The court will <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-child-support-guidelines.html\" title=\"determine how much money\">determine how much money<\/a> the parents must allocate for the children. The noncustodial parent pays their share of <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-basics.html\" title=\"child support\">child support<\/a> to the custodial parent. They have a legal obligation to provide for their children.<\/p>\r\n<p>Circumstances in your life can change, making it difficult or even impossible to continue to pay the amount the court ordered you to. In New York, it&#8217;s <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-451\/\" title=\"possible to modify the terms\" target=\"_blank\" rel=\"noopener\">possible to modify the terms<\/a> of your child support payments.<\/p>\r\n<p>This article will show what conditions might qualify and walk you through the process. Read on for a better understanding of how to modify child support payments in New York.<\/p>\r\n<h2>How Child Support Works in New York<\/h2>\r\n<p>If you&#8217;re trying to learn how to modify a payment, chances are you&#8217;re already familiar with what child support is. Whether the need for child support arises from divorce or a single parent filing a claim against the other parent, the goal is to ensure the children are provided for.<\/p>\r\n<p>In New York, <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-child-support-calculations.html\" title=\"child support is determined\">child support is determined<\/a> using the <b>income shares<\/b> model. The gross income of both parents is applied to a table based on the number of children they have. This produces a rough amount of what would have been spent on the children if the parents were raising them together.<\/p>\r\n<p>The family court then <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-child-support-guidelines.html\" title=\"assesses other factors\">assesses other factors<\/a>. These include who the primary custodial parent is and each parent&#8217;s income percentage. After making these adjustments, the court order is issued with the final amounts.<\/p>\r\n<p>In most cases, the <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/child-custody-basics.html\" title=\"noncustodial parent\">noncustodial parent<\/a> (NCP) pays child support to the primary custodial parent through the <a href=\"https:\/\/childsupport.ny.gov\/DCSE\/HomePage#:~:text=To%20access%20your%20account%20information,Division%20of%20Child%20Support%20Services.\" title=\"New York State Office of Child Support Services (OCSS)\" target=\"_blank\" rel=\"noopener\">New York State Office of Child Support Services (OCSS)<\/a>. Payments are either deducted from the NCP&#8217;s paycheck or sent in another way. Nonpayment of child support is not tolerated in New York and <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-child-support-enforcement.html\" title=\"can even cause jail time\">can even lead to jail time<\/a>.<\/p>\r\n<h2>Reasons for Changes in Child Support<\/h2>\r\n<p>It&#8217;s not easy to modify a child support order. New York requires a significant reason for the alteration of the amount. Child support orders are subject to <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413-a\/\" title=\"review for cost of living adjustments (COLA)\" target=\"_blank\" rel=\"noopener\">review for cost of living adjustments (COLA)<\/a>. Either parent can request this after two years. The Support Collection Unit (SCU) bases a decision on whether or not the consumer price index has changed by 10% or more.<\/p>\r\n<p>Parents requesting the modification of a child support order will need a compelling reason for approval. While all situations are given consideration, the court operates in the <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/focusing-on-the-best-interests-of-the-child.html\" title=\"best interests of the child\">best interests of the child<\/a>. Any downward modification in the amount of child support requires justification.<\/p>\r\n<p>There are three main types of conditions under which the court might grant a child support modification. Let&#8217;s examine each one.<\/p>\r\n<h3>Change in Circumstances<\/h3>\r\n<p>Life is unpredictable and, at times, chaotic. Circumstances change often. Big changes can affect child support. Each situation is different, but certain events often qualify as large changes:<\/p>\r\n<ul>\r\n<li>Change in parental custody<\/li>\r\n<li>The subject of child support becomes emancipated (joins the military, gets married, gets full-time employment, <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-413.html#:~:text=the%20parents%20of%20a%20child%20under%20the%20age%20of%20twenty%2Done%20years%20are%20chargeable%20with%20the%20support%20of%20such%20child\" title=\"reaches the age of 21\" target=\"_blank\" rel=\"noopener\">reaches the age of 21<\/a>, etc.)<\/li>\r\n<li>Incarceration of a parent (if not for nonpayment of child support)<\/li>\r\n<li>Serious illness of a parent<\/li>\r\n<li>Adoption of the child by a step-parent<\/li>\r\n<li>Change in the child&#8217;s educational needs<\/li>\r\n<\/ul>\r\n<p>This is not an exhaustive list. If you&#8217;re uncertain whether or not a change in your life is worth requesting a modification for, speak with a <a href=\"https:\/\/lawyers.findlaw.com\/child-support\/new-york\/?fli=dcta\" title=\"New York family law attorney\" target=\"_blank\" rel=\"noopener\">New York family law attorney<\/a>.<\/p>\r\n<h3>Three (3) Years Have Passed Since the Order Was Issued<\/h3>\r\n<p>Not all changes are major. A group of <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-determining-parents-income.html\" title=\"smaller alterations can add up to affect someone&#039;s life\">smaller alterations can add up to affect someone&#8217;s life<\/a>. An increase in the child&#8217;s expenses might prompt a custodial parent to request additional funds. A noncustodial parent having to travel to take care of a sick relative can ask for relief. The court will balance the needs of the child against reasonable expectations of what the parents can provide.<\/p>\r\n<h3>Involuntary Change in Gross Income<\/h3>\r\n<p>If a parent makes more or less money, it makes sense that the amount of child support they pay is affected as well. If there&#8217;s a change in their <a href=\"https:\/\/www.nycbar.org\/get-legal-help\/article\/family-law\/child-support-modification\/#:~:text=There%20has%20been%20an%20involuntary%20change%20in%20either%20party%E2%80%99s%20gross\" title=\"gross income of at least 15%\" target=\"_blank\" rel=\"noopener\">gross income of at least 15%<\/a>, the court may agree to a modification of the existing child support order. This applies whether it&#8217;s an increase or a decrease.<\/p>\r\n<p>Note that this must stem from an <i>involuntary<\/i> change in income. If a parent quits employment without good cause or doesn&#8217;t put effort into finding a job, they are not likely to get the change they want. Parents who fail to make child support payments due to a voluntary reduction in income face <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-child-support-enforcement.html\" title=\"penalties that can include jail time\">penalties that can include jail time<\/a>, suspension of a driver&#8217;s license, or garnishment of tax refunds.<\/p>\r\n<h2>How To File for Child Support Modification in New York<\/h2>\r\n<p>If you have a <a href=\"https:\/\/childsupport.ny.gov\/order\/modify\" title=\"significant change in your life\" target=\"_blank\" rel=\"noopener\">significant change in your life<\/a> that will affect your ability to make child support payments, it&#8217;s important to file as soon as you can. Any modifications approved by the court will begin from the date the petition is filed, not from when the event happened. If you fall behind in payments, you&#8217;ll be in arrears. The petition is <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/FORMS\/familycourt\/pdfs\/4-11.pdf\" title=\"Form 4-11, Support-Petition for Modication\" target=\"_blank\" rel=\"noopener\">Form 4-11, Support-Petition for Modification<\/a>.<\/p>\r\n<p>You can contact OCSS by email at dcse.cseweb@dfa.state.ny.us to set up a phone appointment. Use &#8216;Modify Order&#8217; as the subject heading and include your case number in the email. You can also make an appointment <a href=\"https:\/\/childsupport.ny.gov\/DCSE\/LocalOffices_input\" title=\"at a local branch\" target=\"_blank\" rel=\"noopener\">at a local branch<\/a>. While OCSS can&#8217;t modify the order, they&#8217;ll help prepare your petition for family court. This can help keep the number of court appearances to a minimum.<\/p>\r\n<p>Form 4-11 is <a href=\"https:\/\/nycourts.gov\/courthelp\/diy\/supportmodification.shtml\" title=\"also available for preparation online\" target=\"_blank\" rel=\"noopener\">also available for preparation online<\/a>. File the completed form either online or in Family Court. You&#8217;ll need to provide evidence supporting your request for modification.<\/p>\r\n<h2><b>New York Child Support Modifications &#8211; Review<\/b><\/h2>\r\n<p>Dealing with child support is frustrating and confusing. You can also end up <a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-260-05\/\" title=\"facing criminal charges\" target=\"_blank\" rel=\"noopener\">facing criminal charges<\/a>.<\/p>\r\n<p>(<a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-451\/\" title=\"NY FCA Section 451\" target=\"_blank\" rel=\"noopener\">NY FCA Section 451<\/a>; <a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-260-05\/\" title=\"Penal Law Section 260.05\" target=\"_blank\" rel=\"noopener\">NYPL Section 260.05<\/a>)<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>How To Modify a Child Support Order in New York<\/b><\/p>\r\n<\/th>\r\n<td><p>If you already have a support order signed by a judge, you may apply to modify that order by following these steps:<\/p>\r\n<ul>\r\n<li>Gather the following information: Name and address of the <b>other parent<\/b>; a copy of the <b>support order<\/b>; the names, addresses, and birth dates of the <b>children on the order<\/b>; and <b>evidence<\/b> as to why the order should be modified<\/li>\r\n<li>File a <b>petition for modification<\/b> using either the online <a href=\"https:\/\/nycourts.gov\/courthelp\/diy\/supportmodification.shtml\" title=\"NYS Family Support Modification Petition DIY\" target=\"_blank\" rel=\"noopener\">DIY Family Support Modification module<\/a>, working with an OCSS representative, or by filing the <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/FORMS\/familycourt\/pdfs\/4-11.pdf\" title=\"Petition for Modification of an Order of Support (New York State)\" target=\"_blank\" rel=\"noopener\">appropriate form<\/a> (.pdf) in family court<\/li>\r\n<li>If the court rules in favor of the modification petition, it will become effective as of <b>the date the petition was filed<\/b><\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i><b>Note:<\/b> New York laws change through the passage of new legislation, higher court rulings that include federal decisions, ballot initiatives, and other means.
