Let&#8217;s take a look at how North Carolina views the charges.<\/p>\r\n<h3>North Carolina and First-Degree Murder Charges<\/h3>\r\n<p>To convict a defendant of <a href=\"https:\/\/www.findlaw.com\/state\/north-carolina-law\/north-carolina-first-degree-murder-laws.html\">first-degree murder<\/a> under North Carolina law, the prosecutor must prove that the individual intentionally killed another person under the following circumstances:<\/p>\r\n<ul>\r\n<li>Using a weapon of mass destruction<\/li>\r\n<li>By using poison, imprisonment, torture, lying in wait, or through any other willful, deliberate, and premeditated method<\/li>\r\n<li>During the commission (or attempt) of rape, <a href=\"https:\/\/www.findlaw.com\/state\/north-carolina-law\/north-carolina-arson-laws.html\">arson<\/a>, any sexual offense, burglary, robbery, kidnapping, or other felony, especially while using a deadly weapon<\/li>\r\n<\/ul>\r\n<p>In North Carolina, first-degree murder is a Class A felony, carrying a punishment of death or life in prison without the possibility of <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-15a-criminal-procedure-act\/nc-gen-st-sect-15a-1371\/\" target=\"_blank\" rel=\"noopener\">parole<\/a>.<\/p>\r\n<h3>North Carolina and Second-Degree Murder Charges<\/h3>\r\n<p>North Carolina law also recognizes <a href=\"https:\/\/www.findlaw.com\/state\/north-carolina-law\/north-carolina-second-degree-murder-laws.html\">second-degree murder<\/a>, which is the intentional killing of another human being with malice but without premeditation. Second-degree murder is a Class B1 felony, punishable by 144 months to life in prison.<\/p>\r\n<h3>Manslaughter Is a Lesser Included Offense of Murder<\/h3>\r\n<p>In North Carolina, both involuntary and voluntary manslaughter are lesser included offenses of murder. This means the state can charge a person with manslaughter directly or ask the court to convict someone of manslaughter rather than <a href=\"https:\/\/archive.findlaw.com\/blog\/what-is-first-degree-murder\/\" target=\"_blank\" rel=\"noopener\">murder<\/a> at the end of a murder trial.<\/p>\r\n<p>This typically happens when the state&#8217;s evidence is not strong enough to substantiate a murder conviction or when a defendant raises an <a href=\"https:\/\/dictionary.findlaw.com\/definition\/imperfect-self-defense.html\" target=\"_blank\" rel=\"noopener\">imperfect defense<\/a> to murder.<\/p>\r\n<p>Manslaughter is different from murder in several ways, including:<\/p>\r\n<ul>\r\n<li>Murder is the unlawful killing of another person with malicious intent, whereas manslaughter is the unlawful taking of a human life without <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-intent-to-kill-how-do-you-prove-it\/\">malice<\/a> and without the intent to kill<\/li>\r\n<li>Murder requires premeditation (planning) while manslaughter does not<\/li>\r\n<li>A person guilty of murder intended to end the victim&#8217;s life, while an individual who commits manslaughter does not intend to kill the victim<\/li>\r\n<li>With manslaughter, the victim&#8217;s death is a by-product of the defendant&#8217;s unlawful, <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/when-can-negligence-become-criminal\/\">negligent<\/a>, or reckless behavior<\/li>\r\n<li>A person guilty of first-degree murder may face the death penalty or life imprisonment without parole, while a defendant guilty of manslaughter cannot receive the <a href=\"https:\/\/www.findlaw.com\/state\/north-carolina-law\/north-carolina-capital-punishment-laws.html\">death penalty<\/a><\/li>\r\n<\/ul>\r\n<h2>Types of Manslaughter Under North Carolina&#8217;s Criminal Laws<\/h2>\r\n<p>There are three <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-manslaughter\/\">types of manslaughter<\/a> in North Carolina. The two most common types of manslaughter charges are voluntary and involuntary manslaughter. There is also a third type called vehicular manslaughter.<\/p>\r\n<p>North Carolina law defines voluntary and involuntary manslaughter like other states do. Voluntary manslaughter cases involve a defendant who intentionally killed another person but did so under the heat of passion or after adequate provocation.<\/p>\r\n<p>In North Carolina, voluntary manslaughter is a <a href=\"https:\/\/www.nccourts.gov\/documents\/publications\/offense-classifications\" target=\"_blank\" rel=\"noopener\">Class D felony<\/a>, carrying a mandatory minimum sentence of 51 months and a maximum penalty, for someone with no criminal record, of 64 months in prison. <a href=\"https:\/\/www.nccourts.gov\/assets\/documents\/publications\/FelonyChart_1013MaxChart.pdf?VersionId=JOZLdcExFM1TmlzHLiPcH7dUcMjQ8Ls7\" title=\"North Carolina&#039;s sentencing guidelines\" target=\"_blank\" rel=\"noopener\">North Carolina&#8217;s sentencing guidelines<\/a> vary depending on the circumstances and criminal record.<\/p>\r\n<p>Involuntary manslaughter cases involve a person who takes the life of another human being as a result of negligence or recklessness. In involuntary manslaughter cases, the state doesn&#8217;t have to prove the defendant intended to kill the victim. It must only prove that the defendant&#8217;s reckless or negligent behavior was the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-is-proximate-cause\/\">proximate cause<\/a> of the victim&#8217;s death.<\/p>\r\n<p>Vehicular manslaughter cases involve a defendant who killed another person while drunk driving. In these cases, the prosecutor must demonstrate that the individual was guilty of <a href=\"https:\/\/www.findlaw.com\/dui.html\">DWI<\/a> at the time of a fatal car accident. As with involuntary manslaughter, the state doesn&#8217;t have to prove intent in these cases.<\/p>\r\n<p>Vehicular manslaughter charges can be either a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\">misdemeanor or a felony<\/a>. If the state files misdemeanor vehicular manslaughter charges, the defendant faces up to 150 days in jail and fines. If the prosecutor pursues felony vehicular manslaughter charges, the penalty is 38 to 120 months in prison plus fines.<\/p>\r\n<p>In cases where the defendant&#8217;s behavior is considered egregious, the state can file <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-15a-criminal-procedure-act\/nc-gen-st-sect-15a-1340-16\/\" target=\"_blank\" rel=\"noopener\">aggravated felony<\/a> charges. These carry a penalty of 64 to 160 months in jail or prison and involve a defendant with prior DWI convictions.<\/p>\r\n<h2>Involuntary Manslaughter in General<\/h2>\r\n<p>North Carolina&#8217;s criminal laws define <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/involuntary-manslaughter-overview.html\">involuntary manslaughter<\/a> as the unintentional killing of another human being as the result of recklessness or criminal negligence.
