Generally, the Oklahoma statutes define prostitution as giving or receiving any of the following with someone other than your spouse in exchange for money (or thing of value):<\/p>\r\n<ul>\r\n<li>Sexual intercourse<\/li>\r\n<li>Fellatio<\/li>\r\n<li>Cunnilingus<\/li>\r\n<li>Masturbation<\/li>\r\n<li>Anal intercourse<\/li>\r\n<li>Any other sexual contact or <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-counts-as-criminally-lewd-behavior\/\">acts of lewdness<\/a><\/li>\r\n<\/ul>\r\n<p>If law enforcement catches you engaged in any of these acts, they will arrest you and charge you with the relevant crime. This could include prostitution, solicitation, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/pimping-and-pandering-laws.html\">pandering<\/a>, pimping, and other related charges.<\/p>\r\n<h2><b>Oklahoma\u2019s Prostitution Laws: Chart<\/b><\/h2>\r\n<p>If you\u2019re facing charges for prostitution, pimping, or solicitation, you should know what the penalties are for these crimes.<\/p>\r\n<p>The following chart highlights Oklahoma&#8217;s main prostitution and solicitation laws.<\/p>\r\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\r\n<tbody><tr><td style=\"width: 121.0px;\"><p><b>Code section <\/b><\/p>\r\n<\/td>\r\n<td><p>Oklahoma Criminal Code <a href=\"https:\/\/www.oscn.net\/applications\/OCISWeb\/DeliverDocument.asp?CiteID=69527\" target=\"_blank\" rel=\"noopener\">Section 21<\/a>-1030: Definitions<\/p>\r\n<p>Oklahoma Criminal Code <a href=\"http:\/\/www.oscn.net\/applications\/OCISWeb\/DeliverDocument.asp?CiteID=69526\" target=\"_blank\" rel=\"noopener\">Section 21-1029<\/a>: Engaging in, Soliciting, or Procuring Prostitution<\/p>\r\n<\/td>\r\n<\/tr><tr><td style=\"width: 121.0px;\"><p><b>What acts does Oklahoma law prohibit?<\/b><\/p>\r\n<\/td>\r\n<td style=\"width: 469.0px;\"><ul>\r\n<li>Engaging in prostitution<\/li>\r\n<li>Soliciting, inducing, facilitating, or enticing another to commit an act of prostitution<\/li>\r\n<li>Residing or using a building or vehicle for prostitution<\/li>\r\n<li>Aiding, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/aiding-and-abetting-accessory.html\">abetting<\/a>, or participating in any of the above acts<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td style=\"width: 121.0px;\"><p><b>Penalties<\/b><\/p>\r\n<\/td>\r\n<td><p>Oklahoma law treats prostitution as a misdemeanor punishable by imprisonment for 30 days to one year and the following fines:<\/p>\r\n<ul>\r\n<li>First conviction: up to $2,500<\/li>\r\n<li>Second conviction: up to $5,000<\/li>\r\n<li>Third or subsequent conviction: up to $7,500<\/li>\r\n<\/ul>\r\n<p>The court may also require the offender to serve between 40 and 80 hours of <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-community-service-when-can-you-get-it\/\">community service<\/a>.<\/p>\r\n<p>Any person who engages in prostitution while knowing they have HIV is guilty of a felony punishable by up to five years imprisonment.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h2><b>Child Prostitution<\/b><\/h2>\r\n<p>Child prostitution happens when someone engages a person under 16 in the act of prostitution.<\/p>\r\n<p>Child prostitution is a felony in Oklahoma and is punishable by imprisonment for up to 10 years and a fine of:<\/p>\r\n<ul>\r\n<li>First offense: up to $5,000<\/li>\r\n<li>Second offense: up to $10,000<\/li>\r\n<li>Third or subsequent offense: up to $15,000<\/li>\r\n<\/ul>\r\n<p>In child prostitution cases, the judge presumes the defendant coerced the victim into committing the offense in violation of Oklahoma&#8217;s human trafficking laws. Your criminal defense attorney must overcome this presumption if you expect an acquittal.<\/p>\r\n<h2><b>Human Trafficking<\/b><\/h2>\r\n<p><a href=\"https:\/\/www.justice.gov\/d9\/2023-06\/child_sex_trafficking_in_the_united_states_2.pdf\" target=\"_blank\" rel=\"noopener\">Human sex trafficking<\/a> has been going on for years. But, it has only been in recent years that the government has cracked down on this type of crime.<\/p>\r\n<p>Oklahoma&#8217;s criminal code treats human trafficking as being akin to modern-day slavery. The elements of the crime include:<\/p>\r\n<ul>\r\n<li>Extreme exploitation of human trafficking victims<\/li>\r\n<li>Denial of freedom or liberty<\/li>\r\n<li>To benefit from that person&#8217;s sex act or labor<\/li>\r\n<\/ul>\r\n<p>If the state can prove these three elements, the judge will convict you of human trafficking. The penalties for this crime are severe and can lead to lengthy prison sentences.<\/p>\r\n<p>Oklahoma law does not recognize consent as a defense to human trafficking. Victims of human trafficking can&#8217;t give their consent to criminal sexual exploitation. If you or someone you know has been a victim of human trafficking, contact an organization dedicated to promoting victim rights, such as the <a href=\"http:\/\/www.polarisproject.org\/what-we-do\/national-human-trafficking-hotline\/the-nhtrc\/overview\" target=\"_blank\" rel=\"noopener\">National Human Trafficking Resource Center<\/a>.<\/p>\r\n<h2><b>Houses of Prostitution<\/b><\/h2>\r\n<p>Under Oklahoma&#8217;s prostitution laws, it is also illegal to operate a house of prostitution or any other facility a defendant uses to conduct unlawful sexual intercourse. Operating a prostitution house is a misdemeanor and is punishable by a fine of at least $2,000.
