These laws also provide for early intervention strategies and special education services to support students with disabilities.<\/p>\r\n<h2><b>New Mexico Compulsory School Attendance Laws<\/b><\/h2>\r\n<p>New Mexico statutes, specifically codified in NMSA 1978, set forth the compulsory school attendance law. This law mandates that all school-age persons must attend a public, private, home, or state institution school program. They must attend school throughout the school year until they graduate from high school or reach 18 years of age.<\/p>\r\n<p>In New Mexico, the public education department works with the local school districts to oversee school attendance. <a href=\"https:\/\/safesupportivelearning.ed.gov\/discipline-compendium?state=New%20Mexico&amp;sub_category=Chronic%20Absenteeism%20and%20Truancy#:~:text=8.7.-,Definitions.,absences%20within%20a%20school%20year.\" target=\"_blank\" rel=\"noopener\"><u>They monitor habitual truancy<\/u><\/a><u>,<\/u> or having a number of unexcused absences in a school year. The local superintendent has the authority to enforce these laws.<\/p>\r\n<p>Intervention efforts can include referral to other educational programs or even legal action if necessary. The exceptions to attendance requirements at public schools include:<\/p>\r\n<ul>\r\n<li><p>Attending private school, home school, or a state institution that provides free education<\/p>\r\n<\/li>\r\n<li><p>Graduation from high school already<\/p>\r\n<\/li>\r\n<li><p>The student is at least 16 years old and gainfully employed or engaged in an alternative form of education sufficient for the person&#8217;s educational needs, and the parent or guardian consents<\/p>\r\n<\/li>\r\n<li><p>Consent of a parent or guardian if under eight years old<\/p>\r\n<\/li>\r\n<li><p>If unable to benefit from school because of learning disabilities or a mental, physical, or emotional condition (although <a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/edlite-FAPE504.html\" target=\"_blank\" rel=\"noopener\">Free Appropriate Public Education<\/a> (FAPE) for children with disabilities is required by federal law)<\/p>\r\n<\/li>\r\n<li><p>Exemptions for legitimate medical reasons<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Home School Provisions<\/p>\r\n<\/th>\r\n<td><p>You can choose to homeschool your child in the state of New Mexico. <a href=\"https:\/\/webnew.ped.state.nm.us\/bureaus\/options-parents-families\/home-schools\/\" target=\"_blank\" rel=\"noopener\">But there are legal requirements<\/a>. These requirements include providing written notice to the <a href=\"https:\/\/webnew.ped.state.nm.us\/\" target=\"_blank\" rel=\"noopener\">New Mexico Public Education Department<\/a> that you want to establish a homeschool. Your homeschooled child may be able to borrow books from the local public school and participate in extracurriculars and sports with the public school, depending on the local school board policy.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Penalties on Parents for Non-Compliance<\/p>\r\n<\/th>\r\n<td><p>A parent of a truant child, after being informed in writing of the problem by the school, who knowingly allows their student to violate the school attendance laws is guilty of a petty misdemeanor. <a href=\"https:\/\/www.nmlegis.gov\/sessions\/04%20Regular\/final\/HB0106.html\" target=\"_blank\" rel=\"noopener\">The penalty depends on the number of offenses:<\/a><\/p>\r\n<ul>\r\n<li><p>1st offense \u2013 A $25 to $100 fine or community service order<\/p>\r\n<\/li>\r\n<li><p>2nd and subsequent \u2013 Up to a $500 fine or up to six months in jail<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p>Penalties on Students for Non-Compliance<\/p>\r\n<\/th>\r\n<td><p>A truant child can have their driving privileges suspended by the <a href=\"https:\/\/seconddistrict.nmcourts.gov\/about-this-district\/childrens-court\/about-childrens-court\/\" target=\"_blank\" rel=\"noopener\">Children\u2019s Court<\/a> for up to 90 days on the first finding of habitual truancy and up to one year for a subsequent finding, among other possible outcomes.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i><b>Note:<\/b> State laws are constantly being revised.
