In a will, a <span data-term-id=\"58629943\">testator<\/span> names <span data-term-id=\"58629946\">beneficiaries<\/span>, appoints an executor, and names guardians for <span data-term-id=\"58629956\">minor children<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<div><p>Your <span data-term-id=\"58629958\">last will and testament<\/span>, or \u201cwill,\u201d is a <span data-term-id=\"58629974\">legal document<\/span> that tells your survivors how you want your estate given away after your death. Your estate is the assets you own, such as <span data-term-id=\"58629973\">real estate<\/span>, <span data-term-id=\"58629957\">personal property<\/span>, financial accounts, retirement accounts, vehicles, and so on. With a <span data-term-id=\"58629940\">valid will<\/span>, you decide who inherits your assets, who you nominate as guardian for your <span data-term-id=\"58629956\">minor children<\/span>, and who will administer your estate.<\/p>\n<p>A will gives you control over these important decisions. Without one, the court applies <span data-term-id=\"58629948\">state laws<\/span> to make them for you. In addition, a will can promote peace and understanding among your <span data-term-id=\"58629953\">family members<\/span> and <span data-term-id=\"58629966\">loved ones<\/span>, a generous gift at a difficult time in their lives. This article discusses how to make a <span data-term-id=\"58629940\">valid will<\/span> in <span data-term-id=\"58629938\">New York<\/span>, the <span data-term-id=\"58629955\">probate<\/span><span data-term-id=\"58629955\"> process<\/span>, the pros and cons of a will-based <span data-term-id=\"58629939\">estate plan<\/span>, and some of the unique features of <span data-term-id=\"58629949\">New York<\/span><span data-term-id=\"58629949\"> will<\/span> law.<\/p>\n<h2>Requirements of a <span data-term-id=\"58629940\">Valid Will<\/span> in <span data-term-id=\"58629938\">New York<\/span><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-wills-laws.html\"><span data-term-id=\"58629942\">New York<\/span><span data-term-id=\"58629942\"> law<\/span><\/a> does not provide a statutory will form, but it does detail exactly how a will must be signed and witnessed. For a will to be valid, <span data-term-id=\"58629975\">New Yorkers<\/span> must follow these <span data-term-id=\"58629982\">formal requirements<\/span>, sometimes referred to as the \u201csigning ceremony,\u201d as well as other statutory requirements.<\/p>\n<p>A person must have <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-3-1-1\/\" target=\"_blank\" rel=\"noopener\">legal capacity<\/a> to make a will in the <span data-term-id=\"58629960\">state of <\/span><span data-term-id=\"58629938\">New York<\/span>. This includes being at least 18 <span data-term-id=\"58629971\">years old<\/span> and of <span data-term-id=\"58629944\">sound mind<\/span> and memory. Except for holographic and <span data-term-id=\"58629978\">nuncupative<\/span> wills, a will must be a <span data-term-id=\"58629950\">written document<\/span> and meet specific <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-3-2-1\/\" target=\"_blank\" rel=\"noopener\">execution and attestation requirements<\/a>. This means the written will must be:<\/p>\n<ul>\n<li>Signed by the <span data-term-id=\"58629943\">testator<\/span> (the person making the will) or at the <span data-term-id=\"58629943\">testator<\/span>\u2019s direction at the end of the document (a person signing for the <span data-term-id=\"58629943\">testator<\/span> doesn\u2019t count as a witness, but must also sign the will and should include their address)<\/li>\n<li>The <span data-term-id=\"58629943\">testator<\/span> must state to each witness that the document is their will<\/li>\n<li>Two attesting witnesses must sign the <span data-term-id=\"58629943\">testator<\/span>\u2019s signature or acknowledgment (this may be done separately, but both must occur within a 30-day window)<\/li>\n<\/ul>\n<p><span data-term-id=\"58629942\">New York<\/span><span data-term-id=\"58629942\"> law<\/span> requires witnesses for a <span data-term-id=\"58629940\">valid will<\/span>, but not a <span data-term-id=\"58629963\">notary<\/span>. Including a notarized <a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1406\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58629985\">self-proving affidavit<\/span> with your will<\/a> can make <span data-term-id=\"58629941\">probate<\/span> easier because the witnesses to the will may not be required to testify in court. This simple step can save time and money during the <span data-term-id=\"58629955\">probate<\/span><span data-term-id=\"58629955\"> process<\/span>.<\/p>\n<h3><span data-term-id=\"58629972\">Holographic Wills<\/span> and <span data-term-id=\"58629978\">Nuncupative<\/span> Wills<\/h3>\n<p><span data-term-id=\"58629942\">New York<\/span><span data-term-id=\"58629942\"> law<\/span> recognizes holographic (handwritten, not witnessed) and <span data-term-id=\"58629978\">nuncupative<\/span> (oral, witnessed by at least two people) wills, but only under specific circumstances. For example, a <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-3-2-2\/\" target=\"_blank\" rel=\"noopener\">holographic or <span data-term-id=\"58629978\">nuncupative<\/span> will<\/a> may be valid if it\u2019s written or declared by a member of the United States <span data-term-id=\"58629970\">Armed Forces<\/span> while serving during a war.<\/p>\n<h2>The <span data-term-id=\"58629955\">Probate<\/span><span data-term-id=\"58629955\"> Process<\/span> for a Will-Based <span data-term-id=\"58629939\">Estate Plan<\/span><\/h2>\n<p>Even with a will in place, your estate must go through the <span data-term-id=\"58629955\">probate<\/span><span data-term-id=\"58629955\"> process<\/span>. This is the court-supervised process for transferring a decedent\u2019s property. Of note, <span data-term-id=\"58629945\">New York<\/span><span data-term-id=\"58629945\"> state<\/span> uses the term <span data-term-id=\"58629984\">Surrogate\u2019s Court<\/span> rather than <span data-term-id=\"58629986\">probate<\/span><span data-term-id=\"58629986\"> court<\/span>. The county-based <span data-term-id=\"58629984\">Surrogate\u2019s Courts<\/span> oversee the process for distributing the decedent\u2019s assets, applying the <span data-term-id=\"58629938\">New York<\/span> Surrogate\u2019s Procedure Act and the <span data-term-id=\"58629976\">New York<\/span><span data-term-id=\"58629976\"> Estates<\/span>, Powers, and Trusts Law.<\/p>\n<p>The process begins with a petition by someone (an executor, a\u00a0<span data-term-id=\"58629953\">family member<\/span>, or an\u00a0interested person) asking the court to open the estate. If you die \u201ctestate\u201d (with a will), the <span data-term-id=\"58629955\">probate<\/span><span data-term-id=\"58629955\"> process<\/span> may include:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1408\/\" target=\"_blank\" rel=\"noopener\">Validating the will<\/a><\/li>\n<li>Appointing the executor<\/li>\n<li>Issuing \u201c<a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1412\/\" target=\"_blank\" rel=\"noopener\">Letters Testamentary<\/a>\u201d<\/li>\n<li>Notifying interested persons<\/li>\n<li>Collecting and valuing your \u201c<span data-term-id=\"58629941\">probate<\/span> assets\u201d<\/li>\n<li>Notifying creditors<\/li>\n<li>Paying all debts, including taxes<\/li>\n<li>Distributing the remaining property to your named <span data-term-id=\"58629946\">beneficiaries<\/span> according to the will<\/li>\n<li>Closing the estate<\/li>\n<\/ul>\n<p>Your <span data-term-id=\"58629941\">probate<\/span> assets are the assets you own that do not have a built-in transfer mechanism. Assets that transfer automatically at death, such as life insurance policies with a named <span data-term-id=\"58629946\">beneficiary<\/span>, homes owned jointly with right of survivorship, and bank accounts with a payable-on-death designation, usually pass without going through <span data-term-id=\"58629941\">probate<\/span>.<\/p>\n<p>If you die \u201c<a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/what-happens-if-i-die-without-a-will.html\"><span data-term-id=\"58629977\">intestate<\/span><\/a>\u201d (without a will), the <span data-term-id=\"58629962\">intestacy<\/span> <span data-term-id=\"58629955\">probate<\/span><span data-term-id=\"58629955\"> process<\/span> is similar. The court appoints an \u201cadministrator\u201d (by <a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1001\/\" target=\"_blank\" rel=\"noopener\">statutory priority<\/a>) rather than an \u201cexecutor\u201d and issues \u201cLetters of Administration\u201d rather than \u201cLetters Testamentary.\u201d After all debts are paid, the Administrator distributes any remaining assets under <span data-term-id=\"58629938\">New York<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-4-1-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58629977\">intestate<\/span> distribution law<\/a>.<\/p>\n<h2>Pros and Cons of a Will-Based <span data-term-id=\"58629939\">Estate Plan<\/span><\/h2>\n<p>A thorough <a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/estate-planning-basics.html\"><span data-term-id=\"58629939\">estate plan<\/span><\/a> includes all the <span data-term-id=\"58629974\">legal documents<\/span> that work together to express your wishes. This often includes incapacity planning (durable <span data-term-id=\"58629961\">power of attorney<\/span> for financial matters, a living will, and a healthcare proxy). An <span data-term-id=\"58629939\">estate plan<\/span> is usually will-based or revocable <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/living-trust-information.html\"><span data-term-id=\"58629968\">living trust<\/span><\/a>-based.<\/p>\n<p>A will-based <span data-term-id=\"58629939\">estate plan<\/span> often meets the needs of many estates and often has a lower upfront cost than a <span data-term-id=\"58629968\">living trust<\/span>-based plan. Unlike a trust-based plan, there is no need to retitle assets during your lifetime, but it only takes effect upon your death. It doesn\u2019t include baked-in incapacity planning as a trust-based plan does. The will must be probated, which can add time and expense to the distribution process.<\/p>\n<p>The <span data-term-id=\"58629955\">probate<\/span><span data-term-id=\"58629955\"> process<\/span> of a will is usually public, meaning creditors and others can often access sensitive information, including who is getting what under your will. By contrast, a trust-based <span data-term-id=\"58629939\">estate plan<\/span> usually avoids <span data-term-id=\"58629941\">probate<\/span>.<\/p>\n<h2>Special Considerations for <span data-term-id=\"58629975\">New Yorkers<\/span><\/h2>\n<p>While <span data-term-id=\"58629939\">estate planning<\/span> basics are similar across all 50 states, each state has its own nuanced specific <span data-term-id=\"58629948\">state laws<\/span>. Some considerations important to <span data-term-id=\"58629939\">estate planning<\/span> in <span data-term-id=\"58629938\">New York<\/span> are:<\/p>\n<ul>\n<li><strong>Spousal right of election<\/strong>: A <span data-term-id=\"58629943\">testator<\/span> cannot completely disinherit a surviving spouse. Under <span data-term-id=\"58629942\">New York<\/span><span data-term-id=\"58629942\"> Law<\/span>, a surviving spouse can elect to take their <a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-5-1-1-a\/\" target=\"_blank\" rel=\"noopener\">statutory share<\/a> of their deceased spouse\u2019s estate. This is typically $50,000 or one-third of the net estate, whichever is greater.<\/li>\n<li><strong><span data-term-id=\"58629976\">New York<\/span> <span data-term-id=\"58629983\">Estate<\/span><span data-term-id=\"58629983\"> tax<\/span><\/strong>: Larger estates may be subject to <span data-term-id=\"58629976\">New York<\/span> <a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/state-laws-estate-taxes.html\"><span data-term-id=\"58629983\">estate<\/span><span data-term-id=\"58629983\"> tax<\/span><\/a>. This often has a lower threshold than the federal <span data-term-id=\"58629983\">estate tax<\/span>.<\/li>\n<li><strong>Statutory fiduciary compensation<\/strong>: <span data-term-id=\"58629942\">New York<\/span><span data-term-id=\"58629942\"> law<\/span> sets the commissions payable to <a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-2307\/\" target=\"_blank\" rel=\"noopener\">executors<\/a>. Larger estates may be subject to significant administrative fees.<\/li>\n<li><strong>Small estates<\/strong>: A <a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1304\/\" target=\"_blank\" rel=\"noopener\">summary procedure<\/a>, rather than full formal <span data-term-id=\"58629941\">probate<\/span>, may be available for smaller estates. Smaller estates are defined as those with\u00a0<a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1301\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58629957\">personal property<\/span> valued at $50,000 or less<\/a>. If a decedent owns <a href=\"https:\/\/codes.findlaw.com\/ny\/surrogates-court-procedure-act\/scp-sect-1302\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58629973\">real estate<\/span> but $50,000 or less in <span data-term-id=\"58629957\">personal property<\/span><\/a>, the <span data-term-id=\"58629957\">personal property<\/span> may still pass under the summary procedure.<\/li>\n<\/ul>\n<p>Creating an <span data-term-id=\"58629939\">estate plan<\/span> can be challenging. There\u2019s no shame in speaking with an <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/new-york\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58629967\">estate planning<\/span><span data-term-id=\"58629967\"> attorney<\/span><\/a> if you have questions or concerns.<\/p>\n<h2>When To Meet With a <span data-term-id=\"58629976\">New York<\/span> <span data-term-id=\"58629939\">Estate<\/span><span data-term-id=\"58629939\"> Planning<\/span> Lawyer<\/h2>\n<p>The <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/how-to-make-a-new-york-will-faq.html\"><span data-term-id=\"58629954\">legal requirements<\/span> for a <span data-term-id=\"58629940\">valid will<\/span><\/a> in <span data-term-id=\"58629938\">New York<\/span> are quite specific.
