This is true even if the dispute concerns whether one neighbor can plant a tree on a shared property line. This is called encroachment and it&#8217;s considered a form of <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/trespass-to-land.html\">trespassing<\/a>.<\/p>\r\n<p>Under New Hampshire law, private landowners can enforce their property rights through the local courts or private agreements. <a href=\"https:\/\/nationalaglawcenter.org\/wp-content\/uploads\/assets\/fencelaw\/newhampshire.pdf\" target=\"_blank\" rel=\"noopener\">State law<\/a> also dictates that homeowners must share the responsibility for division fences, including the cost of maintaining the shared fence.<\/p>\r\n<p>If one neighbor refuses to contribute, the other neighbor can make the repairs and seek damages from their non-paying neighbor.<\/p>\r\n<h2>Using Boundary by Acquiescence To Enforce a Historic Boundary Line<\/h2>\r\n<p>In New Hampshire, boundary by acquiescence is a court-made rule recognizing long-standing markers that property owners have traditionally identified as their boundary lines, even when a survey places them elsewhere.<\/p>\r\n<p>For example, if two property owners think a row of trees marks their property line but later learn that the <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/property-boundaries.html\">boundary line<\/a> extends ten feet beyond those trees, the court may enforce the historic line used by both parties. Boundary by acquiescence requires that the property owners meet specific requirements.<\/p>\r\n<h2>Trees Along Property Lines<\/h2>\r\n<p>Is your neighbor&#8217;s paper birch tree making you mad by dropping big piles of leaves in your yard? Are the roots pushing up your fence? New Hampshire law allows you to <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/conflicts-involving-trees-and-neighbors.html\">prune a neighbor&#8217;s tree<\/a> at your own expense.<\/p>\r\n<p>You should consider several things before deciding to trim your neighbor&#8217;s <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/conflicts-involving-trees-and-neighbors.html\">tree branches<\/a>, including:<\/p>\r\n<ul>\r\n<li>If you seriously injure or kill the tree, you may be liable for damages equal to three to ten times the tree&#8217;s market value<\/li>\r\n<li>Landowners generally have the right to grow, maintain, or cut down their trees as they see fit<\/li>\r\n<li>A landowner who fails to maintain their tree is liable for injuries from the <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/appearance-maintenance-and-fence-restrictions.html\">lack of maintenance<\/a><\/li>\r\n<\/ul>\r\n<h2>Using Fence Viewers for Dispute Resolution<\/h2>\r\n<p>Taking a neighbor to court is not the only option for resolving a property dispute.
