The state law focuses on offering protection to the victim while making the offender accountable.<\/p>\r\n<table>\r\n<tbody><tr><td><p><b>Domestic violence defined<\/b><\/p>\r\n<\/td>\r\n<td><p>According to <a href=\"https:\/\/codes.findlaw.com\/nd\/title-14-domestic-relations-and-persons\/nd-cent-code-sect-14-07-1-01\/\" title=\"NDCC \u00a7 14-07.1-01(2)\" target=\"_blank\" rel=\"noopener\">NDCC \u00a7 14-07.1-01(2)<\/a>, domestic violence covers any of the following acts if committed against a family member or a household member:<\/p>\r\n<ul>\r\n<li>Physical harm<\/li>\r\n<li>Bodily injury<\/li>\r\n<li>Sexual activity compelled by physical force<\/li>\r\n<li>Assault<\/li>\r\n<li>Infliction of fear of imminent physical harm, bodily injury, sexual assault, or forced sexual activity<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Who qualifies as family or a household member<\/b><\/p>\r\n<\/td>\r\n<td><p>According to NDCC \u00a7 14-07.1-01(4), family or household members encompass a wide range of relationships, including:<\/p>\r\n<ul>\r\n<li>Current and former spouses<\/li>\r\n<li>Parents and children<\/li>\r\n<li>Persons related by blood or marriage<\/li>\r\n<li>Dating relationships<\/li>\r\n<li>Current or former cohabitants<\/li>\r\n<li>Persons who have a child in common, regardless of marriage or living status<\/li>\r\n<li>Any person with a sufficient relationship with the abuser, as determined by the court<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h2><b>Penalties for Violations of Domestic Violence Laws in North Dakota<\/b><\/h2>\r\n<p>The following fines and penalties apply to offenders found guilty of violating domestic violence laws:<\/p>\r\n<table>\r\n<tbody><tr><td><p><b>First violation<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li>Class A Misdemeanor<\/li>\r\n<li>Up to 1 year of prison sentence<\/li>\r\n<li>The laws also consider it as contempt of court<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Second or subsequent violation<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li>Class C Felony<\/li>\r\n<li>Up to 5 years of prison sentence<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p>In addition, the law orders the offender to make a personal appearance before the magistrate before release. The court may also require electronic monitoring or GPS tracking as a condition for the offender&#8217;s release.<\/p>\r\n<h2>Mandatory Arrests<\/h2>\r\n<p>North Dakota law encourages law enforcement officers to make an arrest when they respond to a domestic violence call. Under \u00a7 <a href=\"https:\/\/codes.findlaw.com\/nd\/title-14-domestic-relations-and-persons\/nd-cent-code-sect-14-07-1-10\/\" title=\" 14-07.1-10\" target=\"_blank\" rel=\"noopener\">14-07.1-10<\/a>, if police have probable cause to believe that a crime of domestic violence took place, officers &quot;shall presume that arresting the person is the appropriate response.&quot;<\/p>\r\n<p>So, while an arrest is not mandatory at every North Dakota domestic violence call, it is likely to happen. Police can make an arrest regardless of whether the domestic violence happened in their presence. They also do not need a warrant.<\/p>\r\n<p>If law enforcement officers receive multiple complaints from different family members, they must consider each complaint separately to determine if one party acted in <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/self-defense-defense-of-others-and-intentional-torts.html\" title=\"self-defense\">self-defense<\/a>.<\/p>\r\n<p>Police assess who the &quot;predominant aggressor&quot; is by considering various factors, including:<\/p>\r\n<ul>\r\n<li>The severity of the injuries<\/li>\r\n<li>Prior history of domestic violence<\/li>\r\n<li>Any other violent acts that indicate future harm is likely<\/li>\r\n<\/ul>\r\n<p>If someone is found in violation of a protection order, <a href=\"https:\/\/codes.findlaw.com\/nd\/title-14-domestic-relations-and-persons\/nd-cent-code-sect-14-07-1-11\/\" title=\"police must arrest them immediately\" target=\"_blank\" rel=\"noopener\">police must arrest them immediately<\/a>. These arrests are made without a warrant.<\/p>\r\n<h2><b>Protection Orders in North Dakota<\/b><\/h2>\r\n<p>North Dakota provides three types of <a href=\"https:\/\/www.findlaw.com\/state\/north-dakota-law\/north-dakota-protective-orders-laws.html\" title=\"domestic violence protection orders\">domestic violence protection orders<\/a>:<\/p>\r\n<h3><b>Emergency Protection Order<\/b><\/h3>\r\n<p>When the court is unavailable, the victim or the petitioner can seek an emergency protection order.<\/p>\r\n<p>This type of order of protection is valid for 72 hours and asks the petitioner to show that there is a risk of immediate and present danger.<\/p>\r\n<h3><b>Ex Parte Temporary Protection Order<\/b><\/h3>\r\n<p>This type of order of protection is available after a full hearing. <a href=\"https:\/\/codes.findlaw.com\/nd\/title-14-domestic-relations-and-persons\/nd-cent-code-sect-14-07-1-03\/\" title=\"An ex parte temporary protection order\" target=\"_blank\" rel=\"noopener\">An ex parte temporary protection order<\/a> may include the following provisions:<\/p>\r\n<ul>\r\n<li>No contact restrictions<\/li>\r\n<li>Temporary custody or temporary visitation rights of minor children<\/li>\r\n<li>Removal from shared dwelling<\/li>\r\n<li>Surrender for safekeeping of firearms<\/li>\r\n<\/ul>\r\n<h3><b>Domestic Violence Protection Order<\/b><\/h3>\r\n<p>The court issues a full protection order after notice and a full hearing within 14 days. A <a href=\"https:\/\/www.ndcourts.gov\/legal-self-help\/domestic-violence-protection-order\" title=\"Domestic Violence Protection Order (DVPO)\" target=\"_blank\" rel=\"noopener\">Domestic Violence Protection Order (DVPO)<\/a> may include the following:<\/p>\r\n<ul>\r\n<li>Restraining parties from threatening, molesting, injuring, harassing, or having contact with any other person<\/li>\r\n<li>Excluding respondent from dwelling<\/li>\r\n<li>Establishing temporary custody or temporary visitation rights to minor children<\/li>\r\n<li>Requiring or recommending counseling<\/li>\r\n<li>Ordering support payments<\/li>\r\n<li>Awarding temporary use of property<\/li>\r\n<li>Requiring safekeeping of firearms<\/li>\r\n<\/ul>\r\n<p>If you or your loved one is experiencing domestic violence in North Dakota, you must prioritize your safety.
