Both provide <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-4.htm#:~:text=Other%20temporary%20relief%20may%20include\" target=\"_blank\" rel=\"noopener\">relief through provisions tailored to each victim&#8217;s needs<\/a>. All orders include no contact and stay-away conditions for the abuser. Let&#8217;s take a look at what each order consists of.<\/p>\n<h3><span data-term-id=\"39257972\">New Hampshire<\/span> <span data-term-id=\"39257980\">Domestic Violence<\/span> <span data-term-id=\"39257971\">Protective Order<\/span><\/h3>\n<p><span data-term-id=\"39257970\">Domestic violence<\/span> occurs when certain abusive acts occur between people who are <span data-term-id=\"39257976\">household members<\/span>, <span data-term-id=\"39257981\">family members<\/span>, or <span data-term-id=\"39257974\">intimate partners<\/span>. These crimes of <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">power and control<\/a> are committed by an abuser to dominate their victim. By keeping the abuser and the victim apart, <span data-term-id=\"39257971\">protective orders<\/span> attempt to break the toxic cycle of violence and abuse.<\/p>\n<p><span data-term-id=\"39257970\">Domestic violence<\/span> can&#8217;t occur between strangers. People and relationships that <span data-term-id=\"39257972\">New Hampshire<\/span> considers <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-1.htm#:~:text=Family%20or%20household%20member%22%20means\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39257981\">family members<\/span>, <span data-term-id=\"39257976\">household members<\/span>, and <span data-term-id=\"39257974\">intimate partners<\/span><\/a> are the following:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li>Former spouses<\/li>\n<li>Those living together<\/li>\n<li>Those who have lived together in the past<\/li>\n<li>Parents with a child in common<\/li>\n<li>Family through blood relations (consanguinity)<\/li>\n<li>Family through marriage affinity (in-laws with a blood connection to a spouse)<\/li>\n<li>Current sexual partners<\/li>\n<li>Former sexual partners<\/li>\n<li>Current intimate\/romantic partners (no sexual relations required)<\/li>\n<li>Former intimate\/romantic partners (no sexual relations required)<\/li>\n<\/ul>\n<p>Having qualifying participants doesn&#8217;t ensure that a crime is considered <span data-term-id=\"39257970\">domestic violence<\/span>. Those involved must have an <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-1.htm#:~:text=Abuse%22%20means%20the%20commission%20or%20attempted%20commission%20of%20one%20or%20more%20of%20the%20acts\" target=\"_blank\" rel=\"noopener\">offense from the following list<\/a> committed between them:<\/p>\n<ul>\n<li>Assault or reckless conduct<\/li>\n<li><span data-term-id=\"39257996\">Sexual assault<\/span><\/li>\n<li>Interference with freedom<\/li>\n<li><span data-term-id=\"39257997\">Destruction of property<\/span><\/li>\n<li>Criminal threatening<\/li>\n<li>Unauthorized entry<\/li>\n<li>Harassment<\/li>\n<li>Cruelty to animals<\/li>\n<\/ul>\n<p>A husband&#8217;s <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/LXII\/633\/633-1.htm\" target=\"_blank\" rel=\"noopener\">kidnapping of his wife&#8217;s sister<\/a> would receive a <span data-term-id=\"39257970\">domestic violence<\/span> classification. Someone punching a coworker is assault, but not <span data-term-id=\"39257970\">domestic violence<\/span> because there&#8217;s no close, personal relationship. It&#8217;s still a crime subject to prosecution.<\/p>\n<h3><span data-term-id=\"39257972\">New Hampshire<\/span> Stalking <span data-term-id=\"39257971\">Protective Orders<\/span><\/h3>\n<p>For many, stalking invokes images of a menacing, shadowy figure following a frightened victim. That&#8217;s part of the definition, but not all of it. Under <span data-term-id=\"39257975\">New Hampshire<\/span><span data-term-id=\"39257975\"> law<\/span>, <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/LXII\/633\/633-3-a.htm\" target=\"_blank\" rel=\"noopener\">stalking encompasses<\/a> a course of conduct that involves committing multiple acts of any of these offenses:<\/p>\n<ul>\n<li>Threatening the safety of the victim or an immediate <span data-term-id=\"39257981\">family member<\/span><\/li>\n<li>Following, approaching, or confronting a victim or a member of the victim&#8217;s immediate family<\/li>\n<li>Appearing close to or entering the victim&#8217;s residence, <span data-term-id=\"39258010\">place of employment<\/span>, school, or other location<\/li>\n<li>Appearing close to or entering the residence, <span data-term-id=\"39258010\">place of employment<\/span>, or school of a member of the victim&#8217;s immediate family<\/li>\n<li>Causing damage to the person&#8217;s residence or property<\/li>\n<li>Causing damage to the residence or property of a member of the victim&#8217;s immediate family<\/li>\n<li>Placing an object or having an object placed on the victim&#8217;s property<\/li>\n<li>Placing an object or having an object placed on the property of an immediate <span data-term-id=\"39257981\">family member<\/span> of the victim<\/li>\n<li>Causing injury to a victim&#8217;s pet<\/li>\n<li>Causing injury to a pet belonging to a member of the victim&#8217;s immediate family<\/li>\n<li>Any act of communication (repeated harassment)<\/li>\n<\/ul>\n<p>There&#8217;s no relationship requirement for a victim to get a stalking <span data-term-id=\"39257971\">protective order<\/span>. If stalking occurs between people in a qualifying relationship, a conviction is classified as &#8220;<a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/LXII\/633\/633-3-a.htm#:~:text=Upon%20proof%20that%20the%20victim%20and%20defendant%20were%20intimate%20partners%20or%20family%20or%20household%20members%2C%20as%20those%20terms%20are%20defined%20in%20RSA%20631%3A2%2Db%2C%20III%2C%20a%20conviction%20under%20this%20section%20shall%20be%20recorded%20as%20%22stalking%2Ddomestic%20violence.\" target=\"_blank\" rel=\"noopener\">stalking-<span data-term-id=\"39257970\">domestic violence<\/span><\/a>.&#8221;<\/p>\n<h2><span data-term-id=\"39257972\">New Hampshire<\/span> <span data-term-id=\"39257971\">Protective Orders<\/span> &#8211; Protections<\/h2>\n<p><span data-term-id=\"39257973\">Restraining orders<\/span> in <span data-term-id=\"39257972\">New Hampshire<\/span> offer specific provisions for each case. In trying to balance the needs of the victim with the rights of the abuser, each <span data-term-id=\"39257971\">protective order<\/span> can have a different makeup. While there&#8217;s overlap between the two, <span data-term-id=\"39257980\">domestic violence<\/span> <span data-term-id=\"39257971\">protection orders<\/span> tend to have more provisions than stalking orders <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-4.htm#:~:text=Awarding%20custody%20of%20minor%20children\" target=\"_blank\" rel=\"noopener\">due to the personal relationship involved<\/a>.<\/p>\n<p>Stay-away and no-contact orders are standard for both <span data-term-id=\"39257971\">protective orders<\/span>. Other possible provisions include, but aren&#8217;t limited to, the following:<\/p>\n<ul>\n<li>Forbidding the defendant (abuser\/stalker) from <span data-term-id=\"39257988\">acts of abuse<\/span> or stalking the plaintiff (victim), their relatives, or <span data-term-id=\"39257976\">household members<\/span><\/li>\n<li>Forbidding the defendant from entering the plaintiff&#8217;s residence (unless accompanied by a <span data-term-id=\"39258006\">peace officer<\/span> to retrieve personal property at an approved time)<\/li>\n<li>Forbidding the defendant from contacting the plaintiff or entering the plaintiff&#8217;s <span data-term-id=\"39258010\">place of employment<\/span>, school, or other specified location<\/li>\n<li>Forbidding the defendant from taking, converting, or damaging the property of the plaintiff<\/li>\n<li>Ordering the defendant to surrender all <span data-term-id=\"39257990\">deadly weapons<\/span> specified in the <span data-term-id=\"39257971\">protective order<\/span><\/li>\n<li>Awarding the petitioner exclusive care, custody, or control of any animal owned, possessed, leased, kept, or held by the petitioner, defendant, or a <span data-term-id=\"39257991\">minor child<\/span> in either household<\/li>\n<li>Ordering the defendant to stay away from animals awarded to the plaintiff<\/li>\n<li>Awarding the plaintiff a shared residence (unless the defendant owns or leases and pays for the premises and has no legal duty to support the plaintiff or <span data-term-id=\"39257991\">minor children<\/span> on the premises)<\/li>\n<li>Forbidding the defendant from withholding items of the plaintiff&#8217;s personal property specified by the court<\/li>\n<li>Awarding the plaintiff the possession and <span data-term-id=\"39257999\">exclusive use<\/span> of the household furniture, furnishings, or a specific automobile (unless the defendant owns such personal property and has no legal duty to support the plaintiff or <span data-term-id=\"39257991\">minor children<\/span>)<\/li>\n<li>Ordering the defendant to make automobile, insurance, health care, utilities, rent, or mortgage payments<\/li>\n<li>Awarding <span data-term-id=\"39257989\">temporary custody<\/span> of <span data-term-id=\"39257991\">minor children<\/span> to either party<\/li>\n<li>Establishing visitation rights with the parties&#8217; <span data-term-id=\"39257991\">minor children<\/span>, which may include orders denying visitation, requiring supervised visitation, and other conditions<\/li>\n<li>Ordering the defendant to pay financial support to the plaintiff or <span data-term-id=\"39257991\">minor children<\/span> (unless the defendant has no legal duty to support the plaintiff or <span data-term-id=\"39257991\">minor children<\/span>)<\/li>\n<li>Ordering the abuser to engage in a <span data-term-id=\"39258000\">batterer<\/span>&#8216;s intervention program or personal counseling<\/li>\n<li>Ordering the defendant to pay the plaintiff monetary compensation for losses suffered as a direct result of the abuse, which may include, but not be limited to, loss of earnings or support, medical and dental expenses, damage to property, out-of-pocket losses for injuries sustained, and moving and shelter expenses<\/li>\n<li>Ordering the defendant to pay reasonable attorney&#8217;s fees<\/li>\n<\/ul>\n<p>A <span data-term-id=\"39257971\">protective order<\/span> can contain all, some, or none of the provisions listed. A stalking order between people without a personal relationship won&#8217;t contain conditions regarding child custody. Under <span data-term-id=\"39257993\">federal law<\/span>, all <span data-term-id=\"39257973\">restraining orders<\/span> issued in <span data-term-id=\"39257972\">New Hampshire<\/span> <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\">are enforceable anywhere in the U.S.<\/a>, including territories and tribal reservations.<\/p>\n<h2><span data-term-id=\"39257972\">New Hampshire<\/span> <span data-term-id=\"39257971\">Protective Orders<\/span> &#8211; Getting an Order<\/h2>\n<p>Whether for stalking or <span data-term-id=\"39257970\">domestic violence<\/span>, petitioning for a <span data-term-id=\"39257971\">protective order<\/span> in <span data-term-id=\"39257972\">New Hampshire<\/span> follows the same procedure. There are three different durations available. If you&#8217;re in <span data-term-id=\"39257995\">immediate danger<\/span> of abuse and the courts are closed, you can <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-4.htm#:~:text=Upon%20a%20showing%20of%20an%20immediate%20and%20present%20danger%20of%20abuse%2C%20the%20court%20may%20enter%20temporary%20orders\" target=\"_blank\" rel=\"noopener\">find relief<\/a> through an <strong>emergency temporary <span data-term-id=\"39257985\">ex parte<\/span> <span data-term-id=\"39257971\">protective order<\/span><\/strong> <strong>(EPO)<\/strong>.<\/p>\n<p>An EPO is obtained through <span data-term-id=\"39257977\">law enforcement<\/span>. A <span data-term-id=\"39258006\">peace officer<\/span> responding to a crime can call a judge, or the victim can request one at a <span data-term-id=\"39257982\">police department<\/span>. If approved by the <span data-term-id=\"39257987\">circuit court<\/span> judge, the EPO is in <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-4.htm#:~:text=shall%20be%20effective%20until%20the%20close%20of%20the%20next%20regular%20court%20business%20day\" target=\"_blank\" rel=\"noopener\">effect until the end of the next court <span data-term-id=\"39257983\">business day<\/span><\/a>. This provides the victim with basic protection until they can file a petition.<\/p>\n<p>Victims (plaintiffs) can file in <a href=\"https:\/\/www.courts.nh.gov\/your-visit\/find-court#circuit\" target=\"_blank\" rel=\"noopener\">any county <span data-term-id=\"39257987\">circuit court<\/span><\/a> between 8 a.m. and 4 p.m. during a court <span data-term-id=\"39257983\">business day<\/span>. Forms are available online and at the court clerk&#8217;s office. Make sure you use the correct forms for your particular <span data-term-id=\"39257971\">protective order<\/span>:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.courts.nh.gov\/our-courts\/circuit-court\/district-division\/forms\/domestic-violence-forms\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39257980\">Domestic violence<\/span> <span data-term-id=\"39257971\">protective order<\/span> form packet<\/a><\/li>\n<li><a href=\"https:\/\/www.courts.nh.gov\/our-courts\/circuit-court\/district-division\/forms\/stalking\" target=\"_blank\" rel=\"noopener\">Stalking <span data-term-id=\"39257971\">protective order<\/span> form packet<\/a><\/li>\n<\/ul>\n<p>It&#8217;s possible to file via email with the assistance of a crisis center advocate. You can find one through the <span data-term-id=\"39257972\">New Hampshire<\/span> Coalition Against <span data-term-id=\"39257970\">Domestic Violence<\/span> by calling 866.644.3574 or using their <a href=\"https:\/\/www.nhcadsv.org\/member-programs.html\" target=\"_blank\" rel=\"noopener\">advocate locator<\/a>.<\/p>\n<p>Crisis center advocates can assist you in finding shelter, filling out petitions and <span data-term-id=\"39258009\">affidavits<\/span>, and accompanying you to the police station and court. <a href=\"https:\/\/www.courts.nh.gov\/sites\/g\/files\/ehbemt471\/files\/documents\/2023-05\/dv-stalking-checklist.pdf\" target=\"_blank\" rel=\"noopener\">Email petitions must be filed between 8 a.m. and 3 p.m.<\/a> on court <span data-term-id=\"39257983\">business days<\/span>.<\/p>\n<p>When filling out the forms, provide as many details about the abuse you&#8217;ve suffered. This isn&#8217;t a pleasant thing to do, but as the plaintiff, you must convince the court of the danger your abuser presents. You can file them in your county <span data-term-id=\"39257987\">circuit court<\/span>&#8216;s <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-2.htm#:~:text=The%20district%20division%20and%20the%20judicial%20branch%20family%20division%20of%20the%20circuit%20courts%20shall%20have%20concurrent%20jurisdiction%20over%20all%20proceedings%20under%20this%20chapter\" target=\"_blank\" rel=\"noopener\">district division or the judicial branch family division<\/a>. There&#8217;s no fee for filing for a <span data-term-id=\"39257971\">protective order<\/span>.<\/p>\n<p>The clerk takes the petition to a judge, who may have further questions for you. If the court agrees that the <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-5.htm#:~:text=A%20finding%20of%20abuse%20shall%20mean%20the%20defendant%20represents%20a%20credible%20threat%20to%20the%20safety%20of%20the%20plaintiff\" target=\"_blank\" rel=\"noopener\">defendant (abuser\/stalker) poses a present threat of abuse<\/a>, a <strong>temporary <span data-term-id=\"39257985\">ex parte<\/span> <span data-term-id=\"39257971\">protective order<\/span> (TPO)<\/strong> is issued. <span data-term-id=\"39257985\">Ex parte<\/span> means the court doesn&#8217;t speak with the defendant before issuing the order. If the court doesn&#8217;t grant a TPO, you can try for a permanent order at a <span data-term-id=\"39258012\">court hearing<\/span>.<\/p>\n<p>If a TPO is issued, <span data-term-id=\"39257977\">law enforcement<\/span> will serve a copy of the order to the defendant. The <span data-term-id=\"39257986\">temporary order<\/span> lasts either 30 days or until a full <span data-term-id=\"39258012\">court hearing<\/span>. If the defendant opposes the order, <a href=\"https:\/\/www.gencourt.state.nh.us\/rsa\/html\/xii\/173-b\/173-b-3.htm#:~:text=The%20court%20shall%20hold%20a%20hearing%20within%2030%20days%20of%20the%20filing%20of%20a%20petition%20under%20this%20section%20or%20within%2010%20days%20of%20service%20of%20process%20upon%20the%20defendant%2C%20whichever%20occurs%20later\" target=\"false\" rel=\"noopener\">they can request an expedited hearing or expect one within 10 days <\/a>of service. All provisions in the order are enforceable after the defendant is served.<\/p>\n<p>At the <span data-term-id=\"39257992\">final hearing<\/span>, both parties can call witnesses, present evidence, and give their side of the story. The burden of proof is with the plaintiff to show that the defendant is an ongoing danger to their well-being. If the court agrees, a <strong><span data-term-id=\"39258004\">final <\/span><span data-term-id=\"39257971\">protective order<\/span> (FPO) <\/strong>is issued.
