For <span data-term-id=\"39152081\">victims of <\/span><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\"><span data-term-id=\"39152081\">domestic violence<\/span><\/a>, it&#8217;s often the opposite. The abuser has a personal relationship with the victim. They use abuse and fear to control the victim&#8217;s life. <span data-term-id=\"39152079\">New Jersey<\/span> has laws in place to punish abusers and offer relief to their victims.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-17\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39152085\">Prevention of Domestic Violence Act<\/span> (PDVA) of 1991<\/a> details penalties and protections for domestic violence in <span data-term-id=\"39152079\">New Jersey<\/span>. Understanding the laws involved is complex. This article will define domestic violence in the <span data-term-id=\"39152100\">state of <\/span><span data-term-id=\"39152079\">New Jersey<\/span>, explain how <span data-term-id=\"39152080\">restraining orders<\/span> work, and help you navigate the court system. Read on to learn more about <span data-term-id=\"39152093\">domestic violence laws<\/span> in <span data-term-id=\"39152079\">New Jersey<\/span>.<\/p>\n<h2>The Basics of <span data-term-id=\"39152125\">New Jersey<\/span> <span data-term-id=\"39152093\">Domestic Violence<\/span><span data-term-id=\"39152093\"> Laws<\/span><\/h2>\n<p>Not every abusive crime is domestic violence, nor is every offense between spouses domestic violence either. For domestic violence classification in <span data-term-id=\"39152079\">New Jersey<\/span>, a <a href=\"https:\/\/www.njcourts.gov\/sites\/default\/files\/forms\/12968_what_is_dv.pdf\" target=\"_blank\" rel=\"noopener\">certain criminal act must occur between people sharing a qualifying relationship<\/a>. Let&#8217;s take a look at each aspect for a better understanding of what domestic violence is.<\/p>\n<h3>Domestic Violence in <span data-term-id=\"39152079\">New Jersey<\/span>: Criminal Acts<\/h3>\n<p><span data-term-id=\"39152102\">New Jersey<\/span><span data-term-id=\"39152102\"> law<\/span> offers a definitive list of crimes and categories eligible for domestic violence classification. <span data-term-id=\"39152113\">Domestic abuse<\/span> is about <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">power and control<\/a>. Abusers seek to dominate a victim&#8217;s life through threats, fear, coercion, and violence.<\/p>\n<p>While <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\">physical abuse<\/a> is often the image many think of at the mention of domestic violence, it&#8217;s <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">far from the only type<\/a>. A crime that doesn&#8217;t qualify is still a crime and is subject to prosecution. However, it won&#8217;t receive the protections and penalties associated with domestic violence.<\/p>\n<h3>Domestic Violence in <span data-term-id=\"39152079\">New Jersey<\/span>: Relationships<\/h3>\n<p>No matter what offense is committed, domestic violence can&#8217;t take place between two strangers. <a href=\"https:\/\/womanspace.org\/education-training\/defining-abuse\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39152113\">Domestic abuse<\/span><\/a> requires a personal relationship between the abuser and the victim. As a result, the betrayal of trust can destroy lives and tear families apart.<\/p>\n<p>While family members are often involved, domestic violence crimes don&#8217;t require blood relations or marriage between the participants. The eligible people and relationships in <span data-term-id=\"39152079\">New Jersey<\/span> are:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39152092\">Former spouses<\/span><\/li>\n<li>Current <span data-term-id=\"39152094\">household members<\/span><\/li>\n<li>Former <span data-term-id=\"39152094\">household members<\/span><\/li>\n<li>People with a child in common<\/li>\n<li>People who have a pregnancy in common<\/li>\n<li>People who are in a <span data-term-id=\"39152120\">dating relationship<\/span> together<\/li>\n<li>People who were in a <span data-term-id=\"39152120\">dating relationship<\/span> together<\/li>\n<\/ul>\n<p>If adults over 18 years of age or <a href=\"https:\/\/www.findlaw.com\/family\/emancipation-of-minors.html\"><span data-term-id=\"39152107\">emancipated minors<\/span><\/a> have a qualifying abusive crime occur between them, it&#8217;s domestic violence. Crimes classified as domestic violence often carry enhanced penalties for offenders and offer specialized protections for victims.<\/p>\n<h2><span data-term-id=\"39152080\">Restraining Orders<\/span> and <span data-term-id=\"39152125\">New Jersey<\/span> <span data-term-id=\"39152093\">Domestic Violence<\/span><span data-term-id=\"39152093\"> Laws<\/span><\/h2>\n<p>If you&#8217;ve suffered domestic violence or feel as if you&#8217;re in imminent danger, call 911. <span data-term-id=\"39152102\">New Jersey<\/span> <span data-term-id=\"39152096\">law<\/span><span data-term-id=\"39152096\"> enforcement<\/span> receives special training for <span data-term-id=\"39152113\">domestic abuse<\/span> calls. If there&#8217;s probable cause, they can arrest the abuser. They&#8217;ll inform you of your rights, including the <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-23\/\" target=\"_blank\" rel=\"noopener\">opportunity to get a <span data-term-id=\"39152080\">restraining order<\/span><\/a>.<\/p>\n<p><span data-term-id=\"39152125\">New Jersey<\/span> <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-28\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39152118\">domestic violence<\/span> <span data-term-id=\"39152080\">restraining orders<\/span><\/a> can prove an effective means of protection. They aren&#8217;t foolproof, as your abuser can choose to ignore the court order. Doing so exposes them to penalties that increase in severity.<\/p>\n<p>If the courts are closed, <span data-term-id=\"39152096\">law enforcement<\/span> can help you (plaintiff) get a <span data-term-id=\"39152082\">temporary <\/span><span data-term-id=\"39152080\">restraining order<\/span> at the <span data-term-id=\"39152130\">police station<\/span>. You can file in an <a href=\"https:\/\/njj-aocmedia-prod-general-purpose.s3.amazonaws.com\/rosters\/municipal\/municipal-court-listing.pdf\" target=\"_blank\" rel=\"noopener\">open <span data-term-id=\"39152103\">municipal court<\/span><\/a> as well. If the courts are open, you&#8217;ll file at the <a href=\"https:\/\/www.njcourts.gov\/public\/directories\/court-services\/family-offices-dir\" target=\"_blank\" rel=\"noopener\">Family Part of the Chancery Division of <span data-term-id=\"39152106\">Superior Court<\/span><\/a>.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-28\/\" target=\"_blank\" rel=\"noopener\">You can file<\/a> in the county you live in, the county your abuser lives in, the county you&#8217;ve fled to, or the county where the abuse occurred. For example, if you live in <span data-term-id=\"39152128\">Bergen County<\/span> but you&#8217;re hiding in <span data-term-id=\"39152131\">Essex County<\/span>, you could file at either county&#8217;s courthouse. If the offense happened in <span data-term-id=\"39152116\">Morris County<\/span>, you could file there as well.<\/p>\n<p>You&#8217;ll speak with the judge who received your petition. If they agree that you suffered abuse or that the threat of abuse is ongoing, a <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-28\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39152082\">temporary <\/span><span data-term-id=\"39152080\">restraining order<\/span> (<span data-term-id=\"39152098\">TRO<\/span>)<\/a> is issued. This is often done ex parte, which means the court won&#8217;t speak to your abuser before issuing the <span data-term-id=\"39152098\">TRO<\/span>.<\/p>\n<p><span data-term-id=\"39152098\">TROs<\/span> last up to 10 days or until your case hearing. All <span data-term-id=\"39152098\">TROs<\/span> in <span data-term-id=\"39152079\">New Jersey<\/span> contain provisions tailored to the specifics of each case. Most tell the defendant (abuser) what they can and cannot do. While most orders are somewhat different, some <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-28\/\" target=\"_blank\" rel=\"noopener\">conditions are common inclusions<\/a>:<\/p>\n<ul>\n<li>The defendant must obey a no-contact order<\/li>\n<li>The defendant can&#8217;t return to a shared dwelling unless to retrieve personal items at a scheduled time and accompanied by <span data-term-id=\"39152096\">law enforcement<\/span><\/li>\n<li>Award temporary possession of a shared dwelling to the plaintiff<\/li>\n<li>The defendant must surrender all firearms or certain other weapons<\/li>\n<li>The police can search court-ordered locations for firearms<\/li>\n<li>Award possession of any shared animals to the plaintiff<\/li>\n<li>Award temporary <span data-term-id=\"39152095\">child custody<\/span><\/li>\n<\/ul>\n<p>A <span data-term-id=\"39152098\">TRO<\/span> may contain all, some, or none of the above provisions. The court can add a condition for anything it deems necessary. The <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-28\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39152098\">TRO<\/span> is served to the defendant<\/a> by <span data-term-id=\"39152096\">law enforcement<\/span>. Your <span data-term-id=\"39152084\">final <\/span><span data-term-id=\"39152080\">restraining order<\/span> (FRO) hearing is scheduled within 10 days. If the defendant opposes the order, you&#8217;ll both present your cases, offer evidence, and call witnesses at the hearing. Appearing remotely is possible.<\/p>\n<p>If you prove the threat of <span data-term-id=\"39152113\">domestic abuse<\/span> is ongoing, the court will issue an FRO. The FRO can keep <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-29-1\/\" target=\"_blank\" rel=\"noopener\">provisions from the <span data-term-id=\"39152098\">TRO<\/span> and add others<\/a>, which include:<\/p>\n<ul>\n<li>The defendant cannot commit domestic violence against you<\/li>\n<li>The defendant cannot harass, harm, or stalk anyone named in the FRO<\/li>\n<li>The defendant must stay away from all places named in the FRO<\/li>\n<li>The defendant must pay spousal support for rent or a mortgage<\/li>\n<li>The defendant must not contact the plaintiff<\/li>\n<li>The defendant must pay for reasonable losses resulting from the abuse (the plaintiff can also <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/filing-a-domestic-violence-lawsuit.html\" target=\"false\">file a civil suit to recover damages<\/a>)<\/li>\n<li>Making a firearm ban last the duration of the order or two years, whichever is longer<\/li>\n<li>Ordering the defendant to attend domestic violence counseling<\/li>\n<li>Ordering the defendant to undergo a psychiatric evaluation<\/li>\n<li>Granting sole possession of a shared dwelling to the plaintiff or ordering the defendant to pay the plaintiff&#8217;s rent in a different location<\/li>\n<li>Determining temporary custody and visitation restrictions<\/li>\n<li>Awarding temporary possession of personal property to either person<\/li>\n<li>Ordering the defendant to pay temporary <span data-term-id=\"39152110\">child support<\/span><\/li>\n<\/ul>\n<p>Most FROs are issued <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-28-1\/\" target=\"_blank\" rel=\"noopener\">without an end date<\/a>. They stay in effect until either the plaintiff requests termination or a successful petition by the defendant. Any <span data-term-id=\"39152080\">restraining order<\/span> issued in <span data-term-id=\"39152079\">New Jersey<\/span> is, <a href=\"https:\/\/www.hud.gov\/vawa#faq\" target=\"_blank\" rel=\"noopener\">under federal law<\/a>, enforceable anywhere on American soil.<\/p>\n<h2>Penalties and <span data-term-id=\"39152125\">New Jersey<\/span> <span data-term-id=\"39152093\">Domestic Violence<\/span><span data-term-id=\"39152093\"> Laws<\/span><\/h2>\n<p>Having a crime classified as domestic violence is important for a couple of reasons. We&#8217;ve seen the protections and benefits available through <span data-term-id=\"39152080\">restraining orders<\/span>. Let&#8217;s take a look at the other side and discuss the <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-30\/\" target=\"_blank\" rel=\"noopener\">penalties associated with domestic violence acts and violations of <span data-term-id=\"39152098\">TROs<\/span> and FROs<\/a>.<\/p>\n<p>Most crimes associated with domestic violence have severe penalties to start with. A few carry the ability to enhance their punishment for repeat offenders:<\/p>\n<ul>\n<li><span data-term-id=\"39152115\">Aggravated assault<\/span><\/li>\n<li>Assault by auto or vessel<\/li>\n<li>Criminal assault<\/li>\n<li><span data-term-id=\"39152088\">Criminal restraint<\/span><\/li>\n<li><span data-term-id=\"39152086\">Criminal sexual contact<\/span><\/li>\n<li>Homicide<\/li>\n<li>Kidnapping<\/li>\n<\/ul>\n<p>These offenses have their incarceration <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-43-6-8\/\" target=\"_blank\" rel=\"noopener\">set to at least half of the maximum term available<\/a> for each level of crime. Crimes of the fourth degree require serving the full 18-month maximum sentence. Crimes of the third degree impose a minimum of 42 months out of a possible 60 months. Fines are also assessed, starting at $10,000.<\/p>\n<p>For effective <span data-term-id=\"39152098\">TROs<\/span> and FROs, the victim must call <span data-term-id=\"39152096\">law enforcement<\/span> for any violation by the abuser. Violators are <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-31\/\" target=\"_blank\" rel=\"noopener\">subject to immediate arrest<\/a> for good cause. Victims may have to file a complaint in Family Court to enforce the punishment.<\/p>\n<p>First-time violators are <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-29\/\" target=\"_blank\" rel=\"noopener\">charged with contempt<\/a> and guilty of a crime of the fourth degree. The penalties are up to 180 days in jail and a fine of up to $10,000. Subsequent violations carry the same punishments, with a minimum 30-day jail term. This is in addition to the penalties for the offense(s) committed during the violation.<\/p>\n<p>There&#8217;s no shame in finding <span data-term-id=\"39152080\">restraining orders<\/span> tricky to understand. Domestic violence advocates are available at <a href=\"https:\/\/womanspace.org\/\" target=\"_blank\" rel=\"noopener\">both the local<\/a> and <a href=\"https:\/\/www.thehotline.org\/\" target=\"_blank\" rel=\"noopener\">national levels<\/a>. They can help you devise a <a href=\"https:\/\/www.thehotline.org\/what-is-a-safety-plan\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39152123\">safety plan<\/span><\/a>, <a href=\"https:\/\/www.nj.gov\/dcf\/women\/domestic\/\" target=\"_blank\" rel=\"noopener\">find a shelter<\/a>, and <a href=\"https:\/\/partnersnj.org\/\" target=\"_blank\" rel=\"noopener\">get legal aid<\/a>.<\/p>\n<p>The fear of an abuser finding them again can cause a victim to stay in a toxic relationship. <span data-term-id=\"39152079\">New Jersey<\/span>&#8216;s <a href=\"https:\/\/www.nj.gov\/dcf\/women\/acp\/\" target=\"_blank\" rel=\"noopener\">Address Confidentiality Program (ACP)<\/a> helps by giving the victim a second legal address.
