Under North Carolina state law, it\u2019s against the law to possess, produce, receive, or transport <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/child-pornography.html\">child pornography<\/a><span style=\"font-size: 0.8125rem; font-weight: normal;\">. Lawmakers in North Carolina treat this sex crime as a form of <\/span><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/crimes-against-children.html\">child sexual exploitation<\/a><span style=\"font-size: 0.8125rem; font-weight: normal;\">.<\/span><\/p>\r\n<p>Many child pornography cases involve cell phones, the internet, and social media. For example, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/sexting.html\">sexting<\/a>, the act of trading naked pictures on a cell phone, is against the law when a minor is involved.<\/p>\r\n<h2><b>Most Child Pornography Crimes Are Felonies in North Carolina<\/b><\/h2>\r\n<p>Almost all sex crimes involving minors are felonies in North Carolina. North Carolina law deems the following activities felonies:<\/p>\r\n<ul>\r\n<li><b>First-degree<\/b> production of pornography is a Class C felony carrying a 44- to 92-month prison sentence, fines, and mandatory reporting to the sex offender registry<\/li>\r\n<li><b>Second-degree<\/b> (copying or distributing) is a Class E felony sex offense with a penalty of 15 to 31 months in jail<\/li>\r\n<li><b>Third-degree<\/b> possession of child pornography is a Class H felony, with a four-to-eight-month prison sentence<\/li>\r\n<\/ul>\r\n<p>If the offender has prior convictions for child porn, or if the visual depictions involve violence or sexual abuse, harsher penalties are levied.<\/p>\r\n<p>Most convictions on child pornography charges require registration on the <a href=\"https:\/\/www.offenderwatch.com\/network\/north-carolina\" target=\"_blank\" rel=\"noopener\">North Carolina Sex Offender list<\/a>.
