Oklahoma is an at-fault state, meaning drivers file insurance claims with the other driver&#8217;s insurance company. Once the adjuster determines fault, the at-fault driver will pay for the damage and injuries of all victims.<\/p>\r\n<p>Oklahoma uses a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-is-comparative-negligence\/\" title=\"comparative negligence\">comparative negligence<\/a> rule if the parties file a personal injury lawsuit. Determining degrees of negligence becomes important in car accident cases. Knowing Oklahoma state laws and having a good personal injury lawyer are essential following a motor vehicle accident.<\/p>\r\n<h2><b>Oklahoma Car Accident Compensation Laws<\/b><\/h2>\r\n<p>Oklahoma uses an <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/proving-fault-in-accidents.html\" title=\"at-fault rule\">at-fault rule<\/a> for car accident claims. Drivers file insurance claims with the other driver&#8217;s insurance company. The insurance company reviews the other driver&#8217;s claim and evidence and then pays according to the policy.<\/p>\r\n<p>Oklahoma law requires drivers to carry <a href=\"https:\/\/www.oid.ok.gov\/wp-content\/uploads\/2020\/01\/2020_Auto-Brochure.pdf\" title=\"minimum liability insurance\" target=\"_blank\" rel=\"noopener\">minimum liability insurance<\/a> or file proof of financial responsibility with the Department of Public Safety. Minimum auto insurance requirements include:<\/p>\r\n<ul>\r\n<li>$25,000 bodily injury liability per person<\/li>\r\n<li>$50,000 bodily injury liability per accident<\/li>\r\n<li>$25,000 property damage liability<\/li>\r\n<\/ul>\r\n<p>Drivers can also file proof of self-insurance or a $75,000 certificate of deposit with DPS. But if the other driver&#8217;s claims max out their <a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/understanding-insurance-limits.html\" title=\"policy limits\">policy limits<\/a>, they will be liable for any remaining damages.<\/p>\r\n<p>Oklahoma does not require <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/uninsured-motorist-insurance-coverage-and-claims.html\">uninsured\/underinsured motorist insurance<\/a> (UI\/UIM) or personal injury protection (PIP) coverage. PIP provides coverage for car accident victims in accidents with uninsured drivers.<\/p>\r\n<h2><b>Comparative Fault<\/b><\/h2>\r\n<p>Oklahoma&#8217;s <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/contributory-and-comparative-negligence.html\">modified comparative fault<\/a> rule allows accident victims to recover damages even if they were partially responsible for the accident. In most car accidents, both drivers share fault. One driver ran a red light, but the other driver&#8217;s child distracted them before the crash. Under modified comparative negligence, a driver can recover as long as they are 50% or less at fault.<\/p>\r\n<p>Comparative negligence reduces the claimant&#8217;s recovery by their percentage of fault. If one driver is 10% at fault, and the other is 90% at fault, the claimant can only recover 90% of their total damages.<\/p>\r\n<h2><b>Damages and Limits<\/b><\/h2>\r\n<p>In a car accident lawsuit, &quot;<a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.html\">damages<\/a>&quot; are the monetary compensation for the injuries and property damage caused by the accident. You can claim <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/what-kinds-of-damages-may-i-claim-for-car-accident-injuries.html\">two basic types of damages<\/a> after a car accident.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.html\" title=\"Economic damages\"><b>Economic damages<\/b><\/a> are specific, objective costs of the accident calculated from accident reports and medical bills. Economic damages include:<\/p>\r\n<ul>\r\n<li>Medical expenses, including future costs of surgery and rehabilitation<\/li>\r\n<li>Lost wages and earning capacity<\/li>\r\n<li>Out-of-pocket repair costs<\/li>\r\n<\/ul>\r\n<p><b>Non-economic damages<\/b> are abstract or subjective costs, such as:<\/p>\r\n<ul>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/car-accident-pain-and-suffering-damages.html\" title=\"Pain and suffering\">Pain and suffering<\/a><\/li>\r\n<li>Emotional distress<\/li>\r\n<li>Loss of consortium<\/li>\r\n<li>Disability and disfigurement<\/li>\r\n<\/ul>\r\n<p>Oklahoma allows <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/when-can-you-sue-for-punitive-damages\/\" title=\"punitive damages\"><b>punitive damages<\/b><\/a> in personal injury claims if the driver&#8217;s actions were particularly reckless or malicious.<\/p>\r\n<h3><b>Limits<\/b><\/h3>\r\n<p>In 2019, <a href=\"https:\/\/caselaw.findlaw.com\/court\/ok-supreme-court\/1994645.html\" target=\"_blank\" rel=\"noopener\">Oklahoma&#8217;s Supreme Court<\/a> ruled that damage caps on non-economic damage claims were unconstitutional under Oklahoma law. Oklahoma statutes do not have any monetary caps on economic or non-economic damages. The cap on punitive damages is $100,000 or actual (economic) damages, whichever is greater.<\/p>\r\n<p>You have two years from the date of the accident to file a lawsuit after a car accident. The <a href=\"https:\/\/www.findlaw.com\/state\/oklahoma-law\/oklahoma-civil-statute-of-limitations-laws.html\">statute of limitations<\/a> applies to personal injury and property damage claims.
