This includes in the school classroom, graduation ceremonies, or sporting events like football games.<\/p>\r\n<p>Even though schools can&#8217;t lead students in prayers, students can still have voluntary prayer. This means students can pray by themselves or with friends as long as it doesn&#8217;t disrupt class or seem like the school is endorsing it. This can be during the minute of silence or at another appropriate time.&nbsp;<\/p>\r\n<p>For example, a group of Christian or Catholic students can read the Bible or say the Lord&#8217;s Prayer together at lunch. The same goes for students with other religious beliefs, so long as it is student-initiated. Schools don&#8217;t provide religious exercises, but students still get to express their religious beliefs.<\/p>\r\n<p>This article explores prayer in public school laws in the state of New Mexico.<\/p>\r\n<h2>Prayer in Public Schools: A Brief Overview<\/h2>\r\n<p>Across the United States,&nbsp;a complex interplay governs the issue of prayer in public schools.&nbsp;This interplay is between court decisions, constitutional principles, and policies issued by the U.S. Board of Education. It also includes state laws, district court decisions, and State Board of Education policies.&nbsp;<\/p>\r\n<p>Together, they aim to navigate the delicate balance between religious freedom and the separation of church and state.<\/p>\r\n<p>Public schools are prohibited from conducting or endorsing prayer to avoid the establishment of religion. The landmark case of&nbsp;<i><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/370\/421.html\" target=\"_blank\" rel=\"noopener\">Engel v. Vitale<\/a>&nbsp;<\/i>(1962) from New York established this law. Schools can&#8217;t engage in devotional Bible readings or lead students in prayer. This federal law is mandated by the Supreme Court and helps protect religious liberty.<\/p>\r\n<p>Students and school employees retain the right to engage in voluntary school prayer and religious observance. They can do so individually or in religious groups&nbsp;as&nbsp;long as these activities are not disruptive and do not imply school endorsement.&nbsp;<\/p>\r\n<p>This framework ensures that schools remain neutral spaces for education. They also help respect the personal religious practices of students.<\/p>\r\n<p>In addition to policies on voluntary prayer, many public schools have adopted the practice of observing a&nbsp;<a href=\"https:\/\/www.findlaw.com\/education\/student-rights\/is-a-minute-of-silence-in-school-permissible-.html\">moment of silence<\/a>. School districts often implement this at the beginning of the school day. This practice is designed to accommodate all students, regardless of their denominational beliefs or non-beliefs. Students can pray quietly to whatever god they choose or sit quietly and reflect on their day ahead.<\/p>\r\n<p>By allowing for personal religious expression, schools strive to honor the diverse religious landscape of America. School boards uphold the principle of free speech and religious exercise for all students.<\/p>\r\n<h2>School Prayer Laws in New Mexico<\/h2>\r\n<p>In New Mexico, the laws surrounding school prayer reflect a careful balance. This balance is between students&#8217; religious freedoms and adhering to the principle of separation of church and state, as outlined by the Supreme Court.&nbsp;<\/p>\r\n<p>Public schools in New Mexico are not allowed to initiate or sponsor prayer, Bible readings, or any religious exercises. Students have&nbsp;the freedom to engage in voluntary prayer and&nbsp;<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/what-types-of-religious-activities-are-allowed-in-public-schools.html\">religious activities<\/a>. This is provided that these actions do not disrupt educational activities or appear to be endorsed by the school.<\/p>\r\n<p>While some states do have laws that&nbsp;address prayer and&nbsp;<a href=\"https:\/\/www.findlaw.com\/education\/student-rights\/religion-at-school.html\">religion in public schools<\/a>, New Mexico does not. Schools in New Mexico must comply with federal law and Supreme Court cases on school prayer.&nbsp;<\/p>\r\n<h2>Overview of New Mexico Prayer in Public School Laws<\/h2>\r\n<p>The following chart explains the federal law related to&nbsp;<a href=\"https:\/\/www.findlaw.com\/state\/education-laws\/details-on-state-prayer-in-public-school-laws.html\">prayer in public schools<\/a>, which law applies in New Mexico and all other states.<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><b><p>New Mexico Relevant&nbsp;Code Section<\/p>\r\n<\/b><\/th>\r\n<td>The&nbsp;<a href=\"https:\/\/codes.findlaw.com\/nm\/\" target=\"_blank\" rel=\"noopener\">New Mexico Statutes and Administrative Code<\/a>&nbsp;do&nbsp;not address&nbsp;school prayer. The&nbsp;<a href=\"https:\/\/codes.findlaw.com\/nm\/new-mexico-constitution\/\" target=\"_blank\" rel=\"noopener\">New Mexico Constitution<\/a>, Article 2: Bill of Rights, Section 11: Freedom of Religion,&nbsp;gives the right to worship&nbsp;a god according to one&#8217;s conscience. It also prohibits:<br>\r\n<ul>\r\n<li>Denying political rights or privileges due to religion or requiring attending or supporting any religious sect or denomination&nbsp;<\/li>\r\n<li>Giving any legal preference to any religion or mode of worship&nbsp;<\/li>\r\n<\/ul>\r\nThis is similar to the&nbsp;U.S. Constitution&#8217;s&nbsp;First Amendment. New Mexico also passed a&nbsp;<a href=\"https:\/\/codes.findlaw.com\/nm\/chapter-28-human-rights\/nm-st-sect-28-22-3\/\" target=\"_blank\" rel=\"noopener\">Religious Freedom Restoration Act<\/a>&nbsp;(RFRA) to protect the freedom of religion.<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><b><p>What is Allowed?<\/p>\r\n<\/b><\/th>\r\n<td>Public schools in New Mexico must comply with federal laws and cases that provide&nbsp;<a href=\"https:\/\/www.findlaw.com\/education\/student-rights\/religious-accommodation-for-students.html\">religious accommodations for students<\/a>&nbsp;if requested. For example, a Jewish student can request the day off for&nbsp;<a href=\"http:\/\/www.adl.org\/civil-rights\/religious-freedom\/c\/religaccommodshighhols\/school-workplace.html\" target=\"_blank\" rel=\"noopener\">Jewish holidays<\/a>&nbsp;or Muslim students may request a break and a place to pray at specific times&nbsp;to meet their religious obligation to pray five times a day at specific times.
