If the <span data-term-id=\"40847621\">simple assault<\/span> stems from a mutual fight, then the court categorizes it as a <span data-term-id=\"40847644\">petty <\/span><span data-term-id=\"40847629\">disorderly persons offense<\/span>. However, if an assault involves something more serious, such as an assault on a <span data-term-id=\"40847678\">police officer<\/span> or firefighter, or if a person commits assault with a vehicle, it constitutes <span data-term-id=\"40847617\">aggravated assault<\/span>.<\/p>\n<h3><strong><span data-term-id=\"40847617\">Aggravated Assault<\/span> <\/strong><\/h3>\n<p>The penalties for <span data-term-id=\"40847617\">aggravated assault<\/span> are much more severe than those for <span data-term-id=\"40847621\">simple assault<\/span>. In fact, <span data-term-id=\"40847621\">simple assault<\/span> is almost always a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\"><span data-term-id=\"40847666\">misdemeanor<\/span>,<\/a> whereas <span data-term-id=\"40847617\">aggravated assault<\/span> is a felony.<\/p>\n<p>There are three main differences between a <span data-term-id=\"40847621\">simple <\/span><span data-term-id=\"40847631\">assault<\/span><span data-term-id=\"40847631\"> charge<\/span> and an <span data-term-id=\"40847649\">aggravated <\/span><span data-term-id=\"40847631\">assault<\/span><span data-term-id=\"40847649\"> charge<\/span>:<\/p>\n<ul>\n<li>\n<p>In a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/whats-the-difference-between-assault-and-battery.html\"><span data-term-id=\"40847621\">simple assault<\/span><\/a> case, the defendant causes (or attempts to cause) minor injuries. This isn&#8217;t necessarily the case in a <span data-term-id=\"40847621\">simple assault<\/span> case.<\/p>\n<\/li>\n<\/ul>\n<p>An <span data-term-id=\"40847617\">aggravated assault<\/span> is a <span data-term-id=\"40847621\">simple assault<\/span> with <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/factors-considered-in-determining-sentences.html\">aggravating factors<\/a>, such as those described above.<\/p>\n<h3><strong>Degrees of <span data-term-id=\"40847617\">Aggravated Assault<\/span><\/strong><\/h3>\n<p>When it comes to <span data-term-id=\"40847621\">simple assault<\/span>, there are no degrees. This isn&#8217;t the case with <span data-term-id=\"40847617\">aggravated assault<\/span>. <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-12-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40847645\">N.J.S.A<\/span>. 2C: 12-1<\/a> breaks this crime into second, third, and <span data-term-id=\"40847641\">fourth-degree<\/span> <span data-term-id=\"40847617\">aggravated assault<\/span>, with each offense having distinct penalties.<\/p>\n<p>The three degrees of <span data-term-id=\"40847617\">aggravated assault<\/span> break down as follows:<\/p>\n<ul>\n<li>\n<p><strong>Second-degree <span data-term-id=\"40847617\">aggravated assault<\/span>:<\/strong> Causing serious <span data-term-id=\"40847637\">bodily harm<\/span> with the intentional or reckless <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/may-i-shoot-an-intruder.html\"><span data-term-id=\"40847692\">use of a <\/span><span data-term-id=\"40847619\">deadly weapon<\/span><\/a> or using a <span data-term-id=\"40847619\">deadly weapon<\/span> in a way that could cause <span data-term-id=\"40847700\">serious injury<\/span> or <span data-term-id=\"40847680\">risk of death<\/span>.<\/p>\n<\/li>\n<li>\n<p><strong><span data-term-id=\"40847653\">Third-degree<\/span> assault:<\/strong> Causing significant <span data-term-id=\"40847637\">bodily harm<\/span> or using a weapon in a less severe manner than in second-degree <span data-term-id=\"40847617\">aggravated assault<\/span>.<\/p>\n<\/li>\n<li>\n<p><strong><span data-term-id=\"40847641\">Fourth-degree<\/span> assault:<\/strong> Recklessly causing bodily injury with a weapon or pointing a firearm without causing serious harm.<\/p>\n<\/li>\n<\/ul>\n<p>The penalties for <span data-term-id=\"40847617\">aggravated assault<\/span> are quite severe. Not only will a conviction result in a lengthy prison sentence, but you will also have to pay hefty fines.<\/p>\n<h2><strong>How Does <span data-term-id=\"40847615\">New Jersey<\/span> Treat <span data-term-id=\"40847698\">Battery Cases<\/span>?<\/strong><\/h2>\n<p><span data-term-id=\"40847615\">New Jersey<\/span> doesn&#8217;t have a separate crime called &#8220;battery.&#8221; Instead, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/what-is-the-crime-of-battery.html\" target=\"_blank\" rel=\"noopener\">conduct that other states call battery<\/a> is prosecuted under <span data-term-id=\"40847615\">New Jersey<\/span>&#8216;s assault statutes. This means if you cause <span data-term-id=\"40847651\">physical harm<\/span> or offensive contact to another person, you&#8217;ll face <span data-term-id=\"40847631\">assault charges<\/span> in <span data-term-id=\"40847615\">New Jersey<\/span>.<\/p>\n<p>Whether you&#8217;re charged with <span data-term-id=\"40847621\">simple assault<\/span> or <span data-term-id=\"40847617\">aggravated assault<\/span> depends on the severity of the contact. For example, if you punch someone at a bar and cause minor injuries, you&#8217;ll face <span data-term-id=\"40847621\">simple <\/span><span data-term-id=\"40847631\">assault<\/span><span data-term-id=\"40847631\"> charges<\/span>. Both scenarios involve what other states might call &#8220;battery,&#8221; but <span data-term-id=\"40847615\">New Jersey<\/span> treats them as different degrees of assault.<\/p>\n<p>While <span data-term-id=\"40847627\">assault and battery<\/span> are conceptually different crimes (assault typically involves threats while battery involves actual <span data-term-id=\"40847643\">physical contact<\/span>), <span data-term-id=\"40847642\">New Jersey<\/span><span data-term-id=\"40847642\"> law<\/span> treats harmful <span data-term-id=\"40847643\">physical contact<\/span> as assault. In practical terms, this doesn&#8217;t change what conduct is illegal. In a civil <span data-term-id=\"40847698\">battery case<\/span>, the person you harmed can sue you for monetary damages to compensate them for their injuries, medical bills, pain and suffering, and other losses.<\/p>\n<p>This means you could face both criminal <span data-term-id=\"40847631\">assault charges<\/span> from the prosecutor and a civil battery lawsuit from the victim for the same act. For example, if you punch someone and break their nose, you might be criminally charged with <span data-term-id=\"40847621\">simple assault<\/span> while also being sued for battery in civil court. It depends on the facts of your case and your previous <span data-term-id=\"40847647\">criminal record<\/span>.<\/p>\n<p>In addition to the above penalties, a person guilty of these <span data-term-id=\"40847684\">criminal offenses<\/span> will have a negative mark on their <a href=\"https:\/\/www.njcourts.gov\/courts\/superior-court-clerks-office\/copies-court-records\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40847647\">criminal record<\/span><\/a>. Even a record of <span data-term-id=\"40847621\">simple assault<\/span> can impact your ability to get a professional degree, license, or job.<\/p>\n<h2><strong>Possible Defenses To <span data-term-id=\"40847627\">Assault and Battery<\/span><\/strong><\/h2>\n<p>If you want to avoid <span data-term-id=\"40847655\">jail time<\/span> and hefty fines, you&#8217;ll have to put on a strong defense at trial. Thankfully, your <span data-term-id=\"40847639\">criminal defense<\/span><span data-term-id=\"40847639\"> attorney<\/span> will be able to negotiate a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/plea-bargain.html\">plea bargain<\/a>, and your case won&#8217;t go to trial. Either way, you&#8217;ll have to present a defense to the <span data-term-id=\"40847668\">criminal charges<\/span>.<\/p>\n<p>The following are common <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/assault-and-battery-defenses.html\">defenses to <span data-term-id=\"40847627\">assault and battery<\/span><\/a>:<\/p>\n<ul>\n<li>\n<p><strong><span data-term-id=\"40847633\">Self-defense<\/span>:<\/strong> If you can prove that, at the time of the contact, you were facing a threat of unlawful force or harm, this defense may work. You will have to demonstrate that you perceived a threat (from the alleged victim) and had a reasonable basis to fear imminent harm.<\/p>\n<\/li>\n<li>\n<p><strong>Defenses of others:<\/strong> In <span data-term-id=\"40847615\">New Jersey<\/span>, you can raise the <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/self-defense-defense-of-others-and-intentional-torts.html\">defense of others<\/a> in an <span data-term-id=\"40847627\">assault and <\/span><span data-term-id=\"40847698\">battery<\/span><span data-term-id=\"40847698\"> case<\/span>. You must prove the same thing as in a regular <span data-term-id=\"40847633\">self-defense<\/span> case, only you must show that you have an honest and reasonable fear that the third party was in danger of imminent harm.<\/p>\n<\/li>\n<li>\n<p><strong>Defense of property:<\/strong> Surprisingly, <span data-term-id=\"40847642\">New Jersey<\/span><span data-term-id=\"40847642\"> law<\/span> recognizes the <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defense-of-property-and-intentional-torts.html\">defense of property<\/a> in these cases. However, you can only use the force necessary to defend your property. You must also make an attempt to stop the perpetrator before resorting to the <span data-term-id=\"40847660\">use of force<\/span>.<\/p>\n<\/li>\n<li>\n<p><strong>Consent:<\/strong> This defense rarely applies in <span data-term-id=\"40847627\">assault and <\/span><span data-term-id=\"40847698\">battery<\/span><span data-term-id=\"40847698\"> cases<\/span>.
