While every case is different, in most, the noncustodial parent (NCP) makes payments to the custodial parent through the <a href=\"https:\/\/childsupport.ny.gov\/DCSE\/HomePage\" target=\"_blank\" rel=\"noopener\">New York State Office of Child Support Services (OCSS)<\/a>.<\/p>\r\n<p>Providing for your children is not a choice. It&#8217;s an obligation. <a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-260-06\/\" target=\"_blank\" rel=\"noopener\">Child support laws can punish<\/a> nonpayment if necessary, but the primary goal is enabling a seamless transfer of funds from the NCP to the custodial parent.<\/p>\r\n<p>This article will explain New York child support laws, how the amount of child support gets determined, and the guidelines to protect the <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/focusing-on-the-best-interests-of-the-child.html\">best interests of the child<\/a>.<\/p>\r\n<h2>New York Child Support Obligations<\/h2>\r\n<p>New York state laws don&#8217;t mince words on caring for one&#8217;s children. Parents of a child under 21 <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html#:~:text=the%20parents%20of%20a%20child%20under%20the%20age%20of%20twenty%2Done%20years%20are%20chargeable%20with%20the%20support%20of%20such%20child%20and%2C%20if%20possessed%20of%20sufficient%20means%20or%20able%20to%20earn%20such%20means%2C%20shall%20be%20required%20to%20pay%20for%20child%20support%20a%20fair%20and%20reasonable%20sum%20as%20the%20court%20may%20determine\" target=\"_blank\" rel=\"noopener\">must provide for their needs<\/a>. This is true regardless of the relationship between the parents.<\/p>\r\n<p>The responsibility to offer financial support falls on those who have&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-516-a\/#:~:text=(a)%20An-,acknowledgment%20of%20parentage,-executed%20pursuant%20to\" target=\"_blank\" rel=\"noopener\">acknowledged paternity<\/a>. These are usually the parents listed on the child&#8217;s birth certificate. If necessary, the court can <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-516-a\/#:~:text=the%20court%20shall%20order%20genetic%20marker%20tests%20or%20DNA%20tests%20for%20the%20determination%20of%20the%20child%27s%20parentage.\" target=\"_blank\" rel=\"noopener\">order testing to confirm a child&#8217;s birth parent<\/a>.<\/p>\r\n<p>The Social Security Act of 1975 <a href=\"https:\/\/childsupport.ny.gov\/dcse\/custodial_parent_info.html#:~:text=top%20of%20page-,What%20is%20the%20Child%20Support%20Program%3F,-Every%20state%20in\" target=\"_blank\" rel=\"noopener\">required states to set up programs<\/a> to establish and enforce child support payments under Title IV-D. Parents must provide necessities such as food, clothing, shelter, and health insurance.<\/p>\r\n<p>Child support payments are <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html\" target=\"_blank\" rel=\"noopener\">set through a court order<\/a>. It&#8217;s common to encounter them during divorce or child custody hearings. One parent can also file a support petition against the other to start child support payments.<\/p>\r\n<p>Parents may submit a <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-by-agreement.html\">written agreement for child support<\/a> payments they&#8217;ve negotiated. The court must approve it and make sure both parents understand the terms.<\/p>\r\n<h2>Financial Disclosures<\/h2>\r\n<p>Child support gives children the same financial support they&#8217;d have if their parents were together. Before the state can use child support formulas to arrive at a figure, it needs to determine two things:<\/p>\r\n<ul>\r\n<li><a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-determining-parents-income.html\" target=\"_blank\">How much income the parents generate<\/a><\/li>\r\n<li>How much they can afford to pay<\/li>\r\n<\/ul>\r\n<p>The income of both parents is part of the equation.<\/p>\r\n<p>The first and most obvious financial disclosure forms are each parent&#8217;s tax returns, W-2 forms, and pay stubs. Bank accounts and stock portfolios face disclosure as well. Parents must share <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html#:~:text=Income%E2%80%9D%20shall%20mean%2C%20but%20shall%20not%20be%20limited%20to\" target=\"_blank\" rel=\"noopener\">all sources of income for child support determination<\/a>. This includes:<\/p>\r\n<ul>\r\n<li>Alimony payments<\/li>\r\n<li>Annuity payments<\/li>\r\n<li>Disability benefits<\/li>\r\n<li>Fellowships and stipends<\/li>\r\n<li>Pensions and retirement benefits<\/li>\r\n<li>Social security benefits<\/li>\r\n<li>SSI payments (Supplemental Security Income)<\/li>\r\n<li>Unemployment insurance benefits<\/li>\r\n<li>Veterans benefits<\/li>\r\n<li>Workers&#8217; compensation<\/li>\r\n<\/ul>\r\n<p>This disclosure is not voluntary. Anyone involved in child support proceedings is subject to <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-424-a\/\" target=\"_blank\" rel=\"noopener\">compulsory financial disclosure<\/a>.<\/p>\r\n<h2>Determining Child Support Payments<\/h2>\r\n<p><a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-child-support-guidelines.html\">New York&#8217;s guidelines for determining child support payments<\/a> are fairly straightforward, but that doesn&#8217;t mean they aren&#8217;t confusing. New York operates on an income-shares model. Under this system, the parents&#8217; gross income gets combined to determine the starting point. If one parent has a gross income of $60,000 and the other $40,000, their gross income is $100,000.<\/p>\r\n<p>The shared gross income represents the funds available if the parents and children were in a single household. The court then <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html#:~:text=(3)%20%E2%80%9C-,Child%20support%20percentage,-%E2%80%9D%20shall%20mean%3A\" target=\"_blank\" rel=\"noopener\">applies a formula<\/a> to determine how much of that income would have been spent on the children. The number of children the parents have between them decides the percentage:<\/p>\r\n<ul>\r\n<li>17% for one child<\/li>\r\n<li>25% for two children<\/li>\r\n<li>29% for three children<\/li>\r\n<li>31% for four children<\/li>\r\n<li>At least 35% for five or more children<\/li>\r\n<\/ul>\r\n<p>Parents with two children and a gross income of $100,000 would have a base child support cost of $17,000 between them. How that amount is split depends on factors such as who is the custodial parent and <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html#:~:text=such%20amount%20shall%20be%20prorated%20in%20the%20same%20proportion%20as%20each%20parent%27s%20income%20is%20to%20the%20combined%20parental%20income.\" target=\"_blank\" rel=\"noopener\">what percentage of the gross income each parent contributed<\/a>.<\/p>\r\n<p>In most cases, the noncustodial parent (NCP) will pay more because the custodial parent handles the day-to-day expenses. Childcare expenses, health care expenses, and medical expenses are often <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html#:~:text=Each%20parent%27s%20pro%20rata%20share%20of%20the%20child%20care%20expenses%20shall%20be%20separately%20stated%20and%20added%20to%20the%20sum%20of%20subparagraphs%20two%20and%20three%20of%20this%20paragraph\" target=\"_blank\" rel=\"noopener\">add-ons that follow the gross income percentage<\/a>. The court can order the NCP to pay all education expenses.<\/p>\r\n<p>Every case is different. The court can adjust child support amounts to fit the situation. This often happens when there&#8217;s a big difference between the parents&#8217; incomes. The support magistrate can use alternate methods of child support payment determination in their order of support if the <a href=\"https:\/\/childsupport.ny.gov\/dcse\/custodial_parent_info.html#:~:text=For%20the%20combined%20parental%20income%20amount%20over%20%24183%2C000%2C%20the%20court%20may%20consider%20either%20the%20standard%20guideline%20percentages%20and\/or%20other%20factors%20in%20setting%20the%20full%20child%20support%20obligation.\" target=\"_blank\" rel=\"noopener\">combined gross income is over $183,000<\/a>.<\/p>\r\n<p>It&#8217;s possible to <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-modification.html\">request modifications<\/a> to child support payments. This is common after major life changes such as loss of employment, financial gain by one of the parents, or a change in marital status.<\/p>\r\n<p>All child support payments are subject to review every two years. This is to determine if cost of living adjustments (COLA) apply. The <a href=\"https:\/\/childsupport.ny.gov\/DCSE\/HomePage#:~:text=To%20access%20your%20account%20information,Division%20of%20Child%20Support%20Services.\" target=\"_blank\" rel=\"noopener\">New York State Office of Child Support Services (OCSS)<\/a> transfers funds to the custodial parent.<\/p>\r\n<p>In most cases, the NCP&#8217;s employer deducts the child support amount from the NCP&#8217;s paycheck, which goes to the New York State Child Support Processing Center. But, NCPs can make other arrangements for submitting child support.<\/p>\r\n<p>New York has several agencies that enforce child support payments. The names can vary by county. These include the following:<\/p>\r\n<ul>\r\n<li>Child Support Enforcement Unit (CSEU)<\/li>\r\n<li><a href=\"https:\/\/www.suffolkcountyny.gov\/Departments\/Social-Services\/Child-Support-Enforcement-Bureau\" target=\"_blank\" rel=\"noopener\">Child Support Enforcement Bureau (CSEB)<\/a><\/li>\r\n<li>Support Collection Unit (SCU)<\/li>\r\n<\/ul>\r\n<p>Nonpayers face garnishment of their <a href=\"https:\/\/childsupport.ny.gov\/dcse\/cp_support_enforcement.html#:~:text=overdue%20child%20support.-,Income%20Execution%20(IEX),-Income%20Execution%20(IEX\" target=\"_blank\" rel=\"noopener\">paychecks or unemployment benefits<\/a> if they fall into arrears (owe child support). Other methods used to collect on overdue child support include:<\/p>\r\n<ul>\r\n<li>Income tax refund intercept (federal and state)<\/li>\r\n<li>Credit bureau submission<\/li>\r\n<li>Lottery winnings intercept<\/li>\r\n<li>Property execution (seizure of financial assets)<\/li>\r\n<li>Suspension of driver&#8217;s license<\/li>\r\n<li>Denial of issuance or renewal of a passport<\/li>\r\n<li>Liens against real estate and court awards<\/li>\r\n<\/ul>\r\n<p>It&#8217;s possible to face jail time for child support nonpayment issues. This includes making a voluntary substantial change in your ability to earn income for paying child support. Violators face a class A misdemeanor charge for <a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-260-05\/\" target=\"_blank\" rel=\"noopener\">second-degree non-support of a child<\/a>. A second instance within five years <a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-260-06\/\" target=\"_blank\" rel=\"noopener\">is a class E felony<\/a>.<\/p>\r\n<h2><b>New York Child Support Laws: Review<\/b><\/h2>\r\n<p>No matter how you feel about your child&#8217;s other parent, it&#8217;s important to ensure your offspring are well cared for.
