North Dakota has its own <a href=\"http:\/\/www.legis.nd.gov\/information\/acdata\/pdf\/46-02-07.pdf\" target=\"_blank\" rel=\"noopener\">overtime provision<\/a> and also follows the overtime laws of the federal <a href=\"https:\/\/codes.findlaw.com\/us\/title-29-labor\/29-usc-sect-207.html\" target=\"_blank\" rel=\"noopener\">Fair Labor Standards Act<\/a> (FLSA), which both requires employers to pay employees 1.5 their regular rate of pay for all hours worked over 40 in a workweek. However, North Dakota does not require employers to pay employees overtime for hours worked over eight hours per day or on weekends or holidays.<\/p>\r\n<h2>North Dakota Overtime Law Overview<\/h2>\r\n<p>The following chart lists key aspects of North Dakota&#8217;s overtime laws.<\/p>\r\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\r\n<tbody><tr><td><p><b>State and Federal Statutes<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li>North Dakota <a href=\"http:\/\/www.legis.nd.gov\/information\/acdata\/pdf\/46-02-07.pdf\" target=\"_blank\" rel=\"noopener\">Administrative Code \u00a7 46-02-07-02<\/a><\/li>\r\n<li><a href=\"https:\/\/codes.findlaw.com\/us\/title-29-labor\/29-usc-sect-207.html\" target=\"_blank\" rel=\"noopener\">Fair Labor Standards Act<\/a> (FLSA) overtime provision<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Overtime Calculation Methods:<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li><b>Hourly<\/b>: Pay time and a half (1.5 times the regular rate) for hours worked in excess of 40 hours per workweek.<\/li>\r\n<\/ul>\r\n<ul>\r\n<li><b>Hourly Plus Bonus and\/or Commission<\/b>: Regular rate = Total hours times hourly rate, plus the workweek equivalent of the bonus and\/or commission, divided by the total hours in the workweek; then pay half of that regular rate for each overtime hour.<\/li>\r\n<\/ul>\r\n<ul>\r\n<li><b>Salary:<\/b> Regular rate = Salary divided by the number of hours the salary is intended to compensate.<ul>\r\n<li>If the regular hours are less than 40: Add regular rate for each hour up to 40, then pay time and a half for hours over 40.<\/li>\r\n<li>If the regular hours = 40: Pay time and a half for hours over 40.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Exempt from FLSA<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li><b>The following classes of employees are not entitled to overtime pay in North Dakota<\/b> (partial list):<ul>\r\n<li>Administrative employees<\/li>\r\n<li>Professional employees<\/li>\r\n<li>Executive employees<\/li>\r\n<li>Salaried employees<\/li>\r\n<li>Outside salespeople<\/li>\r\n<li>Some computer employees\\<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i><b>Note:<\/b> State laws are always subject to change through the passage of new legislation, rulings in the higher courts (including federal decisions), ballot initiatives, and other means. While we strive to provide the most current information available, please consult an attorney or conduct your own legal research to verify the state law(s) you are researching.<\/i><\/p>\r\n<h2>Determining if North Dakota Law or the FLSA Applies<\/h2>\r\n<p>In cases where North Dakota overtime law and federal overtime law under the FLSA conflict, the law most beneficial to the employee usually prevails. However, to make closer determinations, one must look to the salary level and duties performed in order to determine if North Dakota law or the FLSA applies.<\/p>\r\n<h2>North Dakota Overtime Exemptions<\/h2>\r\n<p>Several kinds of workers are exempted from North Dakota overtime laws, including:<\/p>\r\n<ul>\r\n<li>Administrative employees<\/li>\r\n<li>Professional lecturers engaged in teaching in a school or educational system<\/li>\r\n<li>Nonprofit camp employees<\/li>\r\n<li>Individuals working as guides, cooks, or camp-tenders for a hunting or fishing guide
