r\n<li>Autism spectrum disorder (under 21) (requires a consultation with a certified provider of child)<\/li>\r\n<li>Post-traumatic stress disorder (PTSD) \u2014 moderate to severe<\/li>\r\n<li>Moderate to severe chronic pain<\/li>\r\n<li>Severe pain<\/li>\r\n<li>Opioid use disorder<\/li>\r\n<\/ul>\r\n<p>Qualifying diagnoses require a symptom as well to be eligible for medical cannabis treatment. The diagnoses are:<\/p>\r\n<ul>\r\n<li>AIDS\/HIV<\/li>\r\n<li>Multiple sclerosis (MS)<\/li>\r\n<li>Alzheimer&#8217;s disease<\/li>\r\n<li>Spinal cord injury or disease<\/li>\r\n<li>Amyotrophic lateral sclerosis (ALS)<\/li>\r\n<li>Traumatic brain injury<\/li>\r\n<li>Cancer<\/li>\r\n<li>Ulcerative colitis<\/li>\r\n<li>Chronic pancreatitis<\/li>\r\n<li>Parkinson&#8217;s disease<\/li>\r\n<li>Crohn&#8217;s disease<\/li>\r\n<li>Ehlers-Danlos syndrome<\/li>\r\n<li>Muscular dystrophy<\/li>\r\n<li>Epilepsy<\/li>\r\n<li>Glaucoma<\/li>\r\n<li>Hepatitis C<\/li>\r\n<li>Lupus<\/li>\r\n<li>Injuries or conditions that have qualifying symptoms<\/li>\r\n<li>Positive status for human immunodeficiency virus<\/li>\r\n<\/ul>\r\n<p>The paired symptoms can be any of the following:<\/p>\r\n<ul>\r\n<li>Agitation of Alzheimer&#8217;s disease<\/li>\r\n<li>Wasting syndrome<\/li>\r\n<li>Cachexia<\/li>\r\n<li>Severe and persistent muscle spasms<\/li>\r\n<li>Chemotherapy-induced anorexia<\/li>\r\n<li>Severe pain<\/li>\r\n<li>Constant or severe nausea<\/li>\r\n<li>Elevated intraocular pressure<\/li>\r\n<li>Moderate to severe insomnia<\/li>\r\n<li>Seizures<\/li>\r\n<li>Moderate to severe vomiting<\/li>\r\n<\/ul>\r\n<p>If you aren&#8217;t sure if you qualify, speak to your doctor or&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/therapeutic-cannabis-program\" target=\"_blank\" rel=\"noopener\">contact the TCP<\/a>.<\/p>\r\n<p>Once you have the written certification, you can complete the&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/sites\/g\/files\/ehbemt476\/files\/documents\/2021-11\/tcp-applicationpatient.pdf\" target=\"_blank\" rel=\"noopener\">TCP application form<\/a>. You can mail or hand-deliver your application, the certification, proof of New Hampshire residence, and a check or money order for $50 to:<\/p>\r\n<p>NH Department of Health and Human Services<br>\r\nTherapeutic Cannabis Program<br>\r\n29 Hazen Drive<br>\r\nConcord, NH 03301<\/p>\r\n<p>The department will approve or deny complete applications within 15 days. If approved, you will get your Registry ID Card within five days. The TCP will request any missing documents.<\/p>\r\n<p>When you have your Registry ID Card in hand, you or your caregiver can make medical cannabis purchases at an&nbsp;<a href=\"https:\/\/www.dhhs.nh.gov\/programs-services\/population-health\/therapeutic-cannabis\/alternative-treatment-centers\" target=\"_blank\" rel=\"noopener\">Alternative Treatment Center (ATC)<\/a>&nbsp;dispensary. ATCs are non-profit businesses licensed by the state to provide medical marijuana for patients.<\/p>\r\n<p>Patients are limited to purchasing 2 ounces\/56.7 grams of cannabis or cannabis products every 10 days. This is also the possession limit. Any combination of cannabis flower and THC-infused cannabis products is permitted as long as the total stays equal to or below the possession limit.<\/p>\r\n<p>Besides marijuana flower, these other types of cannabis products are legal to buy from a New Hampshire ATC:<\/p>\r\n<ul>\r\n<li>Tinctures<\/li>\r\n<li>Edibles such as gummies<\/li>\r\n<li>Pre-rolls<\/li>\r\n<li>Vape cartridges and distillate<\/li>\r\n<li>Topicals<\/li>\r\n<li>Extracts in products like butter<\/li>\r\n<li>Baked goods<\/li>\r\n<li>Capsules<\/li>\r\n<li>Chocolates and other candies<\/li>\r\n<li>Drinks that include teas and hot cocoa mixture<\/li>\r\n<li>Honey<\/li>\r\n<\/ul>\r\n<p>There are no taxes on medical marijuana purchases in New Hampshire. Private cultivation remains illegal for TCP patients. New Hampshire honors reciprocity for out-of-state patients with medical marijuana cards.<\/p>\r\n<h2>New Hampshire Marijuana Law Penalties<\/h2>\r\n<p>Operating a motor vehicle under the influence of cannabis carries the same punishment as an&nbsp;<a href=\"https:\/\/www.ncdd.com\/new-hampshire-dwi-laws\" target=\"_blank\" rel=\"noopener\">alcohol-related DUI<\/a>.
