These criminal laws, DVPO restraining orders, and Class A1 misdemeanor to felony domestic violence charges carry serious penalties, including jail time, fines, firearm surrender, and long\u2011term criminal consequences under the current North Carolina domestic violence law.<\/p>\n\n    <\/div>\n\n\n\n<p>Nobody wants to think about experiencing <span data-term-id=\"39010986\">domestic violence<\/span>, but knowing your options ahead of time can be a tremendous help. In this article, we&#8217;ll explain <span data-term-id=\"39010987\">North Carolina<\/span>&#8216;s definition of <span data-term-id=\"39010986\">domestic violence<\/span>, alert you to the <a href=\"https:\/\/www.nccourts.gov\/help-topics\/domestic-violence\/how-to-get-a-protection-order\" target=\"_blank\" rel=\"noopener\"><u>protections and programs available for victims<\/u><\/a>, and prepare you for navigating the legal system. Read on for a better understanding of <span data-term-id=\"39011001\">domestic violence<\/span><span data-term-id=\"39011001\"> laws<\/span> in <span data-term-id=\"39010987\">North Carolina<\/span>.<\/p>\n<h2><span data-term-id=\"39010987\">North Carolina<\/span> <span data-term-id=\"39011001\">Domestic Violence<\/span><span data-term-id=\"39011001\"> Laws<\/span>: The Basics<\/h2>\n<p>For a crime to have <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\"><span data-term-id=\"39010986\">domestic violence<\/span><\/a> status in <span data-term-id=\"39010987\">North Carolina<\/span>, two elements are required. Certain crimes committed by certain people equal domestic abuse. Let&#8217;s take a closer look at each aspect.<\/p>\n<h3><span data-term-id=\"39010986\">Domestic Violence<\/span> in <span data-term-id=\"39010987\">North Carolina<\/span>: <span data-term-id=\"39010990\">Personal Relationships<\/span><\/h3>\n<p>There is no such thing as a <span data-term-id=\"39010986\">domestic violence<\/span> crime between strangers. <span data-term-id=\"39010986\">Domestic violence<\/span> offenses involve familiarity between the participants, referred to as a <span data-term-id=\"39010990\">personal relationship<\/span>. While a common perception of <span data-term-id=\"39010986\">domestic violence<\/span> is that of <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\"><u>physical assault between spouses<\/u><\/a>, the list of potential abusers and victims is far more extensive.<\/p>\n<p>While the name suggests sharing a home, that&#8217;s not a requirement for all eligible relationships. If a qualifying abusive act is involved, people <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-1.html\" target=\"_blank\" rel=\"noopener\"><u>sharing one of the following relationships<\/u><\/a> can engage in a <span data-term-id=\"39010986\">domestic violence<\/span> crime:<\/p>\n<ul>\n<li>Spouses or <span data-term-id=\"39010992\">former spouses<\/span><\/li>\n<li>People with a child in common<\/li>\n<li>Parents and children (minor children must be over the age of 16 to have a <span data-term-id=\"39010997\">DVPO<\/span> against them)<\/li>\n<li>Grandparents and grandchildren<\/li>\n<li>People dating one another<\/li>\n<li>People who have dated one another<\/li>\n<li>People of <span data-term-id=\"39011008\">opposite sexes<\/span> who live together or have lived together<\/li>\n<li>Current or former <span data-term-id=\"39011009\">household members<\/span><\/li>\n<li>Guardians and stepparents of children<\/li>\n<\/ul>\n<p>Same\u2011sex partners may be eligible if they fit into one of the listed categories (such as spouses, <span data-term-id=\"39010992\">former spouses<\/span>, having lived together, or having a child in common), and there are ongoing constitutional challenges to the exclusion of same\u2011sex dating partners.<\/p>\n<p>A crime that lacks a qualifying relationship is still a crime and remains subject to prosecution. The same protections aren&#8217;t available, but non-<span data-term-id=\"39010986\">domestic violence<\/span> victims <a href=\"https:\/\/www.nccourts.gov\/documents\/forms\/complaint-for-no-contact-order-for-stalking-or-nonconsensual-sexual-conduct\" target=\"_blank\" rel=\"noopener\"><u>have options as well<\/u><\/a>.<\/p>\n<h3><span data-term-id=\"39010986\">Domestic Violence<\/span> in <span data-term-id=\"39010987\">North Carolina<\/span>: Abusive Acts<\/h3>\n<p><span data-term-id=\"39010986\">Domestic violence<\/span> offenses focus on <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\"><u>gaining and maintaining power and control<\/u><\/a> over the victim. An abuser wants to dominate every aspect of their victim&#8217;s life. This is accomplished through different <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\"><u>types of <span data-term-id=\"39010986\">domestic violence<\/span><\/u><\/a> that range from coercion to financial abuse.<\/p>\n<p>Through a cycle of fear, abuse, intimidation, and violence, abusers attempt to keep their victims helpless and hopeless. The following categories cover <a href=\"https:\/\/nccadv.org\/domestic-violence-information\/\" target=\"_blank\" rel=\"noopener\"><u>abusive acts considered <span data-term-id=\"39010986\">domestic violence<\/span><\/u><\/a> in <span data-term-id=\"39010987\">North Carolina<\/span> if certain people are involved:<\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Causing a bodily injury on purpose<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Attempting to cause a bodily injury<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Any sexual offense, including:<\/span>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Rape<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Sexual assault<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Statutory rape<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Causing fear of imminent serious bodily injury<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Causing fear by continued harassment that inflicts substantial emotional distress on the victim<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Torment<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.loveisrespect.org\/resources\/types-of-abuse\/\" target=\"_blank\" rel=\"noopener\"><u>Threatening behavior<\/u><\/a> is considered as much of a <span data-term-id=\"39010986\">domestic violence<\/span> crime as any physical assault or <span data-term-id=\"39011035\">sexual offense<\/span>. For example, leaving notes for a victim detailing punishments for anything the abuser disapproves of is <span data-term-id=\"39010986\">domestic violence<\/span>. The abuser doesn&#8217;t have to follow through. The threat is enough.<\/p>\n<p><span data-term-id=\"39010987\">North Carolina<\/span> doesn&#8217;t have separate criminal offenses for <span data-term-id=\"39011003\">acts of <\/span><span data-term-id=\"39010986\">domestic violence<\/span>. However, prior convictions can affect sentences. Victims also gain access to <span data-term-id=\"39010989\">domestic violence<\/span><span data-term-id=\"39010989\"> protective orders<\/span> (<span data-term-id=\"39010997\">DVPO<\/span>) and other specific programs. Crimes committed in violation of a <span data-term-id=\"39010997\">DVPO<\/span> may be subject to <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-4-1\/\" target=\"_blank\" rel=\"noopener\"><u>enhanced penalties<\/u><\/a>.<\/p>\n<h2><span data-term-id=\"39010987\">North Carolina<\/span> <span data-term-id=\"39011001\">Domestic Violence<\/span><span data-term-id=\"39011001\"> Laws<\/span>: Protective Orders and Violations<\/h2>\n<p>Having an abuser imprisoned offers maximum safety for a victim, but that might not be available or only serve as a temporary relief. <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-2\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39010987\">North Carolina<\/span> <span data-term-id=\"39010989\">domestic violence<\/span><span data-term-id=\"39010989\"> protective orders<\/span> (<span data-term-id=\"39010997\">DVPOs<\/span>)<\/u><\/a> offer a means of shielding victims through deterrence. The court orders aren&#8217;t perfect, as an abuser can choose to ignore them. <span data-term-id=\"39010993\">Restraining orders<\/span> in <span data-term-id=\"39010987\">North Carolina<\/span> carry serious penalties, so they do so at their peril.<\/p>\n<p>If you&#8217;ve suffered domestic abuse or are in fear of imminent domestic abuse, call 911. <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-5\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39011019\">Law enforcement<\/span> personnel receive special training<\/u><\/a> for domestic calls. This includes informing the victim of local shelters, explaining important <span data-term-id=\"39010986\">domestic violence<\/span> services, and supplying transportation if needed.<\/p>\n<p>Also known as a <span data-term-id=\"39011031\">50B Order<\/span>, a <span data-term-id=\"39010997\">DVPO<\/span> tells abusers what they can and cannot do concerning their victims. While the basic process to apply for a <span data-term-id=\"39010997\">DVPO<\/span> is similar, some courts in <span data-term-id=\"39010987\">North Carolina<\/span> separate the criminal and civil aspects of <span data-term-id=\"39010999\">domestic violence<\/span><span data-term-id=\"39010999\"> cases<\/span> and orders. There are also differences in emergency orders. <a href=\"https:\/\/www.nccourts.gov\/locations\" target=\"_blank\" rel=\"noopener\"><u>Check with your local courthouse<\/u><\/a> to see how your county handles it.<\/p>\n<p>You (plaintiff) can file for a <span data-term-id=\"39010997\">DVPO<\/span> through a <a href=\"https:\/\/nccadv.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39010986\">domestic violence<\/span> advocate<\/u><\/a> or at your courthouse. <a href=\"https:\/\/www.nccourts.gov\/documents\/forms\/instructions-for-domestic-violence-forms\" target=\"_blank\" rel=\"noopener\"><u>Forms are available online<\/u><\/a> for you to complete in advance. Some counties have a magistrate to contact for emergency orders if the court is closed. Check with your <span data-term-id=\"39010986\">domestic violence<\/span> advocate. If not, call 911 if you&#8217;re in danger.<\/p>\n<p>Whether in person at the courthouse or via video conferencing through an advocate, your petition is reviewed by a judge or a magistrate. They may have questions for you. If the court agrees that <span data-term-id=\"39010986\">domestic violence<\/span> has occurred or is a threat, an <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-2\/\" target=\"_blank\" rel=\"noopener\"><u>ex parte temporary protective order is issued<\/u><\/a>. Ex parte means that the court doesn&#8217;t need to speak with your abuser (defendant) before issuing the order.<\/p>\n<p>The temporary <span data-term-id=\"39010997\">DVPO<\/span> goes into effect once the defendant is served with the order. This is usually done by the sheriff&#8217;s department, but check with your advocate\/court. It lasts for either 10 days total, seven days from when it&#8217;s served, or until your full court hearing. The <span data-term-id=\"39010997\">DVPO<\/span> will <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-3\/\" target=\"_blank\" rel=\"noopener\"><u>contain provisions tailored to your case<\/u><\/a>. Some common conditions include:<\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Ordering the defendant (abuser) to cease:<\/span>\n<ul>\n<li style=\"list-style-type: none\">\n<ul style=\"list-style-type: circle\">\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Abusing the plaintiff<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Following the plaintiff<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Threatening the plaintiff<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Harassing the plaintiff<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400\">Ordering a party to surrender all firearms for the duration of the order<\/span><\/li>\n<li><span style=\"font-weight: 400\">Ordering the defendant to obey a no-contact order with the plaintiff<\/span><\/li>\n<li><span style=\"font-weight: 400\">Ordering the defendant to vacate a shared residence and not return<\/span><\/li>\n<li><span style=\"font-weight: 400\">Ordering the defendant to provide the plaintiff with a suitable alternate residence<\/span><\/li>\n<li><span style=\"font-weight: 400\">Awarding temporary custody of minor children and establishing temporary visitation rights<\/span><\/li>\n<li><span style=\"font-weight: 400\">Ordering payments for the support of a minor child<\/span><\/li>\n<li><span style=\"font-weight: 400\">Ordering spousal support payments<\/span><\/li>\n<li><span style=\"font-weight: 400\">Determining possession of personal property of the parties<\/span><\/li>\n<li><span style=\"font-weight: 400\">Determining custody of any shared domestic animals<\/span><\/li>\n<li><span style=\"font-weight: 400\">Forbidding the defendant from abusing or harming any formerly shared domestic animals<\/span><\/li>\n<li><span style=\"font-weight: 400\">Awarding attorney&#8217;s fees to either party<\/span><\/li>\n<li><span style=\"font-weight: 400\">Ordering the defendant to attend and complete an approved abuser treatment program<\/span><\/li>\n<\/ul>\n<p>This is not an exhaustive list, and not all provisions are used on every <span data-term-id=\"39010997\">DVPO<\/span>. For example, people who are only dating won&#8217;t need a custody ruling.<\/p>\n<p>If the defendant chooses to oppose the court order, you&#8217;ll both state your cases at the full court hearing. You can show evidence and have witnesses testify. If the court feels the threat of <span data-term-id=\"39010986\">domestic violence<\/span> occurred or the threat remains, a <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-3\/\" target=\"_blank\" rel=\"noopener\"><u>final <span data-term-id=\"39010989\">domestic violence<\/span><span data-term-id=\"39010989\"> protection order<\/span> is issued<\/u><\/a>. Conditions from the temporary <span data-term-id=\"39010997\">DVPO<\/span> can be amended or new provisions added.<\/p>\n<p>The final <span data-term-id=\"39010997\">DVPO<\/span> can generally last up to one year.\u200b The court may renew the order for additional fixed terms of up to two years at a time if the protected party files a motion before the order expires and the judge finds good cause to extend it. There is no limit to the number of renewals, but temporary custody granted in a <span data-term-id=\"39010997\">DVPO<\/span> may not be extended beyond a total of one year, even if the rest of the order is renewed. Any <span data-term-id=\"39010997\">DVPO<\/span> issued in <span data-term-id=\"39010987\">North Carolina<\/span> is good anywhere in the United States <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\"><u>under federal law<\/u><\/a>, as long as it also complies with federal requirements.<\/p>\n<p>For a <span data-term-id=\"39010997\">DVPO<\/span> to work, the victim needs to call <span data-term-id=\"39011019\">law enforcement<\/span> any time the abuser either violates or threatens to violate the order. Penalties include <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-50b-domestic-violence\/nc-gen-st-sect-50b-4-1\/\" target=\"_blank\" rel=\"noopener\"><u>possible jail time for any violation<\/u><\/a>:<\/p>\n<ul>\n<li><strong>First or second violation (Class <span data-term-id=\"39011013\">A1 <\/span><span data-term-id=\"39010988\">misdemeanor<\/span>)<\/strong>: Up to 150 days in jail<\/li>\n<li><strong>Third or subsequent violation OR entering a safe house\/shelter OR in possession of a <span data-term-id=\"39011015\">deadly weapon<\/span> during a <span data-term-id=\"39010997\">DVPO<\/span> violation (<span data-term-id=\"39011033\">Class H felony<\/span>)<\/strong>: Between four and 24 months imprisonment<\/li>\n<\/ul>\n<p>These penalties are in addition to any sentences imposed for crimes that were part of the violation. Any felonies committed have their punishments enhanced by one class. For example, <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-14-criminal-law\/nc-gen-st-sect-14-27-22\/\" target=\"_blank\" rel=\"noopener\"><u>second-degree forceable rape is a <span data-term-id=\"39011023\">Class C<\/span> felony<\/u><\/a>. If committed as part of a <span data-term-id=\"39010997\">DVPO<\/span> violation, it would become a Class B2 felony instead.<\/p>\n<p>Knowing which <span data-term-id=\"39010993\">restraining order<\/span> you need can be complex and confusing. FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/north-carolina-law\/north-carolina-protective-orders-laws.html\"><u><span data-term-id=\"39010987\">North Carolina<\/span> Protective Orders Laws<\/u><\/a> article offers <span data-term-id=\"39011024\">what you need to know<\/span> about <span data-term-id=\"39010993\">restraining orders<\/span>.<\/p>\n<h2><span data-term-id=\"39010987\">North Carolina<\/span> <span data-term-id=\"39011001\">Domestic Violence<\/span><span data-term-id=\"39011001\"> Laws<\/span>: Other Programs and Options<\/h2>\n<p>Victims who flee their abusers can get help keeping their new location hidden. The <strong><span data-term-id=\"39010987\">North Carolina<\/span> Address Confidentiality Program (ACP)<\/strong> protects their safety by <a href=\"https:\/\/ncdoj.gov\/public-protection\/acp\/\" target=\"_blank\" rel=\"noopener\"><u>issuing victims a second legal address used for public records<\/u><\/a>. First-class mail is forwarded to the victim&#8217;s locations. There&#8217;s no cost for this program.<\/p>\n<p>Penalties for breaking a lease shouldn&#8217;t deter a victim from escaping their abuser. Under <span data-term-id=\"39010994\">North Carolina<\/span><span data-term-id=\"39010994\"> law<\/span>, <span data-term-id=\"39010991\">victims of <\/span><span data-term-id=\"39010986\">domestic violence<\/span>, <span data-term-id=\"39011000\">sexual assault<\/span>, or stalking are considered protected tenants and can <strong>make a legal break of a lease<\/strong> by giving the landlord written notice that provides a specific termination date at least 30 days after the landlord receives the notice. Documentation like a <span data-term-id=\"39010997\">DVPO<\/span>, criminal order, or ACP card should also be provided, along with a safety plan in certain cases. The tenant must still pay rent through the effective termination date.<\/p>\n<p>If the victim meets all requirements, the landlord may not charge an early\u2011termination fee or other penalty solely for ending the lease because of <span data-term-id=\"39010986\">domestic violence<\/span>. <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-42-landlord-and-tenant\/nc-gen-st-sect-42-45-1\/\" target=\"_blank\" rel=\"noopener\"><u>There&#8217;s no penalty for breaking the lease<\/u><\/a>, as long as the victim is up-to-date on their rent payments.<\/p>\n<p>You can recover expenses resulting from the actions of your abuser <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/filing-a-domestic-violence-lawsuit.html\"><u>by suing them in civil court<\/u><\/a> to recover damages. This includes medical bills, pain and suffering, and lost wages.
