The laws of every state govern the relationship between landlords and tenants to make sure that both parties are protected. If you are a renter in North Carolina, or are considering entering into a lease, read on to learn about your legal rights as a tenant.<\/p>\n<h2>North Carolina Tenants Rights Laws Overview<\/h2>\n<p>Like all other states, North Carolina has put laws in place to protect the rights of tenants in residential leases. These laws cover a variety of important issues, including:<\/p>\n<ul>\n<li>How much a landlord can require as a <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/security-deposit-limits.html\" target=\"_blank\">security deposit<\/a><\/li>\n<li>The timeline for the return of the security deposit at the end of the lease<\/li>\n<li>Increases in rent and late fees for delinquent rent payments<\/li>\n<li>Landlord repairs and a tenants&#8217; right to <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/how-does-a-tenant-use-repair-and-deduct.html\" target=\"_blank\">&quot;repair and deduct&quot;<\/a><\/li>\n<li>Landlord <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/illegal-retaliatory-evictions.html\" target=\"_blank\">discrimination or retaliation<\/a><\/li>\n<\/ul>\n<p>The below chart provides more information about North Carolina&#8217;s tenants&#8217; rights laws.<\/p>\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\n<tbody><tr><td><p><b>Statutes<\/b><\/p>\n<\/td>\n<td>North Carolina <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-41a-state-fair-housing-act\/\" target=\"_blank\" rel=\"noopener\">State Fair Housing Act<\/a> and <a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-42-landlord-and-tenant\/\" target=\"_blank\" rel=\"noopener\">Landlord and Tenant Code<\/a><\/td>\n<\/tr><tr><td><p><b>Security Deposits<\/b><\/p>\n<\/td>\n<td><ul>\n<li>For a month-to-month lease, landlord can&#8217;t require more than one and one-half months&#8217; rent as a security deposit<\/li>\n<li>For a lease term of longer than a month, landlord can&#8217;t require more than two months&#8217; rent as a security deposit<\/li>\n<li style=\"list-style-type: none;\">Landlords can also require an additional &quot;reasonable&quot; nonrefundable deposit for pets<\/li>\n<li>Landlord must return a security deposit within 30 days of tenant move-out, or provide a final accounting of deductions within 60 days<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Paying Rent<\/b><\/p>\n<\/td>\n<td><ul>\n<li>There are no limitations on how much rent a landlord can charge in North Carolina, or how much notice a landlord must give before raising rent<\/li>\n<li>Landlord can&#8217;t charge a monthly late fee in excess of $15 or 5% of the rental payment, whichever is higher<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Living Conditions<\/b><\/p>\n<\/td>\n<td><ul>\n<li>Landlord is obligated to maintain unit in &quot;fit and habitable condition&quot;<\/li>\n<li>Tenant may &quot;repair and deduct&quot; if tenant fails to make important repairs<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Discrimination<\/b><\/p>\n<\/td>\n<td><ul>\n<li>It&#8217;s illegal for a landlord to discriminate against a tenant on the basis of race, color, religion, sex, national origin, handicapping condition, or familial status<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Ending or Renewing a Tenancy<\/b><\/p>\n<\/td>\n<td><ul>\n<li>If tenant fails to pay rent, landlord must provide at least 10 days&#8217; notice and give tenant opportunity to come current before commencing eviction proceedings<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Retaliation<\/b><\/p>\n<\/td>\n<td><ul>\n<li>It&#8217;s illegal for landlord to retaliate against tenant for exercising legal rights<\/li>\n<\/ul>\n<\/td>\n<\/tr><\/tbody><\/table>\n<p><b><i>Note:<\/i><\/b> <i>State regulations are always subject to change through the passage of new legislation, rulings in the higher courts (including federal decisions), ballot initiatives, and other means.
