We&#8217;ll examine the <span data-term-id=\"39150056\">types of <\/span><span data-term-id=\"39150024\">orders of protection<\/span>, detail what they&#8217;re for, show how to obtain the one you need, and ensure you know how long it&#8217;s in effect. Nobody looks forward to requiring a <span data-term-id=\"39150025\">New York<\/span> protective order, but it&#8217;s good to know about them in case getting one becomes necessary.<\/p>\n<h2><span data-term-id=\"39150025\">New York<\/span> Protective Orders: <span data-term-id=\"39150027\">Domestic Violence<\/span><\/h2>\n<p><span data-term-id=\"39150027\">Domestic violence<\/span> occurs when <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-domestic-violence-laws.html\">abusive crimes such as sexual assault happen between <span data-term-id=\"39150043\">family members<\/span>, household members, a <span data-term-id=\"39150035\">former spouse<\/span>, or those in an <span data-term-id=\"39150030\">intimate relationship<\/span><\/a>. <span data-term-id=\"39150025\">New York<\/span> has <span data-term-id=\"39150024\">orders of protection<\/span> that aim to keep abusers away from their victims. No <span data-term-id=\"39150029\">court order<\/span> can guarantee the victim&#8217;s safety, but the protections and punishments in <span data-term-id=\"39150024\">orders of protection<\/span> help.<\/p>\n<p>Before getting into the different types available, let&#8217;s outline what a <span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150024\">order of protection<\/span> can do. The specifics of each case dictate the protections an order contains. Still, <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-842\/\" target=\"_blank\" rel=\"noopener\">some conditions are common inclusions<\/a>:<\/p>\n<ul>\n<li>Ordering the abuser to refrain from abusing, harassing, threatening, or intimidating you or any other designated people<\/li>\n<li>Ordering the abuser to stay away from your home, workplace, school, and your <span data-term-id=\"39150043\">family members<\/span><\/li>\n<li>Ordering the <span data-term-id=\"39150032\">respondent<\/span> to refrain from committing any harm to household domestic animals<\/li>\n<li>Ordering the <span data-term-id=\"39150032\">respondent<\/span> to surrender all firearms<\/li>\n<li>Ordering the <span data-term-id=\"39150032\">respondent<\/span> into a batterer&#8217;s education program at their expense<\/li>\n<li>Returning any identification papers<\/li>\n<li>Establishing child visitation parameters<\/li>\n<li>Scheduled appointment for the retrieval of personal items<\/li>\n<li>Restitution for any medical expenses stemming from the <span data-term-id=\"39150027\">domestic violence<\/span><\/li>\n<\/ul>\n<p>This is not an exhaustive list, and the court can impose any condition to ensure the victim&#8217;s safety. The objective is to break the cycle of abuse by keeping the abuser out of the victim&#8217;s life. <span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150027\">domestic violence<\/span> <span data-term-id=\"39150024\">orders of protection<\/span> remain in effect nationwide <a href=\"https:\/\/www.hud.gov\/vawa#close\" target=\"_blank\" rel=\"noopener\">under federal law<\/a>.<\/p>\n<p>While they all share the same goal, the <span data-term-id=\"39150024\">orders of protection<\/span> available in <span data-term-id=\"39150025\">New York<\/span> are issued by different courts for specific situations. Let&#8217;s take a look at each of them.<\/p>\n<h3><span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150055\">Criminal <\/span><span data-term-id=\"39150029\">Court<\/span> <span data-term-id=\"39150024\">Order<\/span><span data-term-id=\"39150055\"> of Protection<\/span><\/h3>\n<p>When a victim of domestic abuse files for an <span data-term-id=\"39150046\">order of protection<\/span><span data-term-id=\"39150046\"> from<\/span> an abuser, they&#8217;ll do so in <span data-term-id=\"39150026\">Family Court<\/span>. If an abuser is arrested for a <span data-term-id=\"39150027\">domestic violence<\/span> crime like <span data-term-id=\"39150048\">sexual abuse<\/span>, <a href=\"https:\/\/www.nycourts.gov\/CourtHelp\/Safety\/differences.shtml\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"39150024\">order of protection<\/span> is handled in <span data-term-id=\"39150028\">Criminal Court<\/span> instead<\/a>. Either <span data-term-id=\"39150045\">law enforcement<\/span> or a <span data-term-id=\"39150037\">district attorney<\/span> will file the petition.<\/p>\n<p>A <strong><span data-term-id=\"39150055\">Criminal <\/span><span data-term-id=\"39150029\">Court<\/span> <span data-term-id=\"39150024\">Order<\/span><span data-term-id=\"39150055\"> of Protection<\/span><\/strong> can also be filed by <span data-term-id=\"39150045\">law enforcement<\/span> on behalf of the victim if <span data-term-id=\"39150026\">Family Court<\/span> is closed. <a href=\"https:\/\/ww2.nycourts.gov\/courts\/1jd\/supctmanh\/Emergency-Aps.shtml\" target=\"_blank\" rel=\"noopener\">Some districts have a provision in place<\/a> that allows a victim to file an emergency motion.<\/p>\n<p>Once a criminal <span data-term-id=\"39150024\">order of protection<\/span> petition is filed, it&#8217;s out of the victim&#8217;s hands. Even if they don&#8217;t want a protective order or to file charges, the state becomes the plaintiff after an arrest and continues with or without the victim.<\/p>\n<p>Once a judge approves <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-828\/\" target=\"_blank\" rel=\"noopener\">the order, it goes into effect<\/a>. The duration the order remains in place depends on the class of crime committed. These <a href=\"https:\/\/codes.findlaw.com\/ny\/criminal-procedure-law\/cpl-sect-530-12\/\" target=\"_blank\" rel=\"noopener\">terms changed as of September 1st, 2025<\/a>:<\/p>\n<p><strong>Before September 1st, 2025<\/strong>:<\/p>\n<ul>\n<li><u>Felony<\/u>: Up to eight years<\/li>\n<li><u>Class A misdemeanor<\/u>: Up to five years<\/li>\n<li><u>Other charges<\/u>: Up to two years<\/li>\n<\/ul>\n<p><strong>After September 1st, 2025<\/strong>:<\/p>\n<ul>\n<li><u>Felony<\/u>: Up to five years<\/li>\n<li><u>Class A misdemeanor<\/u>: Up to three years<\/li>\n<li><u>Other charges<\/u>: Up to one year<\/li>\n<\/ul>\n<p>These can be delayed by incarceration. If the court believes the threat remains, the order can become permanent.<\/p>\n<h3><span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150027\">Domestic Violence<\/span> Temporary Ex Parte <span data-term-id=\"39150024\">Order of Protection<\/span><\/h3>\n<p>The victim (petitioner) <a href=\"https:\/\/ww2.nycourts.gov\/COURTS\/nyc\/family\/faqs_domesticviolence.shtml\" target=\"_blank\" rel=\"noopener\">begins the process<\/a> of gaining a protective order by filing for a <strong>Temporary Ex Parte <span data-term-id=\"39150059\">Order of Protection<\/span><\/strong><span data-term-id=\"39150059\"> in <\/span><span data-term-id=\"39150026\">Family Court<\/span>. The <span data-term-id=\"39150039\">family offense petition<\/span> is filled out either <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/FORMS\/familycourt\/pdfs\/8-2.pdf\" target=\"_blank\" rel=\"noopener\">in person at a courthouse<\/a> or through a <a href=\"https:\/\/www.nyscadv.org\/program-directory.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39150027\">domestic violence<\/span> advocate<\/a>. Once <a href=\"https:\/\/ww2.nycourts.gov\/forms\/familycourt\/domesticviolence.shtml\" target=\"_blank\" rel=\"noopener\">the forms<\/a> are filed, a judge decides whether there&#8217;s\u00a0<span data-term-id=\"39150051\">good cause<\/span>\u00a0to issue the order. They can ask the petitioner questions, but the abuser (<span data-term-id=\"39150032\">respondent<\/span>) is not contacted at this stage.<\/p>\n<p>Once issued, the temporary order protections go into immediate effect. They last until the case hearing. The <span data-term-id=\"39150032\">respondent<\/span> must be served, which the\u00a0<span data-term-id=\"39150052\">protected person<\/span> cannot do. <a href=\"https:\/\/ww2.nycourts.gov\/COURTS\/nyc\/family\/faqs_domesticviolence.shtml#op10\" target=\"_blank\" rel=\"noopener\">Either the sheriff&#8217;s department or local <span data-term-id=\"39150045\">law enforcement<\/span><\/a> can serve the <span data-term-id=\"39150032\">respondent<\/span>.<\/p>\n<h3><span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150027\">Domestic Violence<\/span> <span data-term-id=\"39150034\">Final <\/span><span data-term-id=\"39150024\">Order of Protection<\/span><\/h3>\n<p>At the case hearing, <a href=\"https:\/\/ww2.nycourts.gov\/COURTS\/nyc\/family\/faqs_domesticviolence.shtml#op16\" target=\"_blank\" rel=\"noopener\">both sides will meet with a court attorney to determine if they can agree<\/a> on a <strong><span data-term-id=\"39150034\">Final <\/span><span data-term-id=\"39150024\">Order of Protection<\/span>. <\/strong>If not, they&#8217;ll go before the judge to give their arguments, present evidence, and call witnesses. It can take multiple <span data-term-id=\"39150044\">court appearances<\/span> before a decision is rendered.<\/p>\n<p>If the judge decides that a final order is necessary, it takes effect after the trial. Amendments and additions to the temporary order&#8217;s conditions are permitted and can include child visitation rights, spousal support, and reimbursement for attorney&#8217;s fees. If child custody or support is involved, <a href=\"https:\/\/opdv.ny.gov\/orders-protection#:~:text=A%20temporary%20order%20of%20protection%20will%20last%20at%20least%20until,last%20up%20to%205%20years.\" target=\"_blank\" rel=\"noopener\">the order lasts for up to two years<\/a>. <span data-term-id=\"39150057\">Aggravating circumstances<\/span> can increase the duration to five years.<\/p>\n<h3><span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150027\">Domestic Violence<\/span> <span data-term-id=\"39150024\">Order of Protection<\/span> During Divorce Proceedings<\/h3>\n<p>During divorce proceedings, the <span data-term-id=\"39150025\">New York<\/span> <span data-term-id=\"39150038\">Supreme Court<\/span> can <a href=\"https:\/\/codes.findlaw.com\/ny\/domestic-relations-law\/dom-sect-240\/\" target=\"_blank\" rel=\"noopener\">issue an <span data-term-id=\"39150024\">order of protection<\/span> to protect the victim<\/a> and their family. This order can become part of the final divorce decree and be made permanent. This affects child custody decisions and may require visitation boundaries. The court&#8217;s primary focus is the child&#8217;s best interests.<\/p>\n<h2><span data-term-id=\"39150025\">New York<\/span> Protective Orders: Extreme Risk<\/h2>\n<p>Also known as a red flag law, an <strong>Extreme Risk Protective Order (ERPO) <\/strong>exists to <a href=\"https:\/\/www.nycourts.gov\/CourtHelp\/Safety\/ERPOindex.shtml\" target=\"_blank\" rel=\"noopener\">take firearms away from someone considered to be a high risk<\/a> to both themselves and others. Unlike the other <span data-term-id=\"39150024\">orders of protection<\/span> in <span data-term-id=\"39150025\">New York<\/span>, an ERPO isn&#8217;t designed to keep someone away from others. Its narrow scope is focused on removing firearms from a person considered volatile and dangerous.<\/p>\n<p>Petitioners may be\u00a0<a href=\"https:\/\/www.nycourts.gov\/CourtHelp\/Safety\/ERPOabout.shtml\" target=\"_blank\" rel=\"noopener\">family or household members,\u00a0<span data-term-id=\"39150045\">law enforcement<\/span> officers<\/a><a href=\"https:\/\/www.nycourts.gov\/CourtHelp\/Safety\/ERPOabout.shtml\" target=\"false\" rel=\"noopener\">, or school officials<\/a>. A judge will decide on the same day the petition is filed. If the temporary ERPO is issued, <span data-term-id=\"39150045\">law enforcement<\/span> will serve the <span data-term-id=\"39150032\">respondent<\/span> and remove their firearms. A <span data-term-id=\"39150040\">court date<\/span> is scheduled for between three and ten days from the issuance.<\/p>\n<p>At the hearing, both sides will present their cases. If the judge deems the <span data-term-id=\"39150032\">respondent<\/span> still dangerous, <a href=\"https:\/\/www.nycourts.gov\/CourtHelp\/Safety\/ERPOabout.shtml\" target=\"_blank\" rel=\"noopener\">the order becomes final, lasts up to a year, and is extendable<\/a>. Once the order expires, the <span data-term-id=\"39150032\">respondent<\/span> can file to recover their firearms.<\/p>\n<h2><span data-term-id=\"39150025\">New York<\/span> Protective Orders: Penalties for Violations<\/h2>\n<p>Protective orders aren&#8217;t foolproof, but the protections they offer are backed with penalties. Either violating a condition or failing to fulfill a requirement of an <span data-term-id=\"39150024\">order of protection<\/span> is considered <a href=\"https:\/\/codes.findlaw.com\/ny\/family-court-act\/fct-sect-846\/\" target=\"_blank\" rel=\"noopener\">contempt of court<\/a>. This carries a penalty of up to six months in jail and affects any custody decisions. Victims can notify either <span data-term-id=\"39150026\">Family Court<\/span> or <span data-term-id=\"39150028\">Criminal Court<\/span> when violations occur.<\/p>\n<p><span data-term-id=\"39150025\">New York<\/span>&#8216;s <a href=\"https:\/\/www.nycourts.gov\/CourtHelp\/Safety\/criminalDVcases.shtml\" target=\"_blank\" rel=\"noopener\">mandatory arrest<\/a> stance means that <span data-term-id=\"39150045\">law enforcement<\/span> is required to arrest an abuser for any violation of an <span data-term-id=\"39150024\">order of protection<\/span>, even if they don&#8217;t witness it.
