For instance, if you work with chemicals and were exposed to what turned out to be anhydrous ammonia, you would have 15 days from that date to report the exposure.

You have a year from the date your employer refuses your workers’ compensation claim to file a formal claim with the New Mexico Workers‘ Compensation Administration (WCA) insurance company. Instead, the one-year period begins when the employer/insurer fails or refuses to pay compensation, or when indemnity payments cease. If you miss either deadline, you may be barred from recovering any benefits.

Other common reasons include:

Lack of medical support for your claim: Your doctor must clearly link your accident to your medical condition. If you have any pre-existing conditions, the insurer may claim your injury is related to those, not your workplace accident. You must have clear medical documentation that connects your accident and your injury.

Your injury did not occur at work or during work hours: Workers’ comp does not cover you “going and coming” to or from work. You are not covered during unpaid breaks unless you’re required to take breaks on company property.

You were intoxicated or impaired when your accident occurred: Impairment from drugs or alcohol while at work will almost always lead to a denial. Most insurance coverage will not pay for injuries due to recklessness, impairment, or intentional behavior.

Your injury was caused by a third party: Unless your worksite was directly responsible for the injury, your claim may be denied. For instance, if you were injured on a construction site because an outside contractor assembled unsafe scaffolding, the insurer may argue your claim is against that contractor.

Most denials are appealable. Contact a workers’ compensation lawyer before trying to appeal a claim yourself.

How To Appeal a Denied Claim

To begin the appeals process, contact a workers’ compensation attorney. The process is complicated, and you’ll need legal advice even if you don’t plan to hire someone to represent you. Your first step is to submit a formal application with the WCA.

You have 30 days from the date of denial to file an appeal. The denial date isn’t the date you receive the letter from the insurance company, but rather when they drafted it. Once the WCA receives your form, they will assign you a mediator. Mediation is an informal process designed to help parties reach an agreement on a disputed matter. Most claim denials are resolved during mediation without going to trial. You may have an attorney with you during mediation.

If the mediation fails, your case will be sent to a Workers’ Compensation Judge (WCJ) for a formal hearing. You can present evidence and witnesses about your claim. The judge will review both sides and then issue a ruling on the case.

If you’re still dissatisfied with the ruling, you have 30 days to appeal to the New Mexico Court of Appeals. You must have legal representation at this stage.

Get Legal Advice From a New Mexico Workers’ Compensation Attorney

As an employee, you’re entitled to workers’ compensation benefits if you’re injured on the job. Workers’ compensation insurance should provide you with medical treatment and wage replacement without you having to fight for them.
