However, several federal and state laws have carved out protections that restrict what an employer can fire an employee for. Usually these are areas like discrimination, workplace safety, and workers\u2019 compensation filings.<\/p>\n<p>A whistleblower is an employee who either reports an unsafe workplace or becomes aware of something illegal at work and makes the difficult decision to report the matter to the authorities. Federal and state laws protect these courageous <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers.html\" target=\"_blank\">whistleblowers<\/a> from being fired or disciplined. Fear of losing a job is a huge barrier to reporting unethical business practices because many Americans <a href=\"http:\/\/money.cnn.com\/2013\/06\/24\/pf\/emergency-savings\/\" target=\"_blank\" rel=\"noopener\">are living paycheck to paycheck<\/a> and being out of work even temporarily can result in losing your home or car.<\/p>\n<h2>Whistleblower Protections in New Mexico<\/h2>\n<p>New Mexico does recognize at \u201c<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law_and_life\/2013\/06\/what-is-common-law.html\" target=\"_blank\">common law<\/a>\u201d or through prior cases that an employee can\u2019t be fired for a reason contradicting clear public policy. An example of against public policy would be an employer that requires you to break the law, whether that\u2019s \u201ccooking the books\u201d or perjury in a civil case that could devastate the company if the truth got out.<\/p>\n<p>Also, New Mexico has enacted statutes that protect employees from retaliation by firing, demoting, etc. for certain activities related to reporting or complaining about discrimination, Medicaid fraud, occupational health and safety (OSHA), mining safety, radiation control, and <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation.html\" target=\"_blank\">worker\u2019s compensation<\/a>.<\/p>\n<p>Additionally, private employment contracts can provide additional protections. However, each whistleblower statute was written differently and additional remedies could apply to your situation.<\/td>\n<\/tr><tr><td width=\"222\" valign=\"top\"><b>Penalties<\/b><\/td>\n<td width=\"449\" valign=\"top\">Penalties vary from civil fines to criminal penalties, in addition to having to pay the whistleblower\u2019s back pay.<\/td>\n<\/tr><tr><td width=\"222\" valign=\"top\"><b>Statute of Limitations<\/b><\/td>\n<td width=\"449\" valign=\"top\">A whistleblower can sue the employer for the retaliation they experienced, generally <a href=\"http:\/\/public.nmcompcomm.us\/NMPublic\/gateway.dll?f=jumplink$jumplink_x=Advanced$jumplink_vpc=first$jumplink_xsl=querylink.xsl$jumplink_sel=title;path;content-type;home-title;item-bookmark$jumplink_d={nmsu}$jumplink_q=%5Bfield%20folio-destination-name:%2737-1-4%27%5D$jumplink_md=target-id=0-0-0-49935\" target=\"_blank\" rel=\"noopener\">within four years<\/a> of the retaliatory action, unless a different time period applies. However, other limitations, like informing the Occupational Health and Safety Bureau within 30 days of a retaliation incident also apply. Be sure to double check with a lawyer before it\u2019s too late!<\/td>\n<\/tr><\/tbody><\/table>\n<p>If you believe you were retaliated against for reporting discrimination or unsafe practices or for declining to do something illegal, than you should speak with an experienced <a href=\"https:\/\/lawyers.findlaw.com\/whistleblower-qui-tam\/new-mexico\/\" target=\"_blank\" rel=\"noopener\">New Mexico whistleblower lawyer<\/a>.
