Regardless of the motive or specific facts of the case, a kidnapping conviction will involve a lengthy prison sentence and, in most cases, significant fines.<\/p>\n<p><span data-term-id=\"40972000\">New Jersey<\/span><span data-term-id=\"40972000\"> law<\/span> classifies the crime of kidnapping as a crime of the <span data-term-id=\"40971984\">first degree<\/span>. If, however, the defendant releases the victim unharmed before the arrest, then it may be a\u00a0<span data-term-id=\"40971980\">second-degree<\/span>\u00a0offense. <span data-term-id=\"40971974\">New Jersey<\/span>\u2019s <span data-term-id=\"40972039\">criminal laws<\/span> also provide for enhanced penalties when certain aggravating factors are present.<\/p>\n<p>This article examines and explains <span data-term-id=\"40971974\">New Jersey<\/span>\u2019s <span data-term-id=\"40972012\">kidnapping laws<\/span>, including the penalties and defenses to this crime. Kidnapping may also involve an individual holding another person for ransom, reward, or as a shield or hostage.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-13-1.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40971974\">New Jersey<\/span> Revised Statutes<\/a> make it illegal to confine another individual for any of the following reasons:<\/p>\n<ul>\n<li>To facilitate the commission of a crime<\/li>\n<li>To terrorize the victim<\/li>\n<li>To inflict bodily injury on the victim or another<\/li>\n<li>To interfere with the performance of a governmental or political function; or<\/li>\n<li>To permanently deprive a parent, guardian, or other <span data-term-id=\"40972016\">lawful custodian of custody of the victim<\/span><\/li>\n<\/ul>\n<p>Committing any of these offenses will earn a <span data-term-id=\"40971982\">kidnapping charge<\/span> as either a first- or <span data-term-id=\"40971998\">second-degree<\/span><span data-term-id=\"40971998\"> crime<\/span>.<\/p>\n<h2>What Does the State Have To Prove To Convict You of Kidnapping in <span data-term-id=\"40971974\">New Jersey<\/span>?<\/h2>\n<p>It is not enough to prove that someone removed another person from one location and transported them to another location. If the prosecutor expects to convict a defendant of <span data-term-id=\"40971984\">first-degree<\/span> or <a href=\"https:\/\/pub.njleg.gov\/bills\/9899\/PL99\/190_.PDF\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40971980\">second-degree<\/span> kidnapping<\/a>, they must prove each element of the crime.<\/p>\n<p>To secure a kidnapping conviction, the state must prove beyond a reasonable doubt that the defendant unlawfully removed or confined another person using force, threat, or deception. It must also show that the defendant did so with the intent to hold the victim for ransom, terrorize or cause bodily harm to the victim, interfere with a governmental or political function, or permanently deprive the victim\u2019s parents (or guardian) of <a href=\"https:\/\/www.findlaw.com\/state\/new-jersey-law\/new-jersey-child-custody-laws.html\">custody<\/a>.<\/p>\n<p>The state must also prove substantiality. This means it must demonstrate that the perpetrator moved the victim a <span data-term-id=\"40972047\">substantial distance<\/span> from their initial location, held them for a <span data-term-id=\"40972015\">substantial period<\/span>, or created a <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-11-1\/\" target=\"_blank\" rel=\"noopener\">substantial risk of harm<\/a>.<\/p>\n<h2><span data-term-id=\"40971996\">Parental Kidnapping<\/span><\/h2>\n<p>While some kidnappings involve complete strangers, many cases involve one parent removing their child from the other parent. This can occur when a non-custodial parent in the middle of a <span data-term-id=\"40972008\">custody dispute<\/span> disagrees with the <span data-term-id=\"40972006\">family law<\/span> judge\u2019s <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/custody-overview.html\"><span data-term-id=\"40972002\">child <\/span><span data-term-id=\"40972053\">custody<\/span><span data-term-id=\"40972053\"> order<\/span><\/a>. They may believe the custodial parent is unfit and decide to take their child to what they consider a <span data-term-id=\"40972014\">safe place<\/span>.<\/p>\n<p>This scenario certainly meets the elements of kidnapping. Criminal courts in <span data-term-id=\"40971974\">New Jersey<\/span> often treat these cases a bit differently than kidnappings involving strangers. A parent is guilty of <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/what-remedies-are-available-if-a-parent-abducts-a-child.html#:~:text=It%20can%20be%20a%20misdemeanor,orders%20are%20enforced%20across%20states.\"><span data-term-id=\"40971996\">parental kidnapping<\/span><\/a> (or <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-13-4\/\" target=\"_blank\" rel=\"noopener\">Interference with Custody<\/a>) when they conceal one of their children to deprive the other parent of custody or <a href=\"https:\/\/www.findlaw.com\/family\/paternity\/parenting-time-interference.html\"><span data-term-id=\"40972026\">parenting time<\/span><\/a>, or take\/conceal a child after receiving custody papers (but before the judge issues a <span data-term-id=\"40972053\">custody order<\/span>).<\/p>\n<p>If the parent takes or conceals their child with the intent to permanently deprive the other parent of custody or <span data-term-id=\"40972026\">parenting time<\/span>, they are guilty of felony kidnapping. They may violate the UCCJEA (<a href=\"https:\/\/www.ojp.gov\/pdffiles1\/ojjdp\/189181.pdf\" target=\"_blank\" rel=\"noopener\">Uniform <span data-term-id=\"40972002\">Child Custody<\/span> Jurisdiction and Enforcement Act<\/a>) as well if they take the child across state lines. A person guilty of <span data-term-id=\"40971996\">parental kidnapping<\/span> not only faces the standard penalties for kidnapping, but they also face a loss of <span data-term-id=\"40972026\">parenting time<\/span> or <a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability.html\"><span data-term-id=\"40972065\">parental rights<\/span><\/a>.<\/p>\n<h2>Penalties for Kidnapping in <span data-term-id=\"40971974\">New Jersey<\/span><\/h2>\n<p>The penalties for kidnapping in <span data-term-id=\"40971974\">New Jersey<\/span> are severe for both first- and <span data-term-id=\"40971980\">second-degree<\/span> kidnapping. If you\u2019re convicted of either of these serious crimes, you will face a lengthy <span data-term-id=\"40972023\">term of imprisonment<\/span> and hefty fines.<\/p>\n<p>The specific penalties for first and <span data-term-id=\"40971980\">second-degree<\/span> kidnapping in <span data-term-id=\"40971974\">New Jersey<\/span> are as follows:<\/p>\n<h3><strong><span data-term-id=\"40971984\">First-Degree<\/span> Kidnapping<\/strong>:<\/h3>\n<ul>\n<li>Prison term of 15 to 30 years<\/li>\n<li>If the victim is less than 16 <span data-term-id=\"40972028\">years of age<\/span> or there are other aggravating factors (such as <span data-term-id=\"40971990\">sexual assault<\/span>, <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-14-3\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40972018\">criminal sexual contact<\/span><\/a>, or selling the victim for financial gain), the penalty increases to 25 years to life without the possibility of <a href=\"https:\/\/codes.findlaw.com\/nj\/title-30-institutions-and-agencies\/nj-st-sect-30-4-123-51\/\" target=\"_blank\" rel=\"noopener\">parole<\/a><\/li>\n<li>Fines of up to $200,000<\/li>\n<\/ul>\n<h3><strong><span data-term-id=\"40971980\">Second-Degree<\/span> Kidnapping<\/strong>:<\/h3>\n<ul>\n<li>Between five and 10 years in prison<\/li>\n<li>Fines of a varying amount<\/li>\n<\/ul>\n<p>If the perpetrator commits a murder during the kidnapping, the state can charge them with <a href=\"https:\/\/www.findlaw.com\/state\/new-jersey-law\/new-jerseys-first-degree-murder-law.html\"><span data-term-id=\"40971984\">first-degree<\/span> murder<\/a> under the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-the-felony-murder-rule\/\">felony murder rule<\/a>.<\/p>\n<h2>Possible <span data-term-id=\"40972045\">Kidnapping Defenses<\/span><\/h2>\n<p>If you\u2019re facing <span data-term-id=\"40971982\">kidnapping charges<\/span>, your <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/new-jersey\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40971994\">criminal defense attorney<\/span><\/a> will craft a strong defense to help you avoid a conviction.<\/p>\n<p>The State of <span data-term-id=\"40971974\">New Jersey<\/span> recognizes the following <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-an-affirmative-defense\/\"><span data-term-id=\"40972019\">affirmative defenses<\/span><\/a> to the crime of kidnapping:<\/p>\n<ul>\n<li>Consent of the victim (or their parent\/guardian if the victim is under 16)<\/li>\n<li>The defendant reasonably believed that their action was necessary to prevent <span data-term-id=\"40972022\">imminent danger<\/span> and notified law enforcement, the <a href=\"https:\/\/www.findlaw.com\/state\/new-jersey-law\/new-jersey-district-attorneys.html\"><span data-term-id=\"40972021\">county prosecutor<\/span><\/a>, or a <span data-term-id=\"40972049\">state agency<\/span> within 24 hours<\/li>\n<li>A parent (with lawful custody) takes a child under the age of 14, where the child goes willingly and the defendant has no intent to commit a crime<\/li>\n<li>Lack of consent<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-2-9\/\" target=\"_blank\" rel=\"noopener\">Duress<\/a> or coercion<\/li>\n<li>Mistaken identity<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arrest.html\">Unlawful arrest<\/a><\/li>\n<\/ul>\n<p>This is not an exhaustive list. Other defenses may arise, depending on the specifics of your case.<\/p>\n<h2>Crimes in <span data-term-id=\"40971974\">New Jersey<\/span> Related to Kidnapping<\/h2>\n<p>The state of <span data-term-id=\"40971974\">New Jersey<\/span> recognizes other crimes related to kidnapping. These crimes are not as serious as kidnapping, but still carry severe penalties. <span data-term-id=\"40972000\">New Jersey<\/span><span data-term-id=\"40972000\"> law<\/span> recognizes two related crimes: <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/false-imprisonment.html\">false imprisonment<\/a> and <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-43-6-8\/\" target=\"_blank\" rel=\"noopener\">criminal restraint<\/a>. Both crimes are typically felonies, with criminal restraint being a <span data-term-id=\"40972051\">third-degree crime<\/span>.<\/p>\n<p>Both crimes are examined in more detail below.<\/p>\n<h3>False Imprisonment<\/h3>\n<p>False imprisonment can be a <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries.html\">tort<\/a> (civil offense) or a crime. Our focus here will be on criminal false imprisonment.<\/p>\n<p>False imprisonment is similar to kidnapping, but not exactly the same. The perpetrator confines the victim but does not move them to a substantially different location. Like a defendant in a kidnapping case, a defendant in a <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-44-6-3\" target=\"_blank\" rel=\"noopener\">false imprisonment case<\/a> must have a malicious intent when they confine the victim.<\/p>\n<p>The penalties for this crime in <span data-term-id=\"40971974\">New Jersey<\/span> depend on the facts of the case. If no other crime is involved, the state will usually charge the person with a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/disorderly-conduct.html\">disorderly persons offense<\/a>, which is a misdemeanor. If the defendant intended to harm the victim or commit another crime, they will face third-degree felony charges.<\/p>\n<p>The penalty for third-degree false imprisonment includes a prison sentence of up to five years and fines of up to $15,000. <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\">Misdemeanor<\/a> false imprisonment carries a maximum of six months in jail and fines.<\/p>\n<h3>Criminal Restraint<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-43-6-8\/\" target=\"_blank\" rel=\"noopener\">Criminal restraint<\/a> is also similar to kidnapping. The elements of this offense are almost identical to those of kidnapping, but have slight differences.<\/p>\n<p>To prove someone guilty of criminal restraint, the prosecutor must demonstrate that the defendant knowingly restrained the victim using force, threats, or deception while exposing the victim to grave bodily injury, such as death or disfigurement. Like false imprisonment, criminal restraint carries a prison term of up to five years and a fine of up to $15,000.<\/p>\n<h2><span data-term-id=\"40972000\">New Jersey<\/span><span data-term-id=\"40972000\"> Law<\/span> and Special Protections for Victims of <span data-term-id=\"40971986\">Domestic Violence<\/span><\/h2>\n<p>One way that abusers maintain control over their partners is by threatening to kidnap their children. With this in mind, and to protect victims of <span data-term-id=\"40971986\">domestic violence<\/span>, <span data-term-id=\"40971974\">New Jersey<\/span> lawmakers passed the <a href=\"https:\/\/codes.findlaw.com\/nj\/title-2c-the-new-jersey-code-of-criminal-justice\/nj-st-sect-2c-25-19\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40971974\">New Jersey<\/span> <span data-term-id=\"40971986\">Domestic Violence<\/span> Act<\/a>.<\/p>\n<p>This law protects victims of <span data-term-id=\"40971986\">domestic violence<\/span> from such behaviors as stalking, <span data-term-id=\"40971990\">sexual assault<\/span>, and kidnapping.
