No matter what name is used, the fallout of abusive crimes between <span data-term-id=\"39085652\">family members<\/span>, <span data-term-id=\"39085631\">household members<\/span>, and <span data-term-id=\"39085636\">intimate partners<\/span> can ruin lives and destroy families.<\/p>\n<p><span data-term-id=\"39085626\">Oklahoma<\/span> battles <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\"><u><span data-term-id=\"39085627\">domestic violence<\/span><\/u><\/a> with laws designed to punish offenders and protect victims. This article will explain how the state of <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70255\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39085626\">Oklahoma<\/span> defines <span data-term-id=\"39085627\">domestic violence<\/span><\/u><\/a>, examine the programs and protections available, and provide a roadmap for navigating the legal system. This collection of statutes focuses on preventing <span data-term-id=\"39085627\">domestic violence<\/span>. Since not every violent or abusive crime is considered <span data-term-id=\"39085627\">domestic violence<\/span>, it&#8217;s important to know what it is.<\/p>\n<p>For a crime to receive <span data-term-id=\"39085627\">domestic violence<\/span> classification, two elements are required. An <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70255\" target=\"_blank\" rel=\"noopener\"><u>abusive act considered eligible for <span data-term-id=\"39085627\">domestic violence<\/span> must occur between individuals sharing a qualifying relationship<\/u><\/a> under <span data-term-id=\"39085654\">Oklahoma<\/span><span data-term-id=\"39085654\"> law<\/span>. Let&#8217;s see if we can make that less confusing.<\/p>\n<p><span data-term-id=\"39085627\">Domestic violence<\/span> crimes are about <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\"><u>power and control<\/u><\/a>. Through different <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\"><u>types of <span data-term-id=\"39085628\">domestic abuse<\/span><\/u><\/a>, abusers take away personal freedoms from victims. They can employ threats, coercion, intimidation, and violence. In <span data-term-id=\"39085626\">Oklahoma<\/span>, <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70256\" target=\"_blank\" rel=\"noopener\"><u>crimes that fall into the following categories<\/u><\/a> are potential <span data-term-id=\"39085627\">domestic violence<\/span> offenses:<\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Harassment<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Stalking<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Domestic abuse, which includes but isn&#8217;t limited to:<\/span>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Causing physical harm or great bodily injury<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Threatening an act of physical harm or great bodily injury<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Domestic assault and battery<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Assault with a dangerous weapon<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Strangulation<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Disfigurement<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Any other types of bodily harm or physical violence<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Rape<\/span><\/li>\n<\/ul>\n<p>While the crime itself is one aspect of <span data-term-id=\"39085627\">domestic violence<\/span>, the participants also determine if it qualifies or not. <span data-term-id=\"39085626\">Oklahoma<\/span>&#8216;s definition of <span data-term-id=\"39085652\">family members<\/span>, <span data-term-id=\"39085631\">household members<\/span>, and <span data-term-id=\"39085636\">intimate partners<\/span> is larger than most states. The eligible participants are:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39085634\">Former spouses<\/span><\/li>\n<li>People who are in a <span data-term-id=\"39085638\">dating relationship<\/span> (with sex and\/or affection)<\/li>\n<li>People who were in a <span data-term-id=\"39085638\">dating relationship<\/span> (with sex and\/or affection)<\/li>\n<li>People with a child in common<\/li>\n<li>People who live together in an intimate way (sex not required)<\/li>\n<li>People who lived together in an intimate way (sex not required)<\/li>\n<li>Family by consanguinity (blood relatives)<\/li>\n<li>Family by marriage (in-laws or stepfamily)<\/li>\n<li>People living in the same household within the past year<\/li>\n<li>Parents<\/li>\n<li>Grandparents<\/li>\n<li>Stepparents<\/li>\n<li>Adoptive parents<\/li>\n<li><span data-term-id=\"39085639\">Foster parents<\/span><\/li>\n<li>Children (both grown and <span data-term-id=\"39085655\">minor children<\/span>)<\/li>\n<li>Grandchildren<\/li>\n<li>Stepchildren<\/li>\n<li>Adopted children<\/li>\n<li>Foster children<\/li>\n<\/ul>\n<p>If people sharing one of the above relationships are involved in one of the abusive acts listed above, it&#8217;s a <span data-term-id=\"39085627\">domestic violence<\/span> crime. <span data-term-id=\"39085653\">Victims of <\/span><span data-term-id=\"39085627\">domestic violence<\/span> crimes have <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=391724\" target=\"_blank\" rel=\"noopener\"><u>access to special programs and protections<\/u><\/a>. Abusers face enhanced penalties, <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70260\" target=\"_blank\" rel=\"noopener\"><u>mandatory <span data-term-id=\"39085627\">domestic violence<\/span> training classes that last 52 weeks<\/u><\/a>, and <span data-term-id=\"39085675\">jail time<\/span>.<\/p>\n<p>If an abuser is arrested for a <span data-term-id=\"39085627\">domestic violence<\/span> crime, the state of <span data-term-id=\"39085626\">Oklahoma<\/span> takes over the prosecution. Even if the victim doesn&#8217;t want to press charges, <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70264\" target=\"_blank\" rel=\"noopener\"><u>the prosecutor decides whether or not to proceed<\/u><\/a>.<\/p>\n<h2>Programs, Protections, and Penalties Under <span data-term-id=\"39085670\">Oklahoma<\/span> <span data-term-id=\"39085672\">Domestic Violence<\/span><span data-term-id=\"39085672\"> Laws<\/span><\/h2>\n<p>Now that we have a better understanding of what <span data-term-id=\"39085627\">domestic violence<\/span> is, let&#8217;s see what tools <span data-term-id=\"39085626\">Oklahoma<\/span> provides to combat it. One of the most effective methods for victim protection is an <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70256\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39085670\">Oklahoma<\/span> <span data-term-id=\"39085627\">domestic violence<\/span> <span data-term-id=\"39085629\">protective order<\/span><\/u><\/a>. While not perfect, <span data-term-id=\"39085629\">protective orders<\/span> combine protection for victims with stiff punishments for abusers.<\/p>\n<p>There are three types of <span data-term-id=\"39085627\">domestic violence<\/span> <span data-term-id=\"39085629\">protective orders<\/span> in <span data-term-id=\"39085626\">Oklahoma<\/span>, but their main variation is duration. All orders have provisions specific to each <span data-term-id=\"39085649\">domestic violence<\/span><span data-term-id=\"39085649\"> case<\/span>, but some are used often. Some of the <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70264\" target=\"_blank\" rel=\"noopener\"><u>most common conditions<\/u><\/a> are written into <span data-term-id=\"39085654\">Oklahoma<\/span><span data-term-id=\"39085654\"> law<\/span>:<\/p>\n<ul>\n<li>The defendant (abuser) must avoid the residence of the petitioner (victim) or any premises occupied by the petitioner<\/li>\n<li>The defendant must avoid contact that harasses or intimidates the petitioner at the home, work, or school of the petitioner, public places, in person, by phone, in writing, by electronic communication or device, or in any other manner<\/li>\n<li>The defendant can&#8217;t impersonate or adopt the personification of the petitioner for any reason<\/li>\n<li>The defendant can&#8217;t damage, dispose of, harm, hide, mistreat, or remove a household pet<\/li>\n<li>The defendant must obey a no-contact order with the petitioner unless the petitioner waives the right in writing<\/li>\n<li>The court can order a wireless provider to switch billing of the victim&#8217;s phone to the victim<\/li>\n<li>If temporary child custody is involved, the defendant must abide by any visitation decrees<\/li>\n<li>The defendant may have to obey <a href=\"https:\/\/www.atf.gov\/resource-center\/docs\/guide\/misdemeanor-crimes-domestic-violence-and-federal-firearms-prohibitions\/download\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39085659\">federal law<\/span><\/u><\/a> concerning firearm possession even if the <span data-term-id=\"39085626\">Oklahoma<\/span> <span data-term-id=\"39085629\">protective order<\/span> doesn&#8217;t have a provision for it<\/li>\n<\/ul>\n<p>A <span data-term-id=\"39085629\">protective order<\/span> can include some, none, or all of the provisions listed. The court can add any condition necessary for the victim&#8217;s safety.<\/p>\n<p>The first step to getting a <span data-term-id=\"39085629\">protective order<\/span> is <a href=\"https:\/\/oscn.net\/forms\/aoc\/protective-orders\/en-petition.pdf?d=202481415\" target=\"_blank\" rel=\"noopener\"><u>filling out the paperwork<\/u><\/a> and filing it at your <a href=\"https:\/\/mentalhealth.networkofcare.org\/oklahoma\/services\/agency?pid=OKLAHOMACOURTSYSTEMCOURTLOCATORPORTAL_2_1746_0\" target=\"_blank\" rel=\"noopener\"><u>local district courthouse<\/u><\/a>. For <span data-term-id=\"39085627\">domestic violence<\/span> <span data-term-id=\"39085629\">protective orders<\/span>, there&#8217;s no requirement for charges to be pressed at a police station or to have a police report.<\/p>\n<p>When you&#8217;re in immediate danger, and the courts are closed, there&#8217;s another option. You can file an <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70257\" target=\"_blank\" rel=\"noopener\"><strong><u>emergency ex parte <span data-term-id=\"39085629\">protection order<\/span><\/u><\/strong><\/a> through <span data-term-id=\"39085644\">law enforcement<\/span>. If a police officer is responding to a call and determines <span data-term-id=\"39085627\">domestic violence<\/span> has occurred, they can initiate the process themselves.<\/p>\n<p>Regardless of how it&#8217;s issued, an emergency ex parte order lasts until the end of the next judicial day. Before then, you need to file a petition for a <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70258\" target=\"_blank\" rel=\"noopener\"><strong><u>temporary ex parte order<\/u><\/strong><\/a> at the courthouse. In most instances, a judge will review the petition on the same day. If approved, the temporary order is issued ex parte, which means without first speaking to the defendant.<\/p>\n<p><span data-term-id=\"39085644\">Law enforcement<\/span> will attempt to serve the defendant with the order within 24 hours. The order lasts for 14 days but only begins once the defendant is served. If the defendant wants to oppose the order, you&#8217;ll have a court hearing within 14 days. <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70258\" target=\"_blank\" rel=\"noopener\"><u>This can be reduced to 72 hours if child custody is involved<\/u><\/a>.<\/p>\n<p>At the court hearing, both sides can make their arguments, present evidence, and call witnesses. If the court agrees with the petitioner, the temporary order becomes a <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70258\" target=\"_blank\" rel=\"noopener\"><strong><u>permanent <span data-term-id=\"39085629\">protective order<\/span><\/u><\/strong><\/a>. The duration is up to five years. If the defendant is incarcerated, the clock doesn&#8217;t begin until they&#8217;re released. The court can rule that the order has no end date if the threat is deemed serious enough.<\/p>\n<p>All <span data-term-id=\"39085629\">protective orders<\/span> issued in <span data-term-id=\"39085626\">Oklahoma<\/span> are covered <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\"><u>under <span data-term-id=\"39085659\">federal law<\/span><\/u><\/a> and are valid anywhere in the country. <span data-term-id=\"39085626\">Oklahoma<\/span> honors other orders <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=104903\" target=\"_blank\" rel=\"noopener\"><u>under state law as well<\/u><\/a>.<\/p>\n<p>Violations of <span data-term-id=\"39085626\">Oklahoma<\/span> <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70260\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39085629\">protective orders<\/span> carry serious ramifications<\/u><\/a>. Even a <span data-term-id=\"39085632\">first offense<\/span> can land you in jail. Penalties vary depending on the number of previous violations and if an injury is involved:<\/p>\n<ul>\n<li><strong>First violation<\/strong> (<span data-term-id=\"39085630\">misdemeanor<\/span>): Up to one year in <span data-term-id=\"39085660\">county jail<\/span> and a fine of up to $1,000<\/li>\n<li><strong>Any additional violations<\/strong> (felony): Between one to three years in the custody of the Department of Corrections and a fine of between $2,000 and $10,000<\/li>\n<li><strong>First violation with physical injury or physical impairment<\/strong> (<span data-term-id=\"39085630\">misdemeanor<\/span>): Between 20 days and one year in <span data-term-id=\"39085660\">county jail<\/span> and a fine of up to $5,000<\/li>\n<li><strong>Any additional violations with physical injury or physical impairment<\/strong> (felony): Between one to five years in the custody of the Department of Corrections and a fine of between $3,000 and $10,000<\/li>\n<\/ul>\n<p>Additional penalties include mandatory 52-week <span data-term-id=\"39085627\">domestic violence<\/span> treatment programs, <span data-term-id=\"39085662\">anger management<\/span> classes, and GPS tracking. The <a href=\"https:\/\/oklahoma.gov\/oag\/about\/divisions\/victim-advocacy-and-services-unit\/acp.html\" target=\"_blank\" rel=\"noopener\"><strong><u>Address Confidentiality Program (ACP)<\/u><\/strong><\/a> allows victims to have a <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=391269\" target=\"_blank\" rel=\"noopener\"><u>second legal mailing address<\/u><\/a> used for public records. This includes a driver&#8217;s license or a voter registration card. First-class mail is forwarded to the actual address. There&#8217;s no charge for this service.<\/p>\n<p>When escaping an abuser, <strong>breaking a lease<\/strong> might be necessary. <span data-term-id=\"39085627\">Domestic violence<\/span> victims are <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=71758\" target=\"_blank\" rel=\"noopener\"><u>covered under state law to break a lease without penalty<\/u><\/a>. Tenants must provide a written request, proof of a <span data-term-id=\"39085629\">protective order<\/span>, and 30 days&#8217; notice.<\/p>\n<p>Abusers have tried to game the system by harassing their victims with pointless, time-consuming, and <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=70258\" target=\"_blank\" rel=\"noopener\"><u>abusive litigation<\/u><\/a>.
