With an <span data-term-id=\"41366780\">estate plan<\/span> in place, you can protect your family by giving them the clarity and <span data-term-id=\"41366857\">peace of mind<\/span> that comes from knowing your final wishes. This overview of <span data-term-id=\"41366792\">New York <\/span><span data-term-id=\"41366875\">estate<\/span><span data-term-id=\"41366875\"> planning<\/span><span data-term-id=\"41366875\"> laws<\/span> explores what an <span data-term-id=\"41366780\">estate plan<\/span> is, how it operates under\u00a0<span data-term-id=\"41366842\">state law<\/span>, and the best ways to get started\u00a0creating yours.<\/p>\n<h2>What Is an <span data-term-id=\"41366780\">Estate Plan<\/span>?<\/h2>\n<p>An <span data-term-id=\"41366780\">estate plan<\/span> is a set of <span data-term-id=\"41366808\">legal documents<\/span> that explains how you want your assets (real\u00a0and\u00a0personal property) distributed to your <span data-term-id=\"41366782\">beneficiaries<\/span> after you pass away. These <span data-term-id=\"41366808\">legal documents<\/span> can also include instructions in case you become unable to manage your financial matters or healthcare decisions. This is known as <span data-term-id=\"41366859\">incapacity<\/span> planning.<\/p>\n<p>Your <span data-term-id=\"41366780\">estate plan<\/span> can be will-based or trust-based. Important <span data-term-id=\"41366859\">incapacity<\/span> planning documents include a <span data-term-id=\"41366824\">durable <\/span><span data-term-id=\"41366785\">power of attorney<\/span> and an advance care <span data-term-id=\"41366804\">directive<\/span>. <span data-term-id=\"41366812\">New York law<\/span> has specific requirements for these <span data-term-id=\"41366808\">legal documents<\/span>. If you\u2019re a <span data-term-id=\"41366790\">New York state<\/span> resident and you\u2019d like to protect your family, learning more about <span data-term-id=\"41366780\">estate planning<\/span> is a good place to start.<\/p>\n<h2>Core Components of an <span data-term-id=\"41366780\">Estate Plan<\/span><\/h2>\n<p>The core components of a comprehensive <span data-term-id=\"41366780\">estate plan<\/span> include a will or trust, a <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/how-to-make-a-power-of-attorney-in-new-york-faq.html\"><span data-term-id=\"41366824\">durable <\/span><span data-term-id=\"41366785\">power of attorney<\/span><\/a>, a <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/living-will\/what-is-a-health-care-directive-and-living-will\/healthcare-power-of-attorney.html\"><span data-term-id=\"41366796\">healthcare proxy<\/span><\/a>, and a <a href=\"https:\/\/www.findlaw.com\/estate\/living-will\/living-will-basics.html\"><span data-term-id=\"41366794\">living will<\/span><\/a>. An <span data-term-id=\"41366780\">estate plan<\/span> is usually built around either a <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/how-to-make-a-new-york-will-faq.html\"><span data-term-id=\"41366840\">last will and testament<\/span> (will) <\/a>or a <span data-term-id=\"41366798\">revocable<\/span> <span data-term-id=\"41366802\">living trust<\/span>. Each of these foundation documents has its own pros and cons. While the will or trust primarily deals with the distribution of your assets at your death, the <span data-term-id=\"41366785\">power of attorney<\/span>, <span data-term-id=\"41366796\">healthcare proxy<\/span>, and <span data-term-id=\"41366794\">living will<\/span> are the documents that communicate your wishes when you can\u2019t speak for yourself.<\/p>\n<h3><span data-term-id=\"41366812\">New York Laws<\/span> and Wills<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-wills-laws.html\"><span data-term-id=\"41366812\">New York law<\/span><\/a> does not provide a statutory form for wills, but it does specify exactly how a will must be signed and witnessed. A \u201csigning ceremony\u201d that doesn\u2019t meet these requirements can create significant <span data-term-id=\"41366781\">probate<\/span> problems, even if everyone agrees on what the <span data-term-id=\"41366834\">decedent<\/span> intended.<\/p>\n<p><strong>Essential Elements of a Valid Will<\/strong><\/p>\n<p>A person must have <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-3-1-1\/\" target=\"_blank\" rel=\"noopener\">legal capacity <\/a>to make a will in the <span data-term-id=\"41366855\">state of New York<\/span>. This includes being at least 18 years old and of sound mind and memory. Except for holographic and nuncupative wills, a will must be written and meet specific <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-3-2-1\/\" target=\"_blank\" rel=\"noopener\">execution and attestation requirements<\/a>. This means the written will must:<\/p>\n<ul>\n<li>\n<p>Be signed by the testator (the person making the will) or at the testator\u2019s <span data-term-id=\"41366804\">direction<\/span> at the end of the document<\/p>\n<\/li>\n<li>\n<p>Have the testator declare to each witness that the document is the testator\u2019s will<\/p>\n<\/li>\n<li>\n<p>Bear the testator\u2019s signature and an acknowledgment signed by two attesting witnesses (both must occur within 30 days of each other)<\/p>\n<\/li>\n<\/ul>\n<p><span data-term-id=\"41366812\">New York law<\/span> requires witnesses for a valid will, but not a notary. Including a <a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1406\/\" target=\"_blank\" rel=\"noopener\">notarized affidavit with your will <\/a>can make <span data-term-id=\"41366781\">probate<\/span> easier by helping prove everything was done correctly at the signing ceremony.<\/p>\n<p><strong>Holographic and Nuncupative Wills<\/strong><\/p>\n<p><span data-term-id=\"41366812\">New York law<\/span> recognizes holographic (handwritten; not witnessed) and nuncupative (oral; witnessed by at least two people) wills, but only under limited circumstances. A <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-3-2-2\/\" target=\"_blank\" rel=\"noopener\">holographic or nuncupative will <\/a>may be valid if executed by a member of the United States armed forces serving during a declared or undeclared war or other armed conflict.<\/p>\n<p><strong>The <span data-term-id=\"41366800\">Probate<\/span><span data-term-id=\"41366800\"> Process<\/span> for a Will-Based <span data-term-id=\"41366780\">Estate Plan<\/span><\/strong><\/p>\n<p><span data-term-id=\"41366790\">New York state<\/span> uses the term <span data-term-id=\"41366820\">Surrogate\u2019s Court<\/span> rather than <span data-term-id=\"41366865\">probate<\/span><span data-term-id=\"41366865\"> court<\/span>. Each county\u2019s <span data-term-id=\"41366820\">Surrogate\u2019s Court<\/span> oversees the process for distributing the <span data-term-id=\"41366834\">decedent<\/span>\u2019s assets. The process begins with a petition by someone (an executor, a\u00a0<span data-term-id=\"41366814\">family member<\/span>, or an\u00a0interested person) asking the court to open the estate. If you die \u201ctestate\u201d (with a will) and the will is valid, the <span data-term-id=\"41366800\">probate<\/span><span data-term-id=\"41366800\"> process<\/span> includes:<\/p>\n<ul>\n<li>\n<p>Appointing the executor<\/p>\n<\/li>\n<li>\n<p>Issuing \u201cLetters Testamentary\u201d<\/p>\n<\/li>\n<li>\n<p>Notifying interested persons<\/p>\n<\/li>\n<li>\n<p>Collecting and valuing your <span data-term-id=\"41366781\">probate<\/span> assets<\/p>\n<\/li>\n<li>\n<p>Notifying creditors<\/p>\n<\/li>\n<li>\n<p>Paying all debts, including taxes<\/p>\n<\/li>\n<li>\n<p>Distributing the remaining property to your named <span data-term-id=\"41366782\">beneficiaries<\/span> according to the will<\/p>\n<\/li>\n<li>\n<p>Closing the estate<\/p>\n<\/li>\n<\/ul>\n<p>Assets that lack a built-in transfer mechanism must be probated. <span data-term-id=\"41366858\">Life insurance policies<\/span> with a named <span data-term-id=\"41366782\">beneficiary<\/span>, homes owned jointly with right of survivorship, and <span data-term-id=\"41366871\">bank accounts<\/span> with a payable-on-death designation often transfer on death.<\/p>\n<p>If you die \u201cintestate\u201d (without a will), the <span data-term-id=\"41366800\">probate<\/span><span data-term-id=\"41366800\"> process<\/span> is similar. The court appoints an administrator rather than an executor and issues \u201cLetters of Administration\u201d rather than \u201cLetters Testamentary.\u201d Any property remaining after the debts are paid will go to your heirs according to New York\u2019s <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-4-1-1\/\" target=\"_blank\" rel=\"noopener\">intestate distribution law<\/a>.<\/p>\n<p><strong>Pros and Cons of a Will-Based <span data-term-id=\"41366780\">Estate Plan<\/span><\/strong><\/p>\n<p>A will-based <span data-term-id=\"41366780\">estate plan<\/span> often meets the needs of a modest estate and tends to have a lower upfront cost than a trust-based plan. There is no need to retitle assets during your lifetime if you choose a will-based <span data-term-id=\"41366780\">estate plan<\/span>. A will only takes effect upon your death and doesn\u2019t include baked-in <span data-term-id=\"41366859\">incapacity<\/span> planning as a trust-based plan does. The will must be probated, which can add time and expense to the distribution process. In addition, the court process is usually public, meaning creditors and others can often access sensitive information, including who is getting how much under your will.<\/p>\n<h3>New York Trust Laws<\/h3>\n<p>In general, a <a href=\"https:\/\/www.findlaw.com\/estate\/trusts.html\">trust<\/a> is a legal arrangement created by the trustmaker (\u201csettlor\u201d or \u201cgrantor\u201d) that allows the designated trustee to hold and manage trust assets on behalf of a <span data-term-id=\"41366782\">beneficiary<\/span>. There are many types of trusts, each with a different purpose.<\/p>\n<p>While a will provides the <span data-term-id=\"41366820\">Surrogate\u2019s Court<\/span> with the <span data-term-id=\"41366834\">decedent<\/span>\u2019s instructions about what to do, a trust-based <span data-term-id=\"41366780\">estate plan<\/span> is designed to minimize the court\u2019s involvement in your estate. This type of trust is commonly known as a <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/revocable-living-trust.html\"><span data-term-id=\"41366798\">revocable<\/span> <span data-term-id=\"41366802\">living trust<\/span><\/a> (RLT) or, in New York, as a \u201c<span data-term-id=\"41366798\">Revocable<\/span> Lifetime Trust\u201d or a \u201c<span data-term-id=\"41366798\">Revocable<\/span> Inter Vivos Trust.\u201d<\/p>\n<p><strong>Essential Elements of a Valid <span data-term-id=\"41366798\">Revocable<\/span> <span data-term-id=\"41366802\">Living Trust<\/span><\/strong><\/p>\n<p>New York has strict requirements for drafting, signing, and funding a valid <span data-term-id=\"41366798\">revocable<\/span> <span data-term-id=\"41366802\">living trust<\/span>. These include:<\/p>\n<ul>\n<li>\n<p><strong>Capacity<\/strong>: Like the testator of a will, the grantor of an RLT must have the legal capacity to make an RLT, including being at least 18 years old and mentally competent<\/p>\n<\/li>\n<li>\n<p><strong>Intent<\/strong>: The trust document must show the grantor\u2019s clear intent to create a trust relationship<\/p>\n<\/li>\n<li>\n<p><strong><span data-term-id=\"41366798\">Revocability<\/span><\/strong>: Unless a lifetime trust specifically states that it is <span data-term-id=\"41366798\">revocable<\/span>, <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-7-1-16\/\" target=\"_blank\" rel=\"noopener\">a trust is assumed to be irrevocable<\/a> under <span data-term-id=\"41366842\">state law<\/span><\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p><strong>A trustee<\/strong>: The trustee holds legal title to the assets, with the designated successor serving as trustee upon the grantor\u2019s <span data-term-id=\"41366859\">incapacity<\/span> or death<\/p>\n<\/li>\n<li>\n<p><strong><span data-term-id=\"41366782\">Beneficiaries<\/span><\/strong>: The trust must identify who benefits from the trust by name<\/p>\n<\/li>\n<li>\n<p><strong>Valid trust purpose<\/strong>: The trust must be created for a <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-7-1-4\/\" target=\"_blank\" rel=\"noopener\">lawful purpose<\/a><\/p>\n<\/li>\n<li>\n<p><strong>Formal <\/strong><a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-7-1-17\/\" target=\"_blank\" rel=\"noopener\"><strong>execution requirements<\/strong><\/a>: The trust must be in writing, signed, and acknowledged by the grantor, and at least one trustee must sign the trust, or it must be signed in the presence of two witnesses who also sign the document<\/p>\n<\/li>\n<li>\n<p><strong>Identifiable trust property<\/strong>: A trust must be \u201c<a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-7-1-18\/\" target=\"_blank\" rel=\"noopener\">funded,<\/a>\u201d meaning assets must be transferred into it (any assets left outside the trust usually must be probated)<\/p>\n<\/li>\n<\/ul>\n<p>Many trusts fail because they are not funded. Consider consulting with an <a href=\"https:\/\/lawyers.findlaw.com\/https:\/\/lawyers.findlaw.com\/estate-planning\/new-york\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41366844\">estate planning<\/span><span data-term-id=\"41366844\"> lawyer<\/span><\/a> about <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/how-do-i-put-money-and-other-assets-in-a-living-trust.html\">the steps to properly fund a trust<\/a>.<\/p>\n<p><strong>Additional Types of Trusts<\/strong><\/p>\n<p>While an RLT is usually the foundation of a trust-based <span data-term-id=\"41366780\">estate plan<\/span> and can meet some <span data-term-id=\"41366862\">tax-planning<\/span> goals, other trusts can work in partnership with your RLT to achieve certain goals. For example, if your <span data-term-id=\"41366780\">estate plan<\/span> strategy includes <span data-term-id=\"41366860\">asset protection<\/span> or <span data-term-id=\"41366806\">Medicaid<\/span> planning, you may need additional trusts. When planning for someone with a disability, a <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/special-needs-trusts-faq-s.html\"><span data-term-id=\"41366836\">special needs trust<\/span><\/a> can ensure their financial needs are met while preserving their eligibility for supplemental assistance programs.<\/p>\n<p><strong>Pros and Cons of a Trust-Based <span data-term-id=\"41366780\">Estate Plan<\/span><\/strong><\/p>\n<p>An RLT is a robust, flexible solution for situations that require it. An RLT-based <span data-term-id=\"41366780\">estate plan<\/span> can help address the needs of blended families, high-net-worth portfolios, family business interests, and more. Some common benefits of an RLT include:<\/p>\n<ul>\n<li><strong>Avoiding <span data-term-id=\"41366781\">probate<\/span><\/strong>: If properly funded, an RLT can help avoid or minimize <span data-term-id=\"41366820\">Surrogate\u2019s Court<\/span> involvement. This can mean lower <span data-term-id=\"41366818\">estate administration<\/span> costs and a faster distribution timeline while keeping the trust terms and distributions out of the public eye.<\/li>\n<li><strong>Built-in <span data-term-id=\"41366859\">incapacity<\/span> planning<\/strong>: As mentioned above, an RLT-based <span data-term-id=\"41366780\">estate plan<\/span> provides some amount of <span data-term-id=\"41366859\">incapacity<\/span> planning, at least with respect to trust assets. The successor trustee steps into service if the grantor-trustee becomes incapacitated.<\/li>\n<li><strong><span data-term-id=\"41366782\">Beneficiary<\/span> protections<\/strong>: Instead of distributing assets outright, an RLT-based plan can protect <span data-term-id=\"41366782\">beneficiaries<\/span> by keeping their assets in continuing trusts with discretionary distribution provisions and spendthrift clauses. In this case, the <span data-term-id=\"41366782\">beneficiary<\/span> doesn\u2019t directly own the trust property, which can help shield it from the <span data-term-id=\"41366782\">beneficiary<\/span>\u2019s creditors, lawsuits, divorce claims, and financial mismanagement. This structure can help preserve family wealth across generations while still supporting <span data-term-id=\"41366782\">beneficiaries<\/span> under controlled conditions.<\/li>\n<\/ul>\n<p>These RLT features come at a cost. An RLT is usually more complex than a will. For this reason, the upfront cost of creating an RLT can be higher. In addition, an RLT requires upkeep. Assets not properly transferred into the trust will likely have to go through <span data-term-id=\"41366781\">probate<\/span>.<\/p>\n<h3><span data-term-id=\"41366859\">Incapacity<\/span> Planning<\/h3>\n<p>As mentioned, a comprehensive <span data-term-id=\"41366780\">estate plan<\/span> includes your instructions on how you want your affairs handled after your death, as well as if you become incapacitated.<\/p>\n<p><strong>Financial Matters<\/strong><\/p>\n<p><span data-term-id=\"41366859\">Incapacity<\/span> planning for financial matters is typically addressed with a <span data-term-id=\"41366824\">Durable <\/span><span data-term-id=\"41366785\">Power of Attorney<\/span>. A <a href=\"https:\/\/codes.findlaw.com\/ny\/general-obligations-law\/gob-sect-5-1513\/\" target=\"_blank\" rel=\"noopener\">statutory short-form <span data-term-id=\"41366824\">Durable <\/span><span data-term-id=\"41366785\">Power of Attorney<\/span><\/a> that meets state requirements often works. A <span data-term-id=\"41366798\">Revocable<\/span> <span data-term-id=\"41366802\">Living Trust<\/span> provides some protection by allowing a successor trustee to manage trust assets during your <span data-term-id=\"41366859\">incapacity<\/span>, but the trustee\u2019s authority is limited to the trust assets.<\/p>\n<p>With a <span data-term-id=\"41366824\">Durable <\/span><span data-term-id=\"41366785\">Power of Attorney<\/span>, you (the \u201cprincipal\u201d) can appoint a trusted person (\u201cagent\u201d) to handle your financial and legal matters if you become incapacitated. This can include banking, <span data-term-id=\"41366789\">real estate<\/span> transactions, tax matters, retirement benefits transactions, investment management, and more.
