However, they refer to this activity in different ways. These laws generally fall under the umbrella of sex crimes. Under Oklahoma&#8217;s rape laws, it is rape if an offender forces their spouse to engage in sexual intercourse by using force or violence.<\/p>\r\n<h2><b>Oklahoma\u2019s Sexual Assault and Rape Laws: Summary<\/b><\/h2>\r\n<p>The following chart outlines Oklahoma&#8217;s main rape laws.<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Oklahoma Rape Law Code Section<\/b><\/p>\r\n<\/th>\r\n<td><p>Oklahoma Statutes <a href=\"http:\/\/www.oscn.net\/applications\/OCISWeb\/DeliverDocument.asp?CiteID=69606\" target=\"_blank\" rel=\"noopener\">Section 21-1114<\/a>: <b>First and Second-Degree Rape<\/b><\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Prohibited Acts Under Oklahoma Rape Laws<\/b><\/p>\r\n<\/th>\r\n<td><p>First-degree rape includes:<\/p>\r\n<ul>\r\n<li>Rape when the offender is over 18 and the victim is less than 14 years old<\/li>\r\n<li>Rape of a victim who is cannot consent due to mental illness<\/li>\r\n<li>Rape of a victim who is intoxicated due to the defendant administering a narcotic or anesthetic agent, common in date rape cases<\/li>\r\n<li>Rape of a victim who is unconscious and the offender knows that the victim is unconscious during sexual intercourse<\/li>\r\n<li>Rape the defendant accomplishes by force, violence, or threat of force or violence<\/li>\r\n<li>Rape by an instrument other than the defendant&#8217;s body part that results in bodily harm<\/li>\r\n<li>Rape by instrumentation when the victim is less than 14 years of age<\/li>\r\n<\/ul>\r\n<p>All other instances of rape qualify as second-degree rape.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/statutory-rape.html\"><b>Statutory Rape<\/b><\/a><b>:<\/b> It is against the law for a person over the age of 18 to have sexual relations with somebody under the age of 16, regardless of whether they consent to the sexual conduct.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Oklahoma Rape Law Penalties<\/b><\/p>\r\n<\/th>\r\n<td><p><b>First-degree rape:<\/b> This crime is a felony. The penalties are as follows and depend on the nature of the offense and the age of the victim:<\/p>\r\n<ul>\r\n<li>Death<\/li>\r\n<li>A prison sentence of at least five years<\/li>\r\n<li>Life in prison<\/li>\r\n<li>Life in prison without the possibility of parole<\/li>\r\n<\/ul>\r\n<p><b>Second-degree rape:<\/b> This offense is a felony and is punishable by imprisonment for one to 15 years.<\/p>\r\n<p>Individuals guilty of any sex crime in Oklahoma may have to complete mandatory <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/the-sex-offender-registry-what-you-need-to-know.html\">sex offender registration<\/a>.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h2><b>Age of Consent<\/b><\/h2>\r\n<p>The age of consent in Oklahoma is 16. This means that people who are 16 years old and older are legally mature enough to consent to having sexual intercourse with another person.
