New York is one of the few no-fault car insurance states. After a car accident, victims must file claims with their own insurance companies before taking any legal action. Along with the no-fault insurance requirements, New York uses a <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/comparative-negligence.html\" title=\"pure comparative negligence\">pure comparative negligence<\/a> rule, giving both drivers a chance at recovering in a personal injury case.<\/p>\r\n<p>If you need to make a car accident claim or a personal injury lawsuit, it&#8217;s best to consult a <a href=\"https:\/\/lawyers.findlaw.com\/motor-vehicle-accidents-plaintiff\/new-york?fli=dcta\" title=\"car accident lawyer\" target=\"_blank\" rel=\"noopener\">car accident lawyer<\/a> and brush up on New York&#8217;s car accident compensation laws.<\/p>\r\n<h2><b>New York Car Accident Laws<\/b><\/h2>\r\n<p>New York is a no-fault state. Drivers must carry their own <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/how-does-pip-insurance-work-5-common-questions\/\" title=\"personal injury protection\">personal injury protection<\/a> coverage and file claims with their own insurance companies after an accident. New York drivers must also have liability insurance if another driver sues them. The minimum insurance coverage is:<\/p>\r\n<ul>\r\n<li><b>Liability Insurance:<\/b> $25,000 bodily injury per person\/$50,000 bodily injury per accident<\/li>\r\n<li><b>Uninsured\/Underinsured Motorist:<\/b> $25,000 per person\/$50,000 per accident<\/li>\r\n<li><b>Personal Injury Protection (PIP):<\/b> $50,000 per person<\/li>\r\n<li><b>Property Damage Liability coverage:<\/b> $10,000 per accident<\/li>\r\n<\/ul>\r\n<p>These are <a href=\"https:\/\/dmv.ny.gov\/insurance\/insurance-requirements\" title=\"maximum insurance policy limits\" target=\"_blank\" rel=\"noopener\">maximum insurance policy limits<\/a>, the total your company will pay for your injuries or another driver&#8217;s claim.<\/p>\r\n<p>To make a claim against the other driver, you must have suffered a &quot;serious injury.&quot; A serious injury means you suffered a:<\/p>\r\n<ul>\r\n<li>Broken bone<\/li>\r\n<li>Total disability for more than 90 days<\/li>\r\n<li>Disfigurement<\/li>\r\n<li>Limitation of use of a body organ or function<\/li>\r\n<\/ul>\r\n<p>Your PIP insurance will not pay for pain and suffering and other non-economic damages. If you can file a &quot;serious injury&quot; claim, you can request these other damages.<\/p>\r\n<h2><b>Comparative Negligence<\/b><\/h2>\r\n<p>New York is a <a href=\"https:\/\/codes.findlaw.com\/ny\/civil-practice-law-and-rules\/cvp-sect-1411.html\" target=\"_blank\" rel=\"noopener\">pure comparative negligence<\/a> state. In most auto accident cases, drivers may share some of the responsibility for the accident. One driver may be more at fault, for instance, a driver speeding and running a red light versus a driver a few feet too far into the intersection.<\/p>\r\n<p>Under pure <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/defenses-contributory-and-comparative-negligence-in-car-accident.html\" title=\"comparative negligence\">comparative negligence<\/a>, at-fault drivers can still recover damages, but their percentage of fault reduces the amount of their recovery. For instance, if you are 20% at fault, you can still recover 80% of damages in your case.<\/p>\r\n<h2><b>Damages and Limits<\/b><\/h2>\r\n<p>In a car accident lawsuit, &quot;damages&quot; means the <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/what-kinds-of-damages-may-i-claim-for-car-accident-injuries.html\" title=\"economic losses you suffer\">economic losses you suffer<\/a> due to the collision. Like most states, New York divides damages into two categories.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.html\" title=\"Economic damages\"><b>Economic damages<\/b><\/a> are tangible losses calculated with accident reports and medical records. Economic damages include:<\/p>\r\n<ul>\r\n<li>Medical bills, including future treatment costs<\/li>\r\n<li>Lost wages and income<\/li>\r\n<li>Out-of-pocket losses<\/li>\r\n<\/ul>\r\n<p>New York&#8217;s no-fault insurance law does not apply to vehicular damage. Drivers may file claims for damage or loss of the car directly against the other driver.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/car-accident-pain-and-suffering-damages.html\" title=\"Non-economic damages\"><b>Non-economic damages<\/b><\/a> are subjective damages that are less easily tabulated. These damages include:<\/p>\r\n<ul>\r\n<li>Pain and suffering<\/li>\r\n<li>Emotional distress<\/li>\r\n<li>Loss of consortium<\/li>\r\n<li>Wrongful death<\/li>\r\n<\/ul>\r\n<p>New York does not have any laws prohibiting <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/when-can-you-sue-for-punitive-damages\/\" title=\"punitive damages\">punitive damages<\/a>. If a driver&#8217;s conduct was particularly reckless or malicious, you can request punitive damages in a personal injury claim.<\/p>\r\n<h3><b>Limits<\/b><\/h3>\r\n<p>New York has no <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/what-is-a-damages-cap.html\" title=\"statutory caps\">statutory caps<\/a> on any damages. The only restrictions are policy limits and proof of injury.<\/p>\r\n<p>Accident victims have a limited amount of time to file a claim. New York&#8217;s statute of limitations is <a href=\"https:\/\/codes.findlaw.com\/ny\/civil-practice-law-and-rules\/cvp-sect-214.html\" target=\"_blank\" rel=\"noopener\">three years<\/a> from the date of the accident.
